What the Employee Examination Agreement Is

An Employee Examination Agreement documents consent and terms when an employer requires a medical, fitness-for-duty, or occupational health examination. It sets scope, purpose, privacy protections, who conducts the exam, how results will be used, and whether follow-up testing or restrictions apply. Properly drafted agreements reduce misunderstandings between employer, employee, and health provider while ensuring applicable privacy and labor rules are acknowledged.

Why this agreement matters for employers and employees

A clear Employee Examination Agreement protects legal rights, preserves confidentiality, documents informed consent, and supports compliance with federal privacy and employment laws such as ESIGN/UETA for electronic records and HIPAA when protected health information is involved.

Why this agreement matters for employers and employees

Who typically completes an Employee Examination Agreement

Employers, occupational health clinics, HR teams, and employees use this agreement to authorize medical exams and record intended uses of medical information.

  • Human resources and benefits teams that manage pre-employment, return-to-work, and periodic fitness evaluations.
  • Occupational health providers and clinics that need documented consent and release of exam findings.
  • Employees undergoing required medical testing who must understand scope, data use, and privacy protections.

Use the agreement when an exam is required or requested to ensure consent, chain of custody for records, and a clear record of decisions tied to the examination results.

Step-by-step: completing the Employee Examination Agreement

Follow these steps in order to prepare, obtain consent, and file the completed agreement.

  • 01
Prepare the form: Specify exam type, provider, and any specific tests required.
  • 02
Provide disclosure info: State purpose, data recipients, and privacy obligations clearly.
  • 03
Obtain signed consent: Collect dated signatures from employee and authorized representative.
  • 04
Store and distribute: Provide copies to the provider and retain employer records per policy.

How to set up a digital workflow for this agreement

Configure online fields, recipient order, and authentication to match your compliance needs before sending the agreement for signature.

Field Configuration
Signature Field Place for employee signature and date
Conditional Fields Show additional consent if high-risk tests selected
Recipient Order Employee signs first, provider second, employer HR last
Authentication Use email or SMS code; use stronger ID for sensitive records

Digital signing and eSubmission considerations

When completing and submitting this agreement electronically, align signer authentication, audit trail, and storage with applicable privacy laws.

  • Authentication: Email, SMS code, or KBA as needed
  • Audit Trail: Capture IP, timestamp, and actions
  • File Formats: PDF/A or DOCX for archival copies

Ensure your eSignature platform supports required safeguards such as secure transport (TLS), at-rest encryption, and retrievable audit records for regulatory review.

Typical electronic signing flow for an examination agreement

A straightforward e-sign workflow reduces friction while preserving evidence of consent and the sequence of approvals.

  • Upload document: Sender uploads the agreement to the signing platform
  • Place fields: Add signature, date, and conditional fields as needed
  • Send to signer: Employee receives secure link or email invitation
  • Complete and store: Signed copies plus audit trail are saved and distributed

Essential clauses to include in a professional agreement

Ensure your agreement contains these core clauses to define scope, privacy, and authority precisely.

Scope of Examination

Detail tests to be performed, limitations on secondary testing, and whether specimens will be retained for follow-up.

Purpose and Use of Results

Explain how results affect employment decisions, accommodations, and fitness determinations.

Privacy and Disclosure

Specify recipients, redaction standards, protections under HIPAA, and any state privacy rules that apply.

Authorization and Consent

Clear, dated consent for examination and release of information to named parties.

Cost and Billing

Who pays for the exam, billing process, and reimbursement terms if applicable.

Amendment and Revocation

Process for employees to revoke consent or amend information and the effect on pending exams.

Key data and security items to record

Encryption: TLS 1.2/1.3; AES-256 at rest
Audit Trail: IP, timestamps, signer actions
Access Controls: Role-based permissions
HIPAA BAA: Signed BAA when PHI is shared
Retention Policy: Document retention schedule
Authentication: Email, SMS, or stronger methods

Common mistakes to avoid

  • Failing to specify the exam's purpose, which leads to overbroad data use and disputes.
  • Using vague consent language instead of clear, dated authorization tied to specific recipients.
  • Storing PHI without a BAA or adequate encryption, risking HIPAA noncompliance.
  • Not documenting signer identity or using insufficient authentication for sensitive medical records.

Penalties and legal risks of improper handling

HIPAA Exposure: Civil penalties, corrective action plans
ADA Violations: Discrimination claims or damages
State Privacy Fines: Fines under state consumer privacy laws
Contract Disputes: Claims for improper use of results
Evidence Admissibility: Unsigned or poorly authenticated records may be excluded
Operational Delays: Delays to onboarding or return-to-work decisions

Typical timelines and processing expectations

Timelines vary by exam type and employer policy. The items below capture common timeframes employers should plan for.

Pre-employment exam scheduling:

Schedule within 7–14 days of conditional offer

Post-accident exam window:

Arrange exam within 24–72 hours when urgent safety concerns exist

Report delivery:

Provider typically returns results within 3–7 business days

Record retention trigger:

Retention period begins on exam date or report issuance

Time to appeal or request review:

Allow employee at least 10 business days to provide additional info

Key milestones from request to final record

Track these numbered stages to ensure timely completion and documentation at each point.

01

Request Initiated

Employer documents need, scope, and sends agreement to employee.

02

Consent Given

Employee signs consent and returns the agreement to employer.

03

Exam Conducted

Provider performs tests and documents findings securely.

04

Report and Decision

Provider issues report; employer documents any employment action.

Real-world examples of how organizations use these agreements

Two practical scenarios show how the agreement supports safe hiring and incident response while protecting privacy.

Healthcare Clinic Scenario

A clinic requires a pre-employment exam for clinical staff to confirm fitness and immunization status.

  • The exam confirms job-specific capabilities and vaccination records.
  • The agreement limits disclosure to HR and occupational health, requires a HIPAA BAA with the provider, and documents employee consent for necessary information to be shared with credentialing teams.

Construction Company Scenario

A contractor requests a post-accident fitness-for-duty exam after a site incident.

  • The exam evaluates return-to-work safety and restrictions.
  • The agreement specifies tests performed, authorizes limited disclosure to site safety managers, and outlines how findings will inform temporary job restrictions or accommodations.

Practical tips for accurate and efficient completion

Adopt these practices to reduce errors, protect privacy, and speed processing.

Use clear, specific consent language
Draft consent to name the provider, list recipients, and state exact uses. Vague or broad release language increases legal risk and can hinder narrow disclosure required by privacy laws.
Limit data shared to what is necessary
Only request exam results relevant to job duties or safety. Minimizing data reduces HIPAA and employment-law exposure and simplifies secure storage and access controls.
Keep medical records separate
Store examination reports apart from standard personnel files with restricted access to occupational health and designated HR staff to comply with privacy expectations.
Ensure robust signer authentication
Use email plus SMS code or stronger multi-factor authentication for sensitive medical consents to improve attribution and evidentiary value.
