What an Employee Home Working Agreement Is

An Employee Home Working Agreement is a written contract that sets expectations for remote work between an employer and an employee. It defines hours, deliverables, expense reimbursement, equipment responsibilities, data protection and performance metrics. The agreement clarifies workplace safety, tax and payroll implications, insurance coverage, and procedures for equipment return or termination of the remote arrangement. Used alongside company policies, it provides a record to resolve disputes and to document consent to monitoring, security controls, and applicable governing law for the employment relationship.

Why clear home working agreements matter

A formal agreement reduces ambiguity about duties, schedules, expenses and security. It protects employer operational needs and employee rights, supports regulatory compliance for payroll and privacy, and documents consent to remote-work conditions.

Why clear home working agreements matter

Who typically completes an Employee Home Working Agreement

Employers, HR teams, hiring managers and employees use this agreement to record remote-work terms and responsibilities.

  • Human resources and hiring managers who set company-wide remote-work policies and approve individual arrangements.
  • Employees beginning or changing a remote-work arrangement who must acknowledge duties, equipment, and security obligations.
  • Finance or payroll staff who need documentation to adjust withholding, reimbursements, and state tax nexus.

Keep a signed copy in the employee file and share relevant sections with IT and payroll for operational follow-through.

Core elements to include in the agreement

A professional agreement is concise but thorough: define scope, hours, equipment, security, reimbursement and termination terms.

Work scope

Clear description of duties, expected deliverables, productivity measures and any role-specific performance targets or reporting cadence.

Hours and availability

Standard work hours, core overlap windows, on-call expectations, and procedures for requesting schedule exceptions or leave.

Equipment and expenses

Which party provides devices, peripherals, software licenses, and the process for reimbursing home office expenses or internet stipends.

Data protection

Security requirements for devices, required VPN use, encryption, acceptable use, and steps to report a suspected breach or lost device.

Payroll and taxes

How state tax withholding, work location reporting and expense treatment will be handled, and any employee obligations to notify location changes.

Termination and review

Duration of arrangement, notice period for revocation, periodic review schedule, and process for returning employer property.

Step-by-step: finalize and sign the agreement

Follow these steps to complete, approve, and retain a valid Employee Home Working Agreement.

  • 01
Prepare draft: HR or manager populates fields and attaches relevant policy exhibits.
  • 02
Review with employee: Discuss terms, answer questions, and agree on schedule and equipment.
  • 03
Approve signatories: Confirm who must sign — employee, manager, HR representative.
  • 04
Execute and store: Collect signatures and save the executed copy in the employee record.

Configure an online workflow for approvals and signatures

Set up fields, signing order, authentication and storage before sending the agreement for signature.

Field Configuration
Signature fields Place required signature and date fields for each signer.
Signing order Set sequential or parallel signing depending on approval flow.
Authentication Choose email, SMS code, or stronger verification as needed.
Archive settings Enable PDF retention, audit trail and export to HRIS.

Digital signing and technical requirements

Use a compliant eSignature platform and secure storage to execute and retain the agreement.

  • Document formats: PDF or DOCX accepted for signing.
  • Authentication options: Email link, SMS code, or multi-factor allowed.
  • Integrations: Connect with HRIS, payroll, and cloud storage.

Ensure the chosen platform supports audit trails, encryption in transit and at rest, and the retention policy required by your organization.

Where the signed agreement should go next

Route completed agreements to the right teams to update payroll, IT, and personnel records.

  • Employee copy: Provide a signed PDF copy to the employee for their records.
  • HR file: Save a copy in the official personnel file or HRIS.
  • Payroll update: Notify payroll for tax withholding or stipend changes.
  • IT ticket: Forward to IT if equipment provisioning or VPN access is required.

Typical timelines and review cycles

Common deadlines include the effective start date, payroll updates, periodic reviews and notice periods for termination of remote work.

Agreement Effective Date:

Starts on the MM/DD/YYYY entered by both parties.

Payroll change deadline:

Submit location or withholding changes before the next payroll cycle.

Expense reimbursement timing:

Expense claims typically submitted within 30 days of incurring the cost.

Review cadence:

Schedule periodic reviews every 6 or 12 months as company policy dictates.

Termination notice:

Specify required notice, often 2–30 days depending on role and policy.

Frequent mistakes to avoid

  • Failing to specify the employee's legal work location, which can create state tax and wage withholding issues.
  • Leaving equipment and reimbursement provisions vague, leading to disputes about replacements and repairs.
  • Omitting data security or VPN requirements, increasing risk of data exposure or HIPAA violations for health data.
  • Not updating payroll and benefits records after location changes, causing incorrect tax withholding or benefit eligibility problems.

Key risks and possible consequences

Tax withholding errors: Incorrect withholding may trigger state tax penalties.
I-9 noncompliance: Improper verification can lead to fines and enforcement action.
Data breach exposure: Unauthorized access could lead to regulatory penalties.
Workers’ compensation: Disputed injury location affects coverage and claims.
Employment misclassification: Misclassifying status can cause wage and tax liabilities.
Agreement unenforceable: Poor drafting risks unenforceable terms and disputes.

Employee

The employee signs to acknowledge duties, equipment terms, security obligations, and that they understand payroll and tax consequences of their chosen work location.

Practical tips for reliable agreements

Follow consistent processes to reduce legal and operational risk when creating and managing remote-work agreements.

Use a standard template
Maintain a company-approved template to ensure consistent clauses for security, equipment, reimbursement, tax treatment, and termination across all employees.
Document location changes promptly
Require employees to notify HR immediately of any change in work location to avoid incorrect withholding and state tax exposure.
Keep audit trails
Retain signed PDFs with audit metadata (timestamps, signer IP, authentication method) to demonstrate consent and execution for dispute resolution.
Review periodically
Schedule reviews every six to twelve months to confirm the arrangement still meets business needs and legal obligations.
