What the Employee Loan Agreement Form Is

An Employee Loan Agreement Form documents the terms under which an employer extends credit to an employee and the employee’s obligations to repay. It records loan amount, interest (if any), repayment schedule, payroll withholding authorization, security or collateral, default remedies, and any tax implications. The form protects both parties by creating a clear, signed record of promises, timelines, and enforcement mechanisms that can be referenced if disagreements, payroll coordination, or regulatory reviews arise.

Why a Formal Employee Loan Agreement Matters (Legal and Practical)

A written agreement reduces ambiguity about repayment, supports lawful payroll deductions, and documents consent and consideration. For electronic execution, e-signatures executed under the ESIGN Act (15 U.S.C. §7001) and state UETA laws create enforceable records provided intent, consent, attribution, and retention requirements are satisfied.

Why a Formal Employee Loan Agreement Matters (Legal and Practical)

Who Typically Prepares and Signs This Form

Use the form to establish responsibilities for all parties and to create a retained record that supports payroll processing, tax reporting, and dispute resolution.

  • Human resources and payroll teams managing deductions and compliance with wage laws.
  • Finance or treasury staff tracking employer receivables and interest income.
  • Employees who request relocation, emergency, or salary-advance loans with documented repayment plans.

Typical Signatory Roles

HR Manager

The HR Manager typically reviews eligibility, authorizes payroll withholding, and stores the executed agreement. They ensure the loan complies with company policy and applicable state wage and hour restrictions, coordinating with payroll and legal as needed.

Employee Borrower

The employee signs to accept the loan terms, repayment schedule, and any payroll deduction authorization. The employee should confirm personal data accuracy and retain a copy for their records; mismatched names or dates can complicate enforcement.
