Equal Opportunity: The employer provides equal employment opportunities without regard to race, color, religion, sex, national origin, age, disability or other protected status. The drug testing program is administered uniformly and consistent with applicable law.

By signing below I grant my informed, written consent to the employer and its designated agents to conduct drug and/or alcohol testing in accordance with the employer's policy. Testing may include but is not limited to urine, blood, hair, saliva, and breath analysis. I understand testing may occur under the following circumstances (select all that apply and initial where requested):

Methods of Testing & Collection Procedures

I understand the employer may utilize the following specimen collection and testing methods. I consent to the collection of specimens and agree to cooperate with chain-of-custody procedures to ensure the integrity of specimens:

Consequences of Refusal or Positive Result

I understand that refusal to submit to testing, tampering with specimens, or a confirmed positive test result may subject me to disciplinary action up to and including termination of employment, in accordance with employer policy and applicable law. I understand a confirmed positive result may be referred to a Medical Review Officer (MRO) for verification and that I will be given the opportunity to provide information regarding prescription or over-the-counter medications that could affect results.

Confidentiality and Release

Test results and related medical information shall be maintained as confidential medical records and disclosed only to individuals with a legitimate need to know, except as required by law. By signing, I authorize any physician, laboratory, employer, or other person who has records or knowledge of my drug or alcohol testing to release such information to the employer, its authorized agents, and to the Medical Review Officer for purposes of determining fitness for duty, compliance with the employer's policy, and making employment decisions.

I further authorize the employer to obtain records of prior alcohol and drug testing from former employers, and to conduct background checks and employment verifications, as necessary to evaluate my suitability for employment and compliance with applicable regulations.

Applicant / Employee Certification and Authorization

I certify that all information provided in this form is true and complete to the best of my knowledge. Acknowledgment

I acknowledge receipt of a copy of this consent form and a copy of the employer's drug and alcohol testing policy. I understand my rights and responsibilities under that policy and under applicable law. What the Employee Drug Consent Form Is and When It Applies

An Employee Drug Consent Form documents an employee's informed agreement to drug testing as a condition of hiring, continued employment, random screening, reasonable suspicion testing, or return-to-duty procedures. The form explains the types of tests used, sample collection procedures, limits on disclosure, and the employer's testing policy. It can be executed on paper or electronically where ESIGN and applicable state law permit. When medical information is involved, the form should be drafted and stored consistent with HIPAA privacy and recordkeeping rules.

Why a Clear Consent Form Matters for Employers and Employees

A well-drafted consent form creates a record of informed agreement, clarifies testing scope and consequences, and supports defensible chain-of-custody and privacy practices under employment and health-data rules.

Why a Clear Consent Form Matters for Employers and Employees

Who Typically Uses This Form

Organizations and staff who manage hiring, safety, and compliance commonly use the Employee Drug Consent Form.

  • Human resources and people operations teams that implement pre-employment and periodic screening programs and track compliance with company policy and law.
  • Supervisors and safety managers who initiate reasonable-suspicion tests to document observations and protect workplace safety.
  • Occupational health providers and clinic administrators who collect specimens and handle medical privacy responsibilities.

Use consistent procedures across hiring and safety workflows to reduce disputes and ensure traceable, auditable consent records.

Who Can Sign and Why Their Role Matters

HR Manager

An HR Manager often signs as the employer representative to confirm that the policy was provided and explained. Their signed copy documents the employer's disclosure of testing procedures, disciplinary consequences, and any accommodations considered under disability law.

Employee / Applicant

The employee or job applicant must sign to show informed consent. A clear signature links the individual to notices about test types, data use, and privacy protections; mismatched signatures or missing consent can invalidate testing outcomes.

Step-by-Step: Completing the Form

Follow these steps to collect consistent, legally defensible consent.

  • 01
Provide Policy: Give the employee the written testing policy before signing.
  • 02
Confirm Identity: Verify ID at collection to match form details.
  • 03
Detail Scope: Specify triggers and test types on the form.
  • 04
Obtain Signature: Have the signer sign and date, capturing format and method.

Essential Components to Include in a Professional Form

A comprehensive Employee Drug Consent Form combines plain-language disclosures with procedural and legal details to reduce disputes.

Consent Language

Clear, unambiguous text stating that the signer consents to specified drug tests under stated conditions, including any disciplinary consequences for refusal or evasion.

Collection Procedures

Describe specimen type, collection method, chain of custody steps, and lab accreditation expectations so the process is transparent and repeatable.

Privacy Protections

State how test results will be stored, who may access them, and whether results will be shared with third parties, consistent with HIPAA where applicable.

Revocation and Withdrawal

Explain whether and how consent can be withdrawn, and the consequences of withdrawal for employment status or access to alternative procedures.

Reasonable Accommodations

Reference the employer's process for disability accommodation requests and how testing interacts with ADA obligations.

Signatory Details

Include printed name, signature, title (if employer rep), date, and a witness or notary block when required by state law or company policy.

Where to Send and How the Form Moves Through Your Process

Typical routing keeps the consent record with HR, the collector, and a secure long-term archive.

  • Upload Document: Sender uploads form and pre-fills key fields.
  • Assign Signers: Assign employee, HR rep, and collector roles.
  • Send to Signer: Signer receives email or link to sign.
  • Store Copies: Store signed PDF with audit trail in secure archive.

Timelines and Key Deadlines to Observe

Observe clear timing for providing the policy, obtaining consent, and retaining records to support later review or dispute resolution.

Policy Delivery:

Provide testing policy before the consent request.

Signing Window:

Obtain signed consent before specimen collection.

Collector Reporting:

Submit chain-of-custody to lab within 24–48 hours.

Result Notification:

Common Preparation Mistakes to Avoid

  • Using vague consent language that fails to specify triggers, sample types, or disciplinary consequences increases legal risk and confusion.
  • Collecting signatures without verifying identity or lacking a chain-of-custody record can lead labs and adjudicators to question results.
  • Ignoring privacy rules for medical information, including HIPAA protections, can expose employers to compliance and disclosure penalties.
  • Failing to capture electronic audit trails or consumer ESIGN disclosures may undermine admissibility of an e-signed consent form.

Penalties and Risks if the Form Is Deficient

HIPAA Breach: Fines and corrective action
Employment Claim: Wrongful termination or discrimination suits
Unusable Evidence: Lab results excluded in disputes
Chain-of-Custody Failure: Invalidated test outcomes
State Penalties: Fines under state privacy law
Privacy Violation: Regulatory enforcement exposure

Realistic Use Cases and Outcomes

Two concise examples show how consistent forms and processes reduce disputes and speed resolution.

Construction Contractor

A mid-size contractor standardized its consent form and chain-of-custody procedure to reduce result disputes.

  • The change improved documentation.
  • Consistent forms plus verified collection reduced contractor liability and improved safety compliance across multiple job sites.

Community Health Clinic

A clinic added HIPAA language and a secure e-sign workflow to patient-staff testing consent.

  • E-sign audit trails recorded attribution.
  • The clinic preserved confidentiality and accelerated administrative processing while meeting privacy obligations.

Supporting Documents to Include with the Consent Form

Attach or reference companion documents to complete the record and support testing integrity.

Chain of Custody

A completed chain-of-custody form documents specimen handling from collection to lab receipt and is essential to demonstrate sample integrity and continuity.

Lab Authorization

A lab authorization or requisition lists requested assays, billing codes, and lab contact information so specimens are processed according to employer instructions.

Policy Statement

A clearly posted testing policy explains triggers, disciplinary consequences, and the appeals process; attach it or include a version reference on the consent form.

Accommodation Request

A form for disability accommodation requests documents any alternative testing arrangements considered under the ADA or similar laws.

Practical Tips for Accurate and Efficient Completion

Follow these best practices to reduce administrative errors and legal exposure.

Use Plain-Language Consent
Write clear, concise consent language that a reasonable person can understand; avoid legalese that obscures testing scope or consequences.
Verify Identity at Collection
Require a government ID at specimen collection; document the verifier's name and method to reduce mismatching risks.
Capture an Audit Trail for E-Signatures
When using electronic signatures, record IP, timestamp, and authentication method to establish signer attribution and support admissibility.
Limit PHI Exposure
Store test results separately with access controls and only share results on a need-to-know basis to comply with HIPAA and privacy laws.
