The employer will provide required safety training and, where applicable, required personal protective equipment (PPE). The employee must attend training sessions, use PPE as instructed, and participate in workplace inspections when requested. The employee agrees to follow written and verbal safety instructions provided by authorized personnel.

I acknowledge receipt of required PPE or will request PPE prior to work that requires it.

Incident Reporting and Investigation

The employee shall report all workplace injuries, illnesses, or near-miss incidents to their supervisor immediately and cooperate with any resulting investigation. The employer retains the right to require medical evaluation or treatment when necessary to determine fitness for duty.

Medical Treatment, Privacy, and Records

The employee authorizes the employer and designated health care providers to administer or arrange emergency medical treatment if the employee is incapacitated. Medical information obtained by the employer in connection with treatment, fitness-for-duty examinations, or workers' compensation will be kept confidential and maintained in a secure file separate from general personnel records, disclosed only as permitted by law.

I consent to emergency medical treatment if necessary.

Substance Abuse and Testing

The employee agrees to comply with the employer's substance abuse policy. The employee consents to drug and alcohol testing in accordance with the employer's policy, following workplace incidents, or when reasonable suspicion exists. Refusal to submit to testing or a confirmed positive result may result in disciplinary action, up to and including termination.

I consent to drug and alcohol testing as permitted by employer policy and law.

What the Employee Health and Safety Agreement Is

An Employee Health and Safety Agreement is a written contract between an employer and an employee that sets workplace health and safety expectations, required training, reporting obligations, and corrective actions. It documents responsibilities for hazard identification, personal protective equipment, incident reporting, and accommodations for medical conditions. The agreement can reference company policies, OSHA standards, and applicable state rules to clarify who does what, when, and how compliance will be measured. Properly drafted, it serves both as a preventive tool and as evidence of shared obligations when incidents occur.

Why a Clear Agreement Matters for Employers and Employees

A formal Employee Health and Safety Agreement reduces ambiguity about duties, helps meet regulatory obligations, and documents mutual expectations to manage workplace risk.

Why a Clear Agreement Matters for Employers and Employees

Who Typically Uses This Agreement

The agreement is used across HR, operations, and frontline teams where safety practices or health disclosures affect work performance.

  • HR and Compliance Teams managing policy enforcement and recordkeeping.
  • Supervisors and Site Managers responsible for daily safety oversight and corrective action.
  • Employees required to follow safety rules, report incidents, and disclose work-affecting medical conditions.

Use the agreement where role-specific requirements exist (e.g., PPE, training, exposure monitoring) and to document mutual commitments in safety-critical roles.

Who Can Sign and Approve the Agreement

HR Manager

Human Resources managers typically review and sign to confirm policy alignment, retention obligations, and to ensure the agreement integrates with benefits, reasonable accommodation, and privacy policies.

Employee

Individual employees sign to acknowledge receipt, understanding, and acceptance of their duties; signatures create evidence of consent and help meet record-retention and enforcement needs.

Core Elements to Include in a Professional Agreement

A complete Employee Health and Safety Agreement organizes responsibilities, reporting steps, and legal protections into clear sections that can be referenced during audits or incident reviews.

Scope

Define covered locations, roles, and activities so parties know which tasks and environments the agreement governs and when safety protocols apply.

Safety Responsibilities

List employer obligations (training, PPE, maintenance) and employee duties (reporting hazards, following procedures) with practical examples for clarity.

Health Disclosures

Describe what medical information must be shared, how confidentiality is protected, and when accommodations might be requested under ADA or company policy.

Incident Reporting

Specify timelines and channels for reporting injuries, near-misses, or exposures, and outline investigation and corrective-action procedures.

Discipline and Remediation

Explain progressive steps for noncompliance, from retraining to suspension, ensuring procedures are consistent with employment law and collective bargaining agreements.

Acknowledgment

Provide a signature block and date fields for all parties, and state how signed agreements will be stored and accessed for audits or worker inquiries.

Step-by-Step: Completing the Agreement

Complete the agreement in order to ensure all required notices and acknowledgments are captured and retained.

  • 01
Prepare Document: Insert company name, scope, and role-specific clauses before sending for signatures.
  • 02
Add Parties: Enter employee and employer details, including IDs and work location for accurate records.
  • 03
Choose Signing Method: Select electronic signature or in-person signing based on legal and industry requirements.
  • 04
Finalize and Store: Save executed copies to the HR system and update training or accommodation records as needed.

Configure an Online Workflow for the Agreement

Configure fields and authentication carefully when using e-signature platforms to maintain legal validity and auditability.

Field Configuration
Signature Field Require signer name, date, and signature with automatic audit entry.
Conditional Fields Show medical disclosure fields only when 'yes' is selected for health questions.
Authentication Use email plus optional SMS or ID check for higher-assurance signers.
Audit Trail Capture IP, timestamp, and action logs for each signer.

Digital Signing and File Format Considerations

Ensure the platform you use supports required security, formats, and integrations before e-signing.

  • File Formats: PDF, DOCX accepted
  • Integrations: Salesforce, NetSuite, Google Workspace
  • Security: AES-256 at rest

Use vendor settings that preserve an immutable audit trail and allow export to HR and records systems for long-term retention.

Where to Send or File the Executed Agreement

Route signed agreements to the systems and departments that must retain them for compliance and operational use.

  • HR Records: Store in employee personnel file and HRIS.
  • Safety Team: Provide copies to environmental health and safety personnel.
  • Supervisor: Notify direct manager for training updates.
  • Legal/Compliance: Retain a copy for audit and regulatory review.

Key Deadlines and Timing to Track

Observe these timing elements to remain compliant with recordkeeping and reporting requirements.

Effective Date Required:

Enter MM/DD/YYYY when the agreement takes effect.

Employee Acknowledgment Deadline:

Typically completed on hire or within 7 days of assignment.

I-9 and Hiring Records:

Keep I-9 per 8 CFR §274a.2 retention rules.

OSHA Injury Reporting:

Report recordable injuries per 29 CFR §1904 timelines.

HIPAA-Related Notices:

Disclosures must meet HIPAA recordkeeping obligations when applicable.

Common Preparation Mistakes to Avoid

  • Omitting effective date which obscures obligation start and retention triggers.
  • Using vague obligations such as 'follow reasonable procedures' without specifics.
  • Failing to secure employee consent for electronic records where consumer disclosure is required.
  • Mismatching signer names or missing signature dates that harm enforceability.

Consequences and Legal Risks of Errors

Invalid Signature: May void agreement
Late Reporting: OSHA penalties possible
HIPAA Breach: Civil penalties apply
I-9 Violations: 8 CFR fines possible
Workers' Comp Issues: Coverage disputes possible
Labor Claims: Employment disputes increase

Examples of How Organizations Use These Agreements

These short examples illustrate practical uses across different organizations and why clarity matters in execution.

Optica Ventures (COO)

Optica used a role-based safety agreement for mobile field teams to standardize PPE and reporting

  • The agreement required daily check-ins and incident logs
  • This produced clearer accountability and simplified reviews during audits, reducing follow-up questions and training gaps.

Fertility Centers of Illinois (Founder)

A healthcare provider used a health and safety agreement to manage employee patient-contact restrictions

  • It tied disclosures to HIPAA-compliant storage
  • The approach limited unnecessary access to PHI while documenting accommodations and operational continuity steps.

Practical Tips for Accurate and Efficient Completion

Adopt these practices to reduce errors and speed processing while maintaining compliance.

Use Consistent Templates
Maintain a single template with role-specific exhibits to avoid contradictory clauses; version and date each template to track changes.
Require Structured Fields
Use labeled fields for dates, names, and IDs to minimize free-text errors and improve searchability in HR systems.
Capture Consent for Electronic Records
For consumer or health-related information, include the ESIGN consumer disclosure when required and record withdrawal procedures.
Preserve the Audit Trail
Store signed copies with timestamps, signer identity, and IP or authentication evidence to support enforceability and investigations.
