What the Employee FAST Agreement Is

The Employee FAST Agreement is a standardized employment contract used to document core terms for fast onboarding, including role, compensation, start date, confidentiality, and basic termination rights. It is designed for employers to streamline hiring of exempt and non‑exempt staff while preserving legal clarity about duties, pay, and benefits. This template supports electronic completion and signatures when parties consent, subject to ESIGN and applicable state UETA or ESRA rules. Use it as a primary agreement for short-form hires, trial-period appointments, or to capture amendments to existing employment arrangements.

Why Use an Employee FAST Agreement

A concise employment agreement reduces onboarding delays and clarifies mutual expectations for pay, duties, and confidentiality. It minimizes disputes by documenting essential terms quickly and supports electronic execution under ESIGN/UETA when parties provide consent, preserving enforceability across most U.S. jurisdictions.

Why Use an Employee FAST Agreement

Who Typically Uses the Employee FAST Agreement

HR teams, hiring managers, and small business owners use this agreement to speed onboarding and standardize core employment terms.

  • Human resources departments handling high-volume hiring and consistent policy application.
  • Start-up founders and small businesses without in-house legal teams needing a simple contract.
  • Managers onboarding temporary or trial employees where quick execution matters.

Use it alongside more detailed handbooks or full employment contracts when role complexity or regulatory requirements demand added provisions.

Core Components of a Professional Employee FAST Agreement

A complete FAST Agreement organizes role description, compensation, term, confidentiality, termination, and dispute resolution into clear sections for quick review and lawful execution.

Position and Duties

Defines title, primary responsibilities, reporting line, and any performance milestones. Use specific, measurable task descriptions to avoid ambiguity about expectations and evaluation criteria during the employment term.

Compensation

Specifies base salary or hourly rate, pay schedule, bonuses, and benefits. Include currency, overtime eligibility, and reference to payroll deductions or tax withholdings. Also state any probationary pay adjustments and effective dates for raises.

Term and Start Date

Lists the effective start date, whether employment is at‑will or for a fixed term, and any trial or probation periods with clear end conditions and notice requirements.

Confidentiality

Includes nondisclosure obligations, definition of confidential information, permitted disclosures, and duration of confidentiality obligations after termination, including trade secret protections. Specify return or destruction procedures for company property and data.

Termination

Describes termination for cause and without cause, notice periods, final pay, accrued PTO payout, and any severance or restrictive covenants affecting post‑employment activities. Include return of property and last date of benefits coverage.

Dispute Resolution

Specifies governing law, forum for disputes, whether arbitration applies, and steps for informal resolution including escalation points and timelines to preserve claims. Clarify venue and any fee‑sharing arrangements for arbitration.

Who Handles the Agreement

HR Manager

An HR Manager prepares the Employee FAST Agreement, configures required fields, coordinates signatures, and ensures tax forms and I-9 verification are completed. They manage storage and handle routine amendments, consulting legal for nonstandard clauses or jurisdiction-specific requirements.

General Counsel

General Counsel reviews template language for enforceability, noncompete scope, and confidentiality provisions. They advise on state-specific variations (ESRA vs UETA), determine notarization or witness needs for special cases, and approve retention schedules aligned with regulatory obligations.

Common Mistakes When Preparing the Employee FAST Agreement

  • Using vague job descriptions that leave performance expectations undefined increases dispute risk and complicates termination or performance management actions.
  • Failing to collect accurate tax forms (W-4, state equivalents) or SSN causes payroll errors, backup withholding, and possible IRS penalties.
  • Including contradictory clauses across handbook and agreement without referencing hierarchy leads to contract interpretation disputes and inconsistent enforcement.
  • Not specifying confidentiality duration or IP assignment can leave employers with weak protection for proprietary information after employment ends.

Penalties and Risks of an Incorrect Agreement

Misclassified Pay: Wage claims and fines.
Missing Withholding: Backup withholding or tax penalties.
I-9 Noncompliance: Civil penalties per DHS rules.
Invalid Signature: Contract may be unenforceable.
Privacy Breach: HIPAA or state data fines.
Late Filing: Regulatory fines or interest.
