What the Employee Duplicate Agreement is and when it’s used

An Employee Duplicate Agreement is a short written record by which an employer provides a duplicate copy of an original employment document to an employee and the employee acknowledges receipt. Common duplicates include offer letters, employment agreements, pay stubs, personnel files, or benefit elections. The form documents which original was duplicated, why a duplicate was issued, the effective date of the duplicate, and the parties receiving it. It creates a clear chain of custody for recordkeeping, supports compliance with retention rules, and reduces disputes about what version was received.

Why issuing a duplicate agreement matters for employers and employees

Providing a signed Employee Duplicate Agreement creates a contemporaneous record that the employee received the same contractual or record materials as maintained by the employer. This helps meet document retention obligations, supports auditability, and reduces later disputes about authenticity or timing.

Why issuing a duplicate agreement matters for employers and employees

Who typically completes and signs this form

Human resources, payroll, and legal teams most commonly prepare Employee Duplicate Agreements when copies of employment documents are reissued or replaced.

  • Human Resources managers who maintain personnel files and provide employees with duplicate employment records for compliance and recordkeeping.
  • Payroll or benefits specialists issuing duplicate pay stubs, tax documents, or benefit election confirmations.
  • Legal or compliance officers who need an auditable acknowledgment for contractual documents or revised employment terms.

Document custodians should keep the signed duplicate agreement in the employee’s personnel file and follow applicable retention schedules to meet regulatory and company policy obligations.
