NOTICE OF RIGHTS UNDER THE FAMILY AND MEDICAL LEAVE ACT

Eligible employees are entitled to take unpaid, job-protected leave for specified family and medical reasons. In general, an eligible employee may take up to 12 workweeks of leave in a 12-month period for:

  • the birth of a child and to care for the newborn child;
  • placement with the employee of a child for adoption or foster care;
  • to care for an immediate family member (spouse, child, or parent) with a serious health condition;
  • to take medical leave when the employee is unable to work because of a serious health condition;
  • for qualifying exigencies arising out of a family member's covered active duty or call to covered active duty in the Armed Forces.

Additionally, certain eligible employees of covered employers may take up to 26 workweeks of leave during a single 12-month period to care for a covered servicemember with a serious injury or illness.

ELIGIBILITY AND AMOUNT OF LEAVE

To be eligible for FMLA leave, an employee must:

  1. have worked for the employer for at least 12 months;
  2. have at least 1,250 hours of service for the employer during the 12-month period immediately preceding the leave; and
  3. work at a location where the employer employs 50 or more employees within 75 miles.

EMPLOYEE AND EMPLOYER RESPONSIBILITIES

Employee Notice: When the need for leave is foreseeable, employees must provide reasonable advance notice and follow the employer's usual and customary notice and procedural requirements for requesting leave. If the foreseen leave is for planned medical treatment, the employee must make a reasonable effort to schedule the treatment so as not to unduly disrupt the employer's operations.

Employer Designation: The employer must notify the employee whether the leave will be designated as FMLA-protected and the amount of leave counted against the employee's leave entitlement. The employer will provide such designation in accordance with company policy and applicable law.

BENEFITS AND PROTECTIONS

During FMLA leave, the employer will maintain the employee's group health insurance coverage on the same terms as if the employee had continued to work, subject to the employee's timely payment of any employee portion of premiums. Upon return from FMLA leave, employees are entitled to be restored to their original job, or to an equivalent position with equivalent pay, benefits, and terms and conditions of employment, unless restoration would cause substantial and grievous economic injury to the employer's operations.

What the Employee FMLA Rights Poster Is

The Employee FMLA Rights Poster is a workplace notice that summarizes employee rights and employer responsibilities under the federal Family and Medical Leave Act (FMLA). Covered employers must display a conspicuous poster at the workplace and provide notice to employees about eligibility, leave entitlements, job protection, continuation of health benefits, and complaint procedures. The poster complements required written notices and policies; it is not itself an individual leave request form but serves as a persistent public disclosure of FMLA protections and complaint channels.

Why the Poster Matters for Employers and Staff

Posting the Employee FMLA Rights Poster keeps workplaces compliant with federal notice obligations, informs staff about leave rights and protections, and reduces misunderstandings that lead to disputes or enforcement actions by the Department of Labor.

Why the Poster Matters for Employers and Staff

Who Needs This Poster and Who Maintains It

Employers covered by the FMLA and HR professionals are primarily responsible for posting and maintaining the Employee FMLA Rights Poster.

  • HR managers and directors responsible for compliance and employee notices in multi-site organizations.
  • Small-business owners and in-house employers meeting the FMLA 50-employee threshold who must post notices at worksites.
  • Employees and union representatives who rely on the poster to understand rights and complaint procedures.

Supervisors and site managers should confirm the poster is current, visible, and supplemented with company-specific contact and policy details.

Typical Signatories and Responsible Persons

Authorized Employer

Common Errors to Avoid When Preparing the Poster

  • Failing to include a working employer contact phone or email that employees can use for leave inquiries.
  • Using an outdated federal version or omitting state-specific family leave notices when required by local law.
  • Placing the poster where only managers see it instead of common employee areas and jobsite hubs.
  • Failing to document posting dates and locations, which weakens proof of compliance during inspections.

Potential Consequences of Not Posting Correctly

DOL enforcement: Investigation and required corrective action
Civil liability: Employee lawsuits for denied rights
Back pay liability: Restitution for improperly denied leave
Administrative fines: Monetary penalties in some cases
Reputational harm: Employee relations and retention impact
Recordkeeping exposure: Weak posting logs undermine defenses

Real-World Examples of Poster Use

These brief examples illustrate common scenarios where accurate posting prevented compliance issues or streamlined employee inquiries.

Regional Hospital

HR updated the poster during a policy change

  • The posted contact routed leave requests promptly
  • As a result, the hospital reduced misfiled leave requests and provided timely benefit continuation during medical absences.

Construction Contractor

A contractor posted the poster in each site trailer and intranet

  • Foremen were trained on where to direct questions
  • This practice ensured remote crews could access leave information and avoid delays in payroll and coverage.

Practical Tips for Accurate and Efficient Poster Management

Adopt routine checks and simple controls to keep posters current and accessible across physical and digital workplaces.

Centralized version control
Store a master poster file in a secure HR repository, track edits, and publish only verified versions to worksites and intranet locations to avoid outdated content circulating.
Consistent posting locations
Standardize posting locations across sites (break room, main entrance, jobsite trailer) and maintain a site log that records who posted and when for audit readiness.
Combine federal and state notices carefully
Attach required state leave posters next to the federal poster where applicable; ensure combined displays remain readable and distinguish federal from state instructions.
Document employee access
Provide the poster during onboarding and keep an electronic copy on the employee portal so remote or off-site workers can access required notices.
