Guaranteed Hours

Employer guarantees that Employee will be scheduled for a minimum of hours per week (the "Guaranteed Hours") for the period commencing on through .

If Employee is available and reports for scheduled shifts but fewer than the Guaranteed Hours are assigned, Employer shall compensate Employee with payment equal to the Employee's regular rate multiplied by the difference between the Guaranteed Hours and hours actually worked for that pay period (the "Guarantee Payment"). Guarantee Payment will be paid in the next regular payroll following the pay period in which the shortfall occurred.

Overtime: Hours worked in excess of applicable statutory thresholds will be compensated in accordance with applicable wage and hour laws. Guarantee Payment does not alter overtime obligations where such laws apply.

Employer may propose reasonable changes to assigned shifts; however, any permanent reduction in Guaranteed Hours will require at least days' written notice and a written amendment signed by both parties.

Timekeeping and Payroll

Employee must accurately record actual hours worked in Employer's timekeeping system. Fraudulent or knowingly inaccurate time records may result in disciplinary action, up to and including termination. Employer will make Guarantee Payments within Employer's standard payroll cycle and will withhold applicable taxes and deductions.

Duration, Termination, and Amendment

This Agreement will remain in effect for the period specified above unless earlier terminated by either party. Either party may terminate this Agreement for any lawful reason by providing written notice to the other party as follows: Employer must provide days' notice; Employee must provide days' notice. Termination of employment for any reason terminates this Agreement.

Amendments to this Agreement must be in writing and signed by both Employer and Employee to be effective.

At-Will Employment and Equal Opportunity

Nothing in this Agreement alters the at-will nature of the employment relationship, unless expressly stated otherwise in a separate written agreement signed by an authorized representative of Employer. Either party may terminate employment at any time, with or without cause and with or without notice, subject to any express notice provisions herein.

Employer is an equal opportunity employer. Employment decisions are based on legitimate business needs, qualifications, and employee performance without regard to protected characteristics under applicable law.

Legal Protections, Governing Law, and Severability

This Agreement will be governed by the laws of the state in which Employee principally performs work, to the extent such laws are applicable. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions will continue in full force and effect.

Employee authorizes Employer to verify Employee's employment history, education, and references, and to obtain background checks where permitted by law. Employee further authorizes former employers and references to provide information reasonably requested by Employer.

What Employee Guaranteed Hours agreements are and when they apply

An Employee Guaranteed Hours agreement is a written employment term that guarantees a minimum number of paid hours to an employee for each pay period or scheduling interval. Typically used for part-time, on-call, or variable-hour workers, the agreement specifies guaranteed hours, applicable pay rates, overtime treatment, schedule-notice rules, and procedures for modification or termination. While commonly negotiated between employer and employee or established via company policy, these provisions function as contract terms enforceable under state contract and wage laws, and they can be executed electronically under ESIGN and UETA where permitted.

Why a clear guaranteed-hours agreement matters for employers and staff

Clear, written guaranteed-hours terms reduce disputes, improve payroll accuracy, and provide predictable income for workers while helping employers plan staffing and measure labor costs.

Why a clear guaranteed-hours agreement matters for employers and staff

Who typically completes or relies on Employee Guaranteed Hours agreements

Common users span employers, HR teams, and hourly workers who need schedule certainty.

  • Human resources managers who draft, approve, and retain employment terms for hourly staff.
  • Small business owners and restaurant or retail managers who schedule variable labor and manage costs.
  • Hourly employees seeking written confirmation of minimum paid hours and pay calculation methods.

Agreements support operational consistency and serve as a reference in payroll audits or wage disputes.

Core clauses that make an Employee Guaranteed Hours agreement professional and enforceable
