What an Employee Equipment Agreement Covers

An Employee Equipment Agreement is a written contract that defines the terms for issuing, using, maintaining, and returning employer-owned equipment provided to an employee. It typically lists the items issued, the employee's responsibilities for care and security, permitted personal use, reporting and repair procedures for loss or damage, and conditions for return at termination or role change. The agreement can also specify financial responsibility for damage or loss, tax implications for personal use, confidentiality obligations for devices that access company data, and the governing law for disputes.

Why use an Employee Equipment Agreement

A clear written agreement protects both employer and employee by defining expectations for custody, care, and return of company property, reducing disputes and inventory loss.

Why use an Employee Equipment Agreement

Who completes and signs this agreement

Employers, HR teams, IT departments, and hiring managers commonly prepare the form so issuance is documented before equipment leaves the workplace.

  • HR and People Operations: ensure policy alignment and payroll deductions for replacement costs when authorized
  • IT Managers: track serial numbers, asset tags, and enforce security configurations
  • Hiring Managers: document issuance during onboarding or role changes for accountability

Use the agreement consistently across new hires, transfers, remote assignments, and when loaning specialized equipment to contractors.

Primary signer roles

Employee

The individual receiving equipment signs to accept responsibility for care, authorized uses, and return conditions. The employee acknowledges potential payroll deductions for loss, agrees to security requirements, and confirms receipt of listed items.

Issuing Manager

A manager or IT representative documents issuance details, records serial numbers and condition, and confirms device setup and security baselines. Their signature validates the inventory record and the company’s fulfillment of issuance requirements.

Step-by-step: issuing and documenting equipment

Follow a consistent sequence to issue equipment, record details, and get employee acknowledgment to reduce inventory loss and compliance risk.

  • 01
Prepare the package: Gather device, charger, accessories, and install required security software.
  • 02
Record identifiers: Log serial numbers, asset tags, and condition in asset management system.
  • 03
Review agreement: Go through terms with employee and explain responsibilities.
  • 04
Obtain signature: Collect dated signatures from employee and issuing manager; retain copy in HR file.

Essential clauses to include in the agreement

A professional Employee Equipment Agreement contains clauses that address custody, permitted use, security obligations, loss and repair liability, return procedures, and applicable law.

Inventory list

Detailed schedule of items by serial number and asset tag so both parties agree on exactly what was issued; attach as Exhibit A when possible.

Permitted use

Defines acceptable personal use, restrictions on software installation, and prohibitions (for example, no peer-to-peer file sharing) to limit compliance and security exposure.

Security requirements

Specifies mandatory configurations such as full-disk encryption, strong passcodes, VPN use, and reporting procedures for lost/stolen devices to protect company data and meet regulatory obligations.

Damage and loss

Explains employee financial responsibility for negligent damage or loss, repair or replacement cost allocations, and any limits on payroll deductions permitted by state law.

Return obligations

Sets timelines and condition standards for return at employment end or role change and explains consequences for failure to return equipment promptly.

Governing law

Identifies the state law that governs the agreement and any venue for dispute resolution; select the jurisdiction where the employer principally operates.

Required data elements for records

Employee name: Full legal name
Asset ID: Serial and asset tag
Issue date: MM/DD/YYYY
Return date: MM/DD/YYYY or 'TBD'
Device condition: Short status note
Signatures: Employee and issuer

Digital signing and record flow for equipment logs

Use an electronic workflow to capture signatures, lock the executed agreement, and archive the audit trail together with asset metadata.

  • Upload: Add agreement PDF and inventory exhibit to the signing workflow.
  • Assign fields: Place signature, date, and text fields near corresponding inventory entries.
  • Authenticate signer: Use email link or two-factor authentication to verify identity.
  • Archive: Store signed PDF and audit trail in HR or asset management system.

Configure an online issuance workflow

Set up a repeatable online workflow that ties the equipment agreement to asset records, HR onboarding steps, and IT provisioning tasks.

Field Configuration
Signer order Employee first, issuer second
Authentication Email link or SMS code
Notifications Automated reminders at 3 and 7 days
Storage Auto-save to HR record or SSO-linked folder

Technical considerations for eSigning and storage

Ensure the eSignature platform supports secure authentication, audit trails, and integration with HR or asset systems.

  • Authentication: Email, SMS, or stronger methods
  • Audit trail: Timestamp, IP, and action log
  • Integrations: HRIS, SSO, cloud storage

Typical timelines and deadlines to track

Track issuance, periodic inventory reconciliations, scheduled maintenance, and return deadlines to maintain compliance and reduce asset loss.

Issuance record:

Log on the day device is handed over

Inventory audit:

Quarterly or semiannual reconciliations recommended

Return at separation:

Due on final day of employment

Lost/stolen report:

Report immediately to IT and HR

Maintenance schedule:

Follow vendor-recommended intervals

Key milestones from issuance to return

Track the employee equipment lifecycle with clear milestones and responsible parties to ensure accountability and timely action.

01

Preparation

IT prepares device, installs security, and records identifiers.

02

Distribution

Employee signs agreement; item handed over.

03

In-service monitoring

Periodic audits and software updates are applied.

04

Return and inspection

Device returned, inspected, and asset log updated.

Common pitfalls to avoid

  • Vague inventory descriptions that omit serial numbers and asset tags
  • Failing to document pre-existing damage at issuance
  • Not specifying permitted personal use or security expectations
  • Missing signatures or undated acknowledgements

Risks and consequences of incomplete agreements

Inventory disputes: Loss of recovery options
Payroll issues: State limits on deductions
Data breaches: Regulatory exposure
Legal liability: Disputes over costs
Insurance gaps: Claims denial risk
Operational delays: Replacement and downtime costs
