Drug and Alcohol Testing Policy — Acknowledgment and Consent

I acknowledge receipt of the Employer's Drug and Alcohol Program and understand that the program requires testing under the circumstances described below. I consent to submit to testing in accordance with this program and authorize the release of test results to the Employer and the designated Medical Review Officer (MRO) as necessary for policy administration.

Circumstances for testing (check all that apply):

Substances to be tested (typical panel): check any additional tests you understand may be administered.

Testing Procedures and Medical Review

Collection will be conducted by a qualified collection site and chain-of-custody procedures will be followed. Specimens will be forwarded to a certified laboratory for analysis. Positive laboratory results will be reviewed by the MRO, who will determine whether an alternative medical explanation exists prior to reporting a confirmed positive to the Employer.

Confidentiality, Release of Information and Authorization

Test results and related health information will be treated as confidential to the extent permitted by law. By signing this form I authorize the MRO, laboratory, and collection site to release my drug and alcohol test results and relevant medical history to the Employer and to the Employer's designated safety or human resources representatives for purposes of evaluating fitness for duty, disciplinary action, accommodation, and return-to-duty determinations.

Refusal, Positive Results and Discipline

Refusal to submit to testing, tampering with a specimen, or a verified positive result may result in disciplinary action up to and including termination, consistent with applicable laws and Company policy. The Employer may require rehabilitation, discipline, or removal from safety-sensitive duties as appropriate. Any required return-to-duty testing and follow-up testing will be at the Employee's expense where permitted by law and policy.

Chain of Custody and Sample Integrity

I understand collection personnel will follow strict chain-of-custody procedures. I will not alter, adulterate, or substitute any specimen. I understand that collection site personnel may conduct direct observation collections where required by policy.

Authorization to Contact Previous Employers and Conduct Background Checks

I authorize the Employer to contact prior employers, education institutions, references, and any listed providers for purposes of verifying my employment history, safety record, and other information relevant to this program. I also authorize any background or records checks required by policy. I release prior employers and other parties from liability for providing information in good faith.

Rehabilitation, Accommodation and Return-to-Duty

Where appropriate and consistent with law and Company policy, Employees with a verified substance use issue may be offered referral to a qualified treatment provider and may be permitted to return to work following successful completion of required treatment and drug testing. Return-to-duty requires a negative test and may include follow-up testing as directed by the MRO or company policy.

Employee Certification

I certify that the information provided on this form is true and complete to the best of my knowledge. I understand that falsification, omission, or misrepresentation of information may subject me to disciplinary action, up to and including termination. By signing below I provide voluntary informed consent to drug and alcohol testing under the terms of this program and to the use and disclosure of test results as described herein.

What the Employee Drug and Alcohol Program Form Is

The Employee Drug and Alcohol Program Form is a standardized workplace document that records an employer's testing policy, employee acknowledgement and consent, and the mechanics for drug and alcohol screening. It typically lists covered testing events (pre-employment, reasonable suspicion, post-accident, random, return-to-duty), describes sample collection and chain-of-custody procedures, and sets out confidentiality and result-reporting practices. Employers use the form to align internal safety protocols with federal or industry rules and to create a record for HR, occupational health, and compliance purposes.

Why a Clear Program Form Matters for Employers

A precise form clarifies expectations, documents consent, and standardizes test handling to reduce disputes and administrative errors. It helps demonstrate consistent enforcement of policy, supports workplace safety, and provides an auditable record useful in regulatory reviews or litigation.

Why a Clear Program Form Matters for Employers

Who Typically Prepares and Signs This Form

Use this form when HR, safety, or occupational health teams administer workplace testing programs.

  • Human resources and benefits administrators who maintain employee records and ensure policy compliance.
  • Supervisors and safety managers who document reasonable-suspicion observations and authorize testing.
  • Third-party collection labs and testing vendors who receive chain-of-custody and consent information.

Signed copies are retained by the employer and, when required, shared with testing providers and authorized reviewers.

Core Sections to Include in a Professional Form

A comprehensive form groups policy elements and operational details so each test event is documented consistently and defensibly.

Employee Consent

Clear statement that the employee consents to the testing program, including scope, types of tests (urine, saliva, breath), and signature/date fields for acknowledgement and legal admissibility.

Covered Events

Lists situations triggering tests — pre-employment, reasonable suspicion, post-accident, random selection, return-to-duty — with short descriptions of each event and who may order testing.

Collection Protocol

Chain-of-custody instructions, specimen labeling, collector responsibilities, and steps to prevent sample tampering or contamination during transport to the laboratory.

Result Handling

Procedure for notifying the employer, employee, and medical review officer (MRO); confirmatory testing protocol; and how positive results are documented and appealed.

Confidentiality

Limits on disclosure, secure storage of results, and roles with authorized access to protect medical and sensitive information in line with applicable privacy laws.

Return-to-Duty

Conditions for reinstatement, follow-up testing schedules, treatment or Employee Assistance Program (EAP) referrals, and any agreed monitoring requirements.

Step-by-Step: How to Complete the Form

Follow a consistent sequence so the form documents a complete, auditable testing event from initiation to record retention.

  • 01
Prepare Form: Confirm policy version and pre-fill employer details.
  • 02
Obtain Consent: Review policy with employee and capture signature.
  • 03
Collect Specimen: Follow chain-of-custody and collection protocol.
  • 04
Record Results: Attach lab report and document notifications.

How to Configure an Online Workflow

Design the digital flow so fields, authentication, and routing enforce your policy and reduce manual steps.

Field Configuration
Authentication Method Use email link or SMS code for signer verification; stronger auth for sensitive records.
Conditional Fields Show confirmatory-result fields only when initial screen is positive to simplify completion.
Signature Placement Place signature and date fields for employee, collector, and reviewer in order.
Storage Location Route completed forms to secure HR and occupational health folders with restricted access.

Where the Completed Form Goes and Who Sees It

Define routing so completed records reach the right custodians while limiting unnecessary disclosure of sensitive information.

  • Employee Copy: Provide the employee with a signed copy for review and appeal.
  • Occupational Health: Route test results and medical notes to occupational health staff only.
  • HR Records: Store policy acknowledgements in the employee file with restricted access.
  • Testing Vendor: Send chain-of-custody and specimen details to the lab securely.

Digital Signing and eSubmission Considerations

Ensure the eSignature platform supports required authentication, audit trails, and secure storage for health-related records.

  • File Formats: PDF and DOCX supported for templates.
  • Integrations: Connectors available for HRIS and storage systems.
  • Advanced Auth: SMS, SSO, or KBA for higher trust.

Choose a provider that offers HIPAA BAA capability if medical information is recorded and ensure the solution captures a complete audit trail for each signed form.

Timelines, Deadlines, and Typical Processing Expectations

Timelines vary by policy and industry; document each stage so stakeholders know expected response windows and retention triggers.

Pre-employment Issue:

Provide the form before any pre-employment test or as part of conditional offer steps.

Random Testing Notice:

Notice timing depends on policy and collective bargaining agreements.

Positive Result Handling:

Initiate confirmatory testing and MRO review as the policy dictates.

Appeal and Retest:

Allow the employee defined time to request retesting or provide medical explanation.

Processing Expectations:

Laboratory turnaround and MRO review typically take several business days.

Penalties and Risks of Incorrect or Missing Documentation

I-9 Noncompliance: Civil fines $281–$2,789
HIPAA Exposure: Civil penalties for improper PHI disclosure
Discrimination Claims: Risk of ADA or EEOC challenges
Chain-of-Custody Gaps: Laboratory results may be excluded
Contractual Breach: Violation of collective bargaining terms
Criminal Liability: Rare but possible in tampering cases

Common Mistakes Employers Make

  • Failing to obtain explicit informed consent or to document employee acknowledgment increases dispute risk and regulatory scrutiny.
  • Using inconsistent forms or outdated policy versions causes confusion and makes enforcement decisions appear arbitrary.
  • Poor chain-of-custody documentation at collection leads laboratories or MROs to invalidate results or decline confirmation testing.
  • Over-sharing test results without a defined access policy can violate privacy rules or expose the employer to HIPAA or state privacy claims.

Practical Tips to Improve Accuracy and Compliance

Adopt consistent procedures, train staff, and use secure digital tools to reduce errors and improve recordkeeping.

Use a single canonical form
Maintain one current template for all testing types and version-control it centrally. Attach a revision date and archive prior versions to demonstrate policy history in audits or disputes.
Train collectors and supervisors
Provide routine training on collection protocol, reasonable-suspicion documentation, and privacy rules. Well-documented training reduces procedural errors and improves defensibility.
Limit access to results
Restrict signed test records to HR and authorized medical reviewers. Use role-based permissions and logging to show who accessed or exported sensitive data.
Keep an audit trail
Record timestamps, IP addresses, and signer authentication methods for each e-signed form. An audit trail supports legal admissibility and demonstrates compliance with electronic signature laws.
