What an Employee Driver Record Request Is

An Employee Driver Record Request is a written authorization that allows an employer or authorized agent to obtain an employee's driving history (motor vehicle record or MVR) from a state motor vehicle agency or an authorized third-party vendor. Employers use it for hiring, annual or periodic checks, post-accident reviews, insurance underwriting, and regulatory compliance for commercial drivers. The request documents the scope of the record being requested, identifies the requester and subject, and captures the employee's informed consent, which may be required under state law and federal regulations where applicable.

Why this Request Matters for Safety and Compliance

Collecting driving records helps reduce fleet risk, supports insurance and safety programs, and documents a lawful consent path for obtaining MVR data. Properly completed records protect employers during hiring decisions, post-incident investigations, and audits while demonstrating a defensible, consistent process.

Why this Request Matters for Safety and Compliance

Who typically issues or completes this form

Employers and organizations that operate vehicles or manage drivers rely on a formal Employee Driver Record Request to obtain MVRs and document consent.

  • Human resources teams and talent acquisition managers responsible for background checks and hiring decisions.
  • Fleet or transportation managers who monitor driver performance and safety qualifications.
  • Risk, safety, and compliance officers overseeing insurance, regulatory, or DOT requirements.

The same form can be used for initial hiring, periodic screening, post-accident requests, or as part of an internal audit trail when retained with supporting documentation.

Essential parts of a professional Employee Driver Record Request

A clear, legally defensible request groups identity details, consent language, the scope and purpose of the check, authorized recipients, and signature evidence so the request can be processed by DMVs or vendors and retained for compliance.

Authorization

Explicit consent language authorizing the release of driving records, including scope and duration, tailored to applicable state requirements.

Employee Identity

Full legal name, date of birth, driver license number, and state of issuance to match DMV records and avoid mismatches.

Scope of Request

Specify the record type requested (driving history, infractions, suspensions) and the time range to limit retrieval to what is necessary.

Intended Use

A short statement describing why the MVR is requested (hiring, insurance, post-accident investigation, regulatory compliance).

Recipient Details

Name and contact of the employer or authorized third-party who will receive the record and how it will be stored and used.

Signature Block

Employee signature, printed name, and date; include witness or notarization if state law or company policy requires it.

Required fields to include on the request

Full Legal Name: Employee's complete legal name
Date of Birth: MM/DD/YYYY
Driver License Number: License number exactly as issued
State of Issue: Two-letter postal abbreviation
Consent Checkbox: Typed or checked consent statement
Requesting Employer: Company name and contact

Step-by-step: Completing and sending the request

Follow these steps to collect consent, request an MVR, and retain the result in a compliant audit trail.

  • 01
    1. Prepare Form: Populate employer and employee identity fields accurately.
  • 02
    2. Obtain Consent: Have the employee sign and date the authorization.
  • 03
    3. Submit Request: Send to state DMV or an authorized MVR vendor.
  • 04
    4. Store Record: Keep signed request and MVR in secure employee file.

Where to send the completed request

A completed request can be routed to state DMVs, certified MVR vendors, or internal recipients depending on company policy and state rules.

  • State DMV: Direct submission where allowed by state processes.
  • MVR Vendor: Authorized third-party providers that aggregate state MVRs.
  • Insurance Carrier: When requested for underwriting or claims.
  • Internal HR File: Retain a copy in the secure personnel or fleet record.

Digital submission and platform considerations

Use platforms that support secure file formats, strong authentication, and a verifiable audit trail when collecting and sending driver record requests.

  • File Formats: PDF or PDF/A for long-term retention
  • Integrations: Supports HRIS, fleet management, and cloud storage
  • Authentication: Email+SMS or stronger signer verification options

Ensure the chosen platform can export signed records and metadata (timestamp, signer identity, IP address) for audits and that it supports your retention policy and any required BAAs.

Configuring an online workflow for MVR requests

Design the digital workflow to reduce errors and automate routing while preserving evidence of consent and access.

Field Mapping Map form fields to HRIS to prevent manual entry errors
Conditional Consent Show consent only when a driver role is selected
Signer Authentication Require SMS code or KBA for higher assurance
Audit Trail Capture timestamps, IP, and document history
Notification Routing Auto-notify HR, fleet manager, and insurance partners

Typical timelines and processing expectations

Processing times vary by state and vendor; set internal deadlines to ensure timely checks for hiring, post-incident reviews, and insurance reporting.

Employee Return:

Recommend 7 calendar days to return signed consent

Vendor Processing:

Most vendors return MVRs within 1–3 business days

State DMV Response:

State response commonly ranges from 1–14 business days

Post-Accident Review:

Initiate request immediately; complete review within 30 days

Retention Trigger:

Record when request issued and when MVR received

Key milestones in the MVR request lifecycle

Track four sequential milestones from issuing the request through final review and retention.

01

Request Issued

Form created and sent to employee for signature.

02

Consent Returned

Signed authorization received and validated by HR.

03

Record Retrieved

MVR obtained from DMV or vendor and logged.

04

Review and File

Safety review completed and record retained securely.

Common mistakes to avoid

  • Missing or incorrect driver license number causing mismatched DMV searches and delays in obtaining accurate records.
  • Expired or undated consents that can invalidate the request and require reauthorization from the employee.
  • Overbroad scope requests that exceed what is necessary, potentially violating state privacy rules or vendor policies.
  • Failing to retain the signed authorization and audit trail, leaving employers unable to demonstrate lawful access during audits.

Risks and potential penalties from errors

Liability Exposure: Potential employer liability for negligent hiring
Insurance Impact: Higher premiums or denied claims for noncompliance
Regulatory Fines: Sanctions where statutory consent rules are violated
Invalid Consent: Records obtained without valid consent may be unusable
Data Breach: Unauthorized disclosure of PII carries breach risk
Discrimination Claims: Improper use of MVR info could trigger legal claims

Practical tips for accurate, efficient requests

Adopt consistent processes that reduce friction for employees while preserving legal defensibility and an auditable record.

Standardize the form
Use a single, version-controlled request template across the organization. Include mandatory fields, consent language, scope, and a signature block so every request is uniform and easier to validate during audits.
Verify identity before submission
Confirm the employee's identity with a government-issued ID or an authenticated e-sign process. Identity mismatches at the DMV cause delays and increase operational cost and error rates.
Automate where possible
Integrate form completion with HRIS and MVR vendors to reduce manual entry. Automated routing, field population, and audit trails shorten turnaround and reduce transcription mistakes.
Protect and limit access
Restrict access to retrieved MVRs to those with a business need and store records in encrypted storage with role-based permissions to limit breach risk.
