EMPLOYEE FIT POLICY

Purpose and Scope

This Employee Fit Policy establishes the employer's requirements and procedures for assessing and maintaining employee physical and mental fitness for assigned duties, particularly where health, safety, security, or essential job performance may be affected. The policy applies to all employees, contractors, and applicants assigned to duties on behalf of the company.

Definitions

"Fit for duty" means the ability of an employee to perform the essential functions of the position safely and effectively, with or without reasonable accommodation. "Safety-sensitive position" refers to positions where impairment could reasonably be expected to cause harm to persons, property, or operations.

Policy Statements

The employer may require fitness-for-duty evaluations where: (a) job performance indicates a possible impairment; (b) after a workplace incident; (c) where periodic evaluations are required for safety-sensitive positions; or (d) when a manager reasonably believes fitness for duty is in question. Fitness-for-duty evaluations will be job-related, consistent with business necessity, and conducted in a manner that respects employee privacy and applicable law.

Medical Evaluations and Testing

Evaluations may include medical examination, laboratory testing, psychological assessment, or other procedures as appropriate to determine fitness for duty. Drug and alcohol testing may be required consistent with this policy for safety-sensitive positions or after incidents that suggest impairment. All testing will follow accepted professional standards and applicable legal requirements.

Confidentiality and Recordkeeping

Medical information obtained under this policy is confidential medical information and will be maintained separately from general personnel files. Disclosure will be limited to those with a legitimate need to know or as required by law. Records will be retained in accordance with applicable record retention policies.

Reasonable Accommodation

Employees who believe they require reasonable accommodation to perform essential job functions should notify Human Resources or their manager. The employer will engage in an interactive process to evaluate feasible accommodations in accordance with applicable law. Requests for accommodation will be considered on a case-by-case basis.

Consequences for Non-Compliance

Failure to comply with fitness-for-duty evaluations, refusal to submit to required testing, or falsification of medical information may result in disciplinary action up to and including termination. Employees removed from duty for fitness concerns may be placed on leave pending evaluation and resolution.

Appeal and Second Opinion

Employees may request a second medical opinion at their own expense within ten (10) business days of an adverse determination. The employer may also require a designated independent evaluation. Disputes will be handled in accordance with applicable policies and law.

Responsibilities

Managers must promptly report observed or reported impairment and coordinate with Human Resources. Employees must notify their manager or Human Resources of any condition that may affect safe performance of duties. Human Resources will administer evaluations, coordinate accommodations, and maintain confidential records.

What the Employee Fit Policy Is and When It Applies

An Employee Fit Policy documents employer expectations and procedures for assessing whether a candidate or employee is fit for a specific role, assignment, or return-to-work scenario. It typically covers required qualifications, physical and mental fitness standards, assessment methods (medical exam, skills test, behavioral assessment), confidentiality terms for health information, and the process for determining reasonable accommodations. The policy clarifies roles and decision points for HR, occupational health, hiring managers, and legal counsel, and explains how assessments are documented, retained, and reviewed to support consistent, non-discriminatory employment decisions.

Why an Employee Fit Policy Matters for Compliance and Consistency

A clear Employee Fit Policy reduces legal and operational risk by standardizing assessment criteria, protecting employee privacy, and documenting decisions. It helps employers meet obligations under ADA, HIPAA, and federal employment laws while providing managers a repeatable process for safety-sensitive roles and return-to-work cases.

Why an Employee Fit Policy Matters for Compliance and Consistency

Who Typically Uses This Policy and How It’s Applied

Human resources, occupational health clinicians, hiring managers, and legal teams commonly implement and rely on the Employee Fit Policy to guide decisions.

  • HR teams that manage onboarding, accommodations, and performance-related fitness reviews within organizations.
  • Occupational health providers who conduct medical evaluations and certify fitness for duty.
  • Hiring managers for roles with safety-critical duties and supervisors handling return-to-work planning.

The policy is also useful to compliance officers and auditors as evidence of consistent, documented procedures when fitness questions arise.

Core Elements to Include in a Professional Employee Fit Policy

Include clear sections that establish scope, assessment criteria, roles, confidentiality, accommodation procedures, and documentation standards to ensure consistent application and legal defensibility.

Scope

Define which employees, contractors, roles, and situations (e.g., pre-employment, post-incident, return-to-work) the policy covers and any exclusions.

Assessment Criteria

List objective fitness standards, allowed assessment methods, frequency of evaluations, and acceptable testing protocols to avoid arbitrary outcomes.

Decision Roles

Describe responsibilities for HR, occupational health professionals, supervisors, and legal review to establish who makes and documents final determinations.

Confidentiality

Specify handling of medical and health information in compliance with HIPAA and internal privacy controls; limit access to need-to-know staff only.

Accommodations

Outline procedures for requesting, evaluating, and implementing reasonable accommodations under the ADA, including interactive process timelines.

Documentation

Require standardized recordkeeping for assessments, determinations, and communications, including retention periods and secure storage methods.

Common Pitfalls to Avoid When Preparing the Policy

  • Vague fitness criteria that allow inconsistent or subjective decisions, increasing discrimination risk.
  • Mixing medical records with general personnel files, which can violate privacy rules and complicate access requests.
  • Failure to document interactive accommodation discussions, leaving employers exposed to claims under the ADA.
  • Using inappropriate authentication for sensitive records, which weakens auditability and chain-of-custody evidence.

Consequences of Errors or Noncompliance

ADA Violations: Discrimination claims and litigation exposure
HIPAA Breach: Fines and corrective action
Recordkeeping Failure: Regulatory audits and penalties
Operational Risk: Workplace safety incidents
Reputational Harm: Loss of trust with staff
Litigation Costs: Legal fees and settlements
