EMPLOYEE DRUG MISUSE POLICY

Company Identification

Purpose

This Policy sets forth the Company's commitment to a safe, healthy and productive workplace by prohibiting the unlawful manufacture, distribution, possession, sale, transfer, or use of controlled substances and the misuse of alcohol or prescription drugs while on Company premises, during business hours, while operating Company vehicles or equipment, or at any time when an employee's conduct may adversely affect the safety or reputation of the Company.

Scope

This Policy applies to all employees, contractors, temporary workers and interns of the Company at all locations under the Company's control and to any employee-related activity that may affect the Company. Employees are required to report to work fit for duty and free from the influence of prohibited substances.

Definitions

For purposes of this Policy, "prohibited substances" includes illicit drugs, controlled substances not prescribed by a licensed practitioner for the employee, misuse of prescription medication, and alcohol when its presence impairs an employee's performance or safety.

Prohibited Conduct

Employees are prohibited from: (a) using, possessing, distributing, selling, or offering for sale prohibited substances on Company premises or during work hours; (b) performing duties while impaired by prohibited substances; and (c) failing to notify a supervisor of any medication that may adversely affect safe performance. Violation of this Policy will result in disciplinary action up to and including termination.

Drug and Alcohol Testing Procedures

The Company may require testing in the following circumstances: pre-employment (where permitted by law), reasonable suspicion, post-accident, random testing for safety-sensitive positions, and return-to-duty and follow-up testing after a treatment program. Tests may include urine, breath, saliva, blood, or other accepted methods.

Employees subject to testing will be informed of the reason for testing and have the opportunity to provide information regarding lawful medication use. Refusal to submit to testing, tampering with a sample, or a confirmed positive result will be treated as a Policy violation.

Employee Assistance and Rehabilitation

The Company supports rehabilitation for employees with substance misuse problems. Employees may be offered referral to an Employee Assistance Program (EAP) or other treatment resources. Participation in voluntary treatment does not preclude disciplinary action for Policy violations discovered before, during, or after treatment.

Confidentiality and Recordkeeping

Records of tests, medical evaluations and treatment referrals will be maintained confidentially and separately from general personnel files to the extent permitted by law. Disclosure will be limited to individuals with a legitimate business need to know or as required by law.

Consequences and Discipline

Confirmed violations may result in disciplinary measures, including written reprimand, suspension, mandatory participation in treatment, demotion, loss of privileges, or termination. Safety-sensitive positions may be subject to more stringent consequences.

Employee Rights and Appeals

Employees have the right to request review of a test result, to submit medical information concerning prescription medication, and to appeal disciplinary decisions pursuant to the Company's established grievance procedures. Appeal requests must be submitted in writing within the time period specified in applicable Company policies.

Notification of Convictions

Employees must notify the Company in writing of any criminal conviction related to controlled substances or alcohol that affects fitness for duty, no later than five (5) calendar days after such conviction, as required by law or Company policy.

Training and Communication

The Company will provide training for supervisors to recognize signs of impairment and will communicate this Policy to employees. Employees are encouraged to ask questions to Human Resources regarding implementation and expectations.

What the Employee Drug Misuse Policy Is and Who It Covers

An Employee Drug Misuse Policy is a written workplace rule set that defines prohibited substances and behavior, testing procedures, disciplinary measures, and support options. The policy establishes employer and employee responsibilities, confidentiality expectations, and how positive tests are handled. It is intended for use across hiring, reasonable-suspicion, post-incident, and return-to-duty situations and should align with federal law, applicable state statutes, collective bargaining agreements, and privacy protections.

Why a Clear Policy Matters for Compliance and Safety

A clear Employee Drug Misuse Policy reduces workplace risk, ensures consistent enforcement, supports safety-sensitive roles, and helps employers meet legal obligations. It also documents procedures that protect employee privacy and demonstrate nondiscrimination.

Why a Clear Policy Matters for Compliance and Safety

Who Prepares and Relies on This Policy

Typical users draft, review, and apply the policy across HR, operations, and legal teams.

  • Human resources managers responsible for policy maintenance and employee communications.
  • Supervisors and safety officers who identify reasonable-suspicion incidents and enforce testing.
  • Employees and unions who need clarity on consent, testing, discipline, and accommodation rights.

Maintain clear assignment of responsibilities so enforcement is consistent and defensible.

Core Elements to Include in a Professional Policy

A robust policy balances safety, privacy, and legal compliance by defining scope, testing methods, and corrective steps while addressing confidentiality and reasonable accommodation.

Policy Statement

A concise purpose statement explaining workplace safety goals, zero-tolerance or permissive stance, and applicability to all employees and contractors.

Scope

Which workers and settings are covered (pre-employment, post-incident, random, reasonable suspicion), plus any job-class exemptions or safety-sensitive role definitions.

Prohibited Conduct

List of banned substances and behaviors, including on-premises use, possession, impairment at work, and off-duty conduct affecting job performance.

Testing Procedures

Types of tests (urine, saliva, hair), collection protocols, chain-of-custody, lab certifications, and confirmatory testing requirements.

Discipline and Support

Progressive discipline, potential termination criteria, return-to-duty steps, and access to employee assistance or rehabilitation programs.

Privacy and Recordkeeping

How test results are stored, who has access, confidentiality safeguards, retention periods, and compliance with HIPAA and other privacy rules where applicable.

Step-by-Step: Adopting and Implementing the Policy

Follow these four steps to create, approve, and operationalize the policy in the workplace.

  • 01
Draft: Assemble HR, legal, and safety stakeholders to prepare a tailored draft.
  • 02
Legal review: Obtain counsel review for state law, ADA, and collective bargaining implications.
  • 03
Communicate: Distribute to employees and provide training on testing and rights.
  • 04
Record signatures: Collect signed acknowledgments and file them in personnel records.

Key Data Elements to Capture and Protect

Employee Full Name: Given and family name
Employee ID: Organization-specific identifier
Job Title: Role at time of record
Test Consent: Signed consent indicator

Where Completed Policies and Results Are Sent

After signatures are collected, route documents to designated recipients and maintain secure access controls.

  • Human Resources: Primary retention and personnel file storage
  • Immediate Supervisor: Receives notification of outcomes as permitted
  • Occupational Health: Stores medical records and fitness-for-duty evaluations
  • Legal/Compliance: Keeps copies for legal defense and audits

Technical Requirements for Digital Completion and Storage

Confirm file formats, access controls, and integrations before using an e-signature workflow.

  • Document Formats: PDF or DOCX for auditability
  • Access Controls: Role-based permissions and encryption
  • Integrations: Common: HRIS, Microsoft 365, Google Workspace

Use platforms supporting audit trails, secure storage, and compliance addenda (for example, HIPAA BAA) when health data is involved.

Typical Timelines and Review Deadlines to Define

Set explicit timelines for notice, testing windows, and periodic policy review to ensure consistent application.

Implementation Date:

Date policy becomes effective for all employees

Employee Notice Period:

Timeframe to notify employees of policy changes

Specify hours post-incident for sample collection

Policy Review Cycle:

Annual or biennial legal and operational review

Record Access Requests:

Response timeline for employee record requests

Consequences and Legal Risks of an Incomplete or Flawed Policy

Disciplinary Risk: Incorrectly applied discipline
Wrongful Termination: Exposure to employment litigation
Regulatory Fines: Penalties under industry law
Privacy Breach: Protected health data exposure
ADA Claim: Failure to accommodate disabilities
Collective Bargaining: Union contract violations

Common Mistakes When Preparing a Drug Misuse Policy

  • Using vague language on who is covered, which creates inconsistent enforcement and legal risk.
  • Failing to specify testing procedures and chain of custody, which undermines result admissibility.
  • Neglecting privacy safeguards for medical data, increasing the chance of HIPAA or state privacy violations.
  • Ignoring accommodation obligations under the ADA when employees disclose substance-use disorders.
