Effective Date:

Anticipated End Date:

Legal Authorization and Notices

By signing this Employee Deduction Authority, the Employee authorizes the Employer to deduct from the Employee's wages the amounts specified above and to remit such amounts as necessary to satisfy premiums, contributions, repayments, garnishments, or other obligations described herein. This authorization survives termination of employment only to the extent permitted by law and only for amounts accrued or owing at the time of termination.

The Employer shall comply with applicable federal, state and local law when making deductions. Deductions for court-ordered garnishments will be processed pursuant to the documentation provided by the relevant court or governmental authority. For other deductions, Employer will provide a periodic statement of amounts deducted upon Employee's written request.

Revocation: Employee may revoke this authorization only by providing written notice to Human Resources. Revocation will be effective only after Employer has had a reasonable opportunity to process the notice and will not affect deductions already taken in good faith.

Adjustment and Errors: Employee authorizes the Employer to adjust future deductions to correct arithmetic or administrative errors in prior payroll periods, provided adjustments comply with applicable wage and hour laws.

Employee Certification: I certify that all information provided on this form is true and complete. I authorize the Employer to contact my previous employers and references as necessary to verify employment history and other information supplied on this form and to conduct background checks as allowed by law. I understand that knowingly providing false information may result in disciplinary action, up to and including termination.

At-Will & Equal Opportunity Statements

Employment with the Employer is at-will unless otherwise expressly provided in a separate written agreement signed by an authorized representative of the Employer. Nothing in this form alters the at-will nature of employment.

The Employer is an equal opportunity employer. Decisions regarding employment, compensation, benefits and deductions are made without regard to protected characteristics, except when distinctions are required by law.

Acknowledgement

Employee acknowledges receipt of a copy of this Employee Deduction Authority and understands the terms set forth. Employee further acknowledges that deductions will be reflected in the employee pay statements and agrees to review pay statements and promptly notify Human Resources of any discrepancies.

What an Employee Deduction Authority Is

An Employee Deduction Authority is a written authorization that permits an employer to withhold specified amounts from an employee’s wages for purposes such as benefits premiums, retirement contributions, loan repayments, charitable deductions, or other agreed deductions. The form identifies the parties, describes the deduction types and amounts or percentages, sets an effective date, and records employee consent. In the United States, properly executed electronic versions can satisfy legal requirements under the ESIGN Act and UETA when intent, consent, attribution, and retention are demonstrable, and any statutory exceptions are observed.

Why a Clear Deduction Authority Matters

Using an Employee Deduction Authority clarifies consent, reduces payroll disputes, and documents the scope and timing of deductions. A clear authority helps employers comply with wage and withholding laws and supports auditability when retained with payroll records and signed consent evidence.

Common Preparation Mistakes to Avoid

  • Failing to specify exact amounts or percentages leads to payroll misapplied deductions and employee disputes; avoid vague language such as 'reasonable amount'.
  • Omitting start date or renewal terms can leave employers without authority to continue deductions after termination or contract change.
  • Using mismatched employee names or incorrect TINs causes backup withholding and IRS notice triggers.
  • Not documenting revocation procedures or notary/witness needs increases risk when employees contest deductions.

Penalties and Compliance Risks

Incorrect TIN: Triggers 24% backup withholding
Late 1099 filing: Penalties $60–$330 per form
Intentional disregard: $660+ per form, no cap
I-9 errors: Civil penalties $281–$2,789 each
