I understand that such reports may include information obtained through private and public records and interviews with third parties, and may be used to make employment decisions.

Criminal background check

Credit report (for positions with financial responsibility)

Motor vehicle and driving record check

Investigative consumer report (personal and professional references)

I authorize all persons, schools, current and former employers, and organizations to provide the employer and its CRA with any information requested regarding my background. I release those parties and the employer from any liability for furnishing such information in good faith.

Legal Disclosures

At-Will Employment: If employed, I understand and agree that employment with the employer is at-will and may be terminated by either party at any time, with or without cause, and with or without notice, unless such status is expressly modified in a written agreement signed by an authorized representative of the employer.

Equal Opportunity: The employer is an equal opportunity employer. Employment decisions are made without regard to race, color, religion, sex, national origin, age, disability, genetic information, or any other characteristic protected by applicable law.

Applicant Certification and Release

I certify that all information I have provided on this form and any attachments is true, correct, and complete to the best of my knowledge. I understand that any falsification, omission, or misrepresentation of information may result in refusal to hire or immediate termination of employment, whenever discovered.

I authorize the employer to investigate and verify any statements contained in this document and to obtain reports about me from third parties. I understand that such investigations may include criminal history, credit history, motor vehicle records, education verification, drug and alcohol testing, and reference checks. I further authorize the release of any such information to the employer and its agents for employment purposes and waive any claims I may have against such parties for providing such information.

Acknowledgements

By signing below I acknowledge receipt of and consent to the terms above. I understand that if the employer intends to take an adverse employment action based wholly or partly on information in a consumer report, I will be provided with a copy of the report and a written statement of my rights under applicable law prior to such action being finalized.

What the Employee CRA Document Is and When It Applies

An Employee CRA Document is a written authorization and disclosure used by employers to request consumer reports or background checks from a consumer reporting agency (CRA). It documents an applicant or employee's consent, specifies the scope of the report (criminal, credit, motor vehicle, or employment history), and records the date and signature. The document helps employers demonstrate that they obtained affirmative consent before ordering a report and that they provided required disclosures. It can be delivered on paper or electronically when ESIGN and applicable state electronic signature laws are followed.

Why a Clear Employee CRA Document Matters

A properly drafted Employee CRA Document reduces legal risk, documents consent under consumer reporting laws, and creates an auditable record for hiring decisions. Clear scope, retention, and adverse-action steps support compliance and help avoid disputes related to unauthorized background checks.

Why a Clear Employee CRA Document Matters

Who Prepares and Who Signs the Employee CRA Document

Employers and HR teams prepare the document; applicants and employees provide the consent and signature required before a consumer report is obtained.

  • HR or Talent Acquisition teams responsible for screening and recordkeeping during hiring.
  • Third-party background screening vendors or in-house security teams that request reports from CRAs.
  • Applicants, contractors, or current employees who must provide informed consent for a check.

Maintain a copy of the signed document tied to the hiring record and include an audit trail of how and when the consent was captured.

Primary Signers and Document Owners

HR Manager

An HR Manager typically prepares the Employee CRA Document, selects the scope of the report, and retains signed authorizations in the employee file for compliance and audit purposes. They coordinate with vendors and legal counsel when policy changes are needed.

Applicant / Employee

The applicant or employee must provide affirmative, written consent and sign the document. Their signature establishes legal permission to pull consumer reports and creates attribution for later adverse-action procedures if needed.

Essential Data Elements to Include

Full legal name: Exact name on ID
Date of birth: MM/DD/YYYY
SSN or partial: SSN or last four digits
Current address: Street, city, state, ZIP
Scope of report: Types requested
Signature block: Signed and dated

Step-by-Step: Completing and Using the Employee CRA Document

Follow these sequential steps to obtain consent, request a consumer report, and handle results while maintaining compliance.

  • 01
Prepare disclosure: Draft clear disclosure describing the consumer report purpose.
  • 02
Obtain consent: Get a signed authorization prior to ordering a report.
  • 03
Order report: Send request to CRA with required identifiers.
  • 04
Adverse action: If denying, provide pre- and post-adverse action notices.

Where to Send and How to File the Signed Document

After signature, route the Employee CRA Document to internal HR records and to the background screening vendor or CRA as required by your process.

  • HR file: Store signed authorizations in the employee record.
  • Background vendor: Provide scanned copy for vendor processing.
  • Consumer reporting agency: Send identifiers securely to the CRA.
  • Retention system: Archive signed documents per retention policy.

Configuring an Electronic Workflow for CRA Authorizations

Recommended workflow settings reduce friction and create an auditable trail when collecting authorization electronically.

Field Configuration
Disclosure text Include explicit purpose and contact details
Required fields Make name, DOB, and signature mandatory
Authentication Use email + OTP or stronger methods
Retention Save signed PDF and audit trail

Technical Considerations for eSubmission and Distribution

Use secure, standards‑compliant tools and integrations to send, sign, and store CRA authorizations electronically.

  • Supported formats: PDF, DOCX, HTML
  • Integrations: Salesforce, NetSuite, Microsoft 365
  • Authentication: Email, SMS OTP, SSO

Choose a platform that produces tamper-evident PDFs, captures an audit trail, and supports your legal and industry compliance needs.

Key Timing Rules and Typical Deadlines

Timing matters for obtaining consent, ordering reports, and providing adverse action notices; build these triggers into your workflow.

Consent before order:

Obtain written authorization prior to requesting a consumer report

Pre-adverse action:

Provide a copy of the report and summary of rights prior to final adverse action

Adverse action notice:

Send a final adverse action notice promptly after decision

Recordkeeping start:

Retention period begins on the date the authorization was signed

Revocation handling:

Honor revocation requests and document the date received

Milestones from Authorization to Final Decision

A sequential milestone view helps teams track critical compliance touchpoints during screening and hiring.

01

Authorization Signed

Candidate signs consent and disclosure before any report is requested.

02

Report Requested

Employer or vendor sends identifiers to the CRA to obtain the report.

03

Report Received

Screening results are reviewed by HR or decision-maker.

04

Decision & Notice

If adverse, provide required notices and CRA contact information.

Common Mistakes When Preparing the Employee CRA Document

  • Using vague language about the scope of the report that extends beyond what was authorized, creating disputes.
  • Failing to obtain signed consent before ordering a report, which can violate consumer reporting rules.
  • Not storing the signed authorization with a tamper-evident audit trail and therefore lacking proof of consent.
  • Neglecting to provide pre- and post-adverse action notices when a report influenced the hiring decision.

Principal Penalties and Compliance Risks

FCRA liability: Statutory damages possible
Administrative fines: Regulatory penalties may apply
Adverse-action disputes: Consumer disputes and appeals
Reputational harm: Public complaints and lost trust
Hiring delays: Operational slowdown from errors
Data breach risk: Sensitive PII exposure risk

Anatomy of a Professional Employee CRA Document

Include these six components to make the authorization clear, enforceable, and useful for HR and compliance reviews.

Disclosure language

A clear disclosure describing that a consumer report may be obtained, the types of information the report may include, and the purpose of the check. This language must be separate from other employment-related text so the applicant understands they are consenting to a background check.

Scope and purpose

Explicit scope (criminal records, credit history, motor vehicle records, education/employment verification) and a stated purpose limited to employment decisions to avoid overbroad authorizations or future misuse of the report.

Identifiers

Fields for name, date of birth, and SSN or last four digits to help CRAs accurately match records. Clear instructions reduce mismatches that cause delays or incorrect results.

Signature and date

A dated signature line capturing the signer's intent. For electronic signatures, ensure the platform captures attribution, timestamp, and consent disclosures consistent with ESIGN and state law.

Duration and revocation

Specify how long the authorization remains valid and the procedure for withdrawing consent. A defined duration helps limit future, unauthorized requests.

Adverse action instructions

A short description of the employer's adverse action process, including how the applicant receives a copy of the report, the CRA name, and dispute rights, enabling compliance with adverse-action obligations.

Practical Tips for Accurate and Efficient Completion

Use consistent, documented procedures to collect authorizations and manage reports; these practices reduce legal exposure and improve turnaround time.

Standardize the form
Use a single, company-approved authorization template to ensure consistent disclosures, prevent omissions, and make audit reviews straightforward across hiring teams.
Use secure delivery
Transmit personal identifiers over encrypted channels and capture signed PDFs with audit trails to protect PII and demonstrate chain of custody.
Log and link records
Keep signed authorizations linked to the report and hiring decision in your HRIS or document repository to simplify compliance checks and response to consumer disputes.
Train staff
Provide clear guidance for recruiters and hiring managers about when consent is required, how to handle revocations, and the adverse-action workflow to avoid inconsistent practices.

Use-Case Examples from Hiring Operations

Realistic examples illustrate how teams incorporate the Employee CRA Document into hiring workflows and where electronic signatures add value.

Healthcare Employer

A medium-size hospital automates authorizations during onboarding to reduce manual paper handling.

  • The screening includes criminal and credential checks.
  • As a result, HR retains a searchable signed PDF and audit trail to meet internal and external audit requests while protecting patient safety.

Technology Company

A software firm uses an online authorization to collect applicant consent at offer stage.

  • The form limits scope to employment verification and criminal checks.
  • This reduces time-to-hire, ties the authorization to the HR record, and documents consent for any adverse-action communications.
