What an Employee Janitorial Agreement Covers

An Employee Janitorial Agreement is a written contract that defines the working relationship between an employer and a janitorial employee or cleaner. It sets out job duties, schedule, compensation, payroll classification, attendance expectations, tools and supplies provision, confidentiality, safety and health requirements, termination and notice procedures, and any probationary or training periods. The agreement clarifies whether the worker is classified as an employee or independent contractor, and includes applicable wage, tax withholding, and workers' compensation provisions to maintain compliance with federal and state employment laws.

Why a Written Janitorial Agreement Matters

Use an Employee Janitorial Agreement to reduce disputes, document wage and hour obligations, protect employer property and confidential information, and set clear performance expectations. A written agreement provides evidence of terms for payroll, liability, and compliance with federal and state labor laws.

Why a Written Janitorial Agreement Matters

Who Typically Prepares and Uses This Agreement

Typical users include HR managers, small business owners, property managers, and facilities supervisors responsible for cleaning staff.

  • Small businesses hiring part-time or full-time janitors at office or retail locations.
  • Property management firms contracting cleaning services for residential and commercial buildings.
  • Schools, healthcare providers, and public facilities managing custodial employees under institutional policies.

Use this agreement when hiring, changing terms, or documenting workplace policies for janitorial personnel regularly.

Roles That Should Review and Sign

HR Manager

An HR Manager typically completes or reviews the agreement to ensure compliance with wage and hour laws, classification rules, and benefits eligibility. They confirm payroll setup, tax withholding, background-check requirements, and coordinate training or probationary terms before the employee starts work.

Facilities Supervisor

A Facilities Supervisor defines daily duties, shift schedules, equipment and supply responsibilities, and performance standards. They use the agreement to document site-specific safety rules, keys and access protocols, and to record disciplinary steps tied to custodial performance issues.

Key Sections to Include in the Agreement

Essential sections in the Employee Janitorial Agreement ensure legal clarity and practical direction for employment, pay, duties, safety, and termination.

Parties

Identify employer legal name and employee full legal name, business address, and contact information. Include DBA names if relevant and the employee's worker classification (employee or independent contractor).

Duties

Describe specific cleaning tasks, frequency, locations, and shift times. Note expectations for handling chemicals, equipment operation, reporting damage, and any additional duties such as floor care or window cleaning.

Compensation

State pay rate (hourly or salary), overtime policy, pay schedule, payroll deductions, and reimbursement for supplies or travel. Specify how raises, bonuses, and tip reporting are handled if applicable.

Safety & PPE

Outline safety procedures, required PPE, hazardous chemical training, and compliance with OSHA rules. Include reporting protocols for injuries and a reference to workers' compensation coverage and claim procedures.

Confidentiality

Protect employer information, client lists, alarm codes, and facility access procedures. Specify duration of confidentiality obligations and permitted disclosures, including exceptions required by law or emergency response.

Termination

Describe notice requirements for resignation or termination, grounds for immediate dismissal, final pay timeline, return of keys and equipment, and any post-termination restrictive covenants or noncompete terms.
