EMPLOYEE DRUGS & ALCOHOL POLICY

Employer Name:     Effective Date:

Purpose

This policy establishes the standards and procedures for the unlawful use, possession, distribution, sale, transfer, manufacture, or being under the influence of illegal drugs, controlled substances, or alcohol while conducting company business or while on company premises. The purpose of the policy is to maintain a safe, productive and drug-free work environment, to comply with applicable laws and contractual obligations, and to provide a framework for assistance and remedial action when appropriate.

Scope

This policy applies to all employees, contractors, temporary workers, interns, and applicants for employment of the Employer. It applies while on Employer property, during work hours, while operating Employer vehicles or equipment, or at off-site work locations where job-related activities occur.

Definitions

"Illegal drugs" means substances the possession or use of which is unlawful under applicable law and includes controlled substances except when lawfully prescribed. "Under the influence" means a level of impairment caused by alcohol or drugs that adversely affects job performance, coordination, decision-making, or safety.

Prohibited Conduct

The following conduct is prohibited: (a) reporting for duty or performing duties while under the influence of illegal drugs or alcohol; (b) possession, sale, distribution, manufacture, or transfer of illegal drugs or alcohol on Employer premises or during work time; (c) failure to submit to a required test; and (d) refusal to cooperate with any investigation or treatment program required by the Employer.

Testing Procedures

The Employer may require drug and/or alcohol testing in the following circumstances: pre-employment, reasonable suspicion, post-accident, random selection (for safety-sensitive positions), return-to-duty after a positive result or treatment, and follow-up testing. Tests may include urine, breath, blood, hair, or other scientifically accepted methods.

Pre-Employment Testing: Applicants for designated positions may be required to submit to testing as a condition of employment. Consent to such testing is required for employment consideration.
Reasonable Suspicion Testing: If a trained supervisor has a reasonable belief that an employee is under the influence, the employee must submit to testing.
Post-Accident Testing: Employees involved in workplace accidents that result in injury, significant property damage, or safety incidents may be required to undergo testing.

Return-to-Duty and Follow-Up Testing: An employee returning to work following treatment for substance abuse shall be tested prior to resumption of duties and as directed thereafter to ensure continued compliance with the policy.

Employee Assistance and Treatment

The Employer encourages employees who have a drug or alcohol problem to seek confidential help. Employees may be required to participate in counseling or a rehabilitation program as a condition of continued employment. Participation in treatment does not exempt an employee from disciplinary action for policy violations nor guarantee reinstatement following termination.

Confidentiality

Testing results, medical records, and treatment information are confidential and maintained separately from general personnel records to the extent permitted by law. Information may be released only to those with a need to know for enforcement, safety, or treatment purposes or as required by law.

Consequences for Policy Violations

Violation of this policy may result in disciplinary action up to and including suspension without pay, mandatory participation in a treatment program, demotion, or termination of employment. A confirmed positive test result, refusal to test, adulteration or substitution of specimen, or other material breach of this policy will be addressed in accordance with progressive discipline or immediate termination where warranted.

Search and Inspection

Employer reserves the right to inspect facilities, desks, lockers, and vehicles on Employer property when there is reasonable suspicion of policy violation or as permitted by law. Employees are expected to cooperate with such inspections.

Recordkeeping and Reporting

Records of testing, disciplinary actions, and treatment referrals will be retained in secure files. Mandatory reports to regulatory agencies will be made as required by law.

Training

Supervisors will receive training necessary to identify and document reasonable suspicion. Employees will be informed of the policy and the resources available for assistance.

Legal Statements

At-Will Employment: Nothing in this policy creates a contract of employment for any specified duration. Employment remains at-will and may be terminated by either party at any time, with or without cause, to the extent permitted by law.
Equal Opportunity: The Employer provides equal employment opportunity to all employees and applicants without regard to protected characteristics, and decisions under this policy will be applied consistently and without unlawful discrimination.

What an Employee Drugs & Alcohol Policy Covers

An Employee Drugs & Alcohol Policy sets employer rules for substance use, testing, and workplace safety. It defines prohibited substances and conduct, establishes testing methods and grounds for testing, describes disciplinary and return-to-work procedures, and outlines confidentiality and recordkeeping obligations to comply with applicable federal and state law.

Why a Clear Policy Matters for Employers

A well-drafted policy reduces safety risk, supports consistent enforcement, and documents procedures that protect the employer in disputes. It also helps meet industry-specific regulatory obligations and clarifies employee expectations about testing, discipline, and assistance programs.

Why a Clear Policy Matters for Employers

Who Typically Implements and Signs This Policy

Employers across safety-sensitive and non-safety industries adopt this policy to manage risk, enforce standards, and support rehabilitation pathways for employees.

  • Human resources teams responsible for hiring, onboarding, and policy enforcement in organizations of all sizes.
  • Supervisors and safety officers who identify impairment, initiate reasonable-suspicion testing, and document incidents.
  • Legal and compliance staff who review procedures for consistency with federal and state laws and collective-bargaining agreements.

Implementation typically involves HR distribution at hire, periodic refresher training, and a signed acknowledgement retained in the employee file.

Core Components to Include in the Policy

Include clear, practical sections so the policy is enforceable, defensible, and easy to follow for staff and managers.

Scope and Purpose

Define who and what the policy covers, whether it applies to all employees, contractors, and off-site conduct related to work activities.

Prohibited Conduct

List banned substances and behaviors, including on-duty use, possession, impairment, and off-duty conduct when it affects workplace safety or performance.

Testing Procedures

Specify types of testing (pre-employment, random, reasonable suspicion, post-incident, return-to-duty), collection methods, and approved labs.

Reasonable Suspicion

Describe supervisor training, observable indicators that trigger testing, and required documentation for reasonable-suspicion referrals.

Discipline and Rehabilitation

Explain consequences for violations, options for treatment or EAP referrals, and criteria for return-to-work and follow-up testing.

Confidentiality

State who has access to test results, how records are stored, and legal limits on disclosure to protect employee privacy.

Required Information and Fields to Collect

Employee Name: Full legal name
Date of Birth: MM/DD/YYYY
Position: Job title/department
Consent Checkbox: Signed consent indicator
Testing Type: Select test category
Acknowledgement Date: Signature date

Step-by-Step: Completing the Policy Acknowledgement

Follow a standard sequence to collect a valid employee acknowledgement and supporting information.

  • 01
Provide Policy: Give employee an electronic or paper copy.
  • 02
Review Terms: Ensure employee reads testing and discipline provisions.
  • 03
Collect Consent: Obtain signature and date for consent.
  • 04
File Record: Store signed copy in personnel file.

How to Configure an Online Acknowledgement Workflow

Set up authentication, routing, and retention to create a defensible digital record for acknowledgements and testing consent.

Field Configuration
Authentication Email plus SMS code
Conditional Fields Show testing consent when role applies
Notifications Auto-notify HR on signature
Record Retention Archive signed PDF with audit trail

Where Signed Policies Should Be Sent or Stored

Define authoritative storage locations and routing so signed acknowledgements are accessible for audits and incident response.

  • Human Resources: Primary personnel file storage location
  • Occupational Health: Store testing records separately
  • Compliance Archive: Retain signed policies for audits
  • Employee Copy: Provide a signed copy to the employee

Digital Signing and File Format Considerations

Choose a platform that preserves an audit trail, supports common formats, and can meet any regulatory authentication requirements.

  • File Formats: PDF and DOCX supported
  • Integrations: Connects with HR and storage systems
  • Authentication: Options for SMS, SSO, or KBA

Ensure the provider can produce tamper-evident signed PDFs and export audit logs for legal or regulatory review.

Timing: When to Distribute and Act

Set clear timelines for distribution, testing windows, acknowledgement collection, and required follow-up actions after incidents.

New Hire Distribution:

Provide policy at or before first day.

Acknowledgement Deadline:

Require signed acknowledgement within 7–30 days.

Random Testing Frequency:

Specify the selection interval if using random testing.

Post-Incident Testing:

Test as soon as practicable after safety incidents.

Follow-Up Testing:

Define follow-up schedule for return-to-duty cases.

Common Mistakes to Avoid

  • Vague scope language that fails to specify which roles are safety-sensitive or subject to random testing.
  • Collecting test consent without an ESIGN-compliant disclosure for consumer-facing records or healthcare contexts.
  • Inconsistent supervisor training that leads to poorly documented reasonable-suspicion referrals.
  • Storing test results in unsecured or mixed-access files that violate privacy expectations.

Consequences of an Incomplete or Incorrect Policy

Disciplinary Risk: Unclear policies hinder enforcement
Termination Exposure: Improper procedure invites wrongful termination claims
Workers' Comp Effect: Testing errors may affect claims
Regulatory Penalties: DOT/agency fines for noncompliance
Privacy Violations: Improper disclosure can trigger liability
Evidence Issues: Poor chain of custody undermines results
