What an Employee Marine Services Contract Is

An Employee Marine Services Contract is a written agreement between an employer and an individual hired to perform marine-related work — for example, crewing, maintenance, vessel operations, or specialized maritime services. It sets out job duties, compensation, work schedule, safety and compliance obligations, insurance and indemnity provisions, and termination terms. The contract clarifies expectations for work performed on or near navigable waters and can include clauses for maritime liens, salvage, and applicable admiralty law. This template supports consistent hiring, risk allocation, and regulatory compliance.

Why the Employee Marine Services Contract Matters

An Employee Marine Services Contract defines duties, allocates liability, and documents pay and benefits to reduce disputes and clarify compliance with maritime, labor, and safety regulations. A clear contract helps manage operational risk and supports enforceability in U.S. courts.

Why the Employee Marine Services Contract Matters

Who Typically Completes an Employee Marine Services Contract

Employers and hiring managers in maritime operations, vessel management, and marine maintenance use this contract to document employment terms and obligations.

  • Shipowners and vessel operators hiring crew, engineers, or deckhands for commercial or private vessels.
  • Marine service companies contracting technicians for maintenance, repair, and inspection services aboard vessels.
  • Harbor authorities, port operators, and maritime contractors engaging specialists for on-water projects or logistics support.

Use this template when hiring crewmembers, subcontractors, or shore-side staff working under vessel operations or marine project contracts.

Core Elements to Include in the Contract

A complete Employee Marine Services Contract addresses operational duties, compensation, safety, insurance, dispute resolution, and termination to protect both employer and employee interests.

Parties

Identify employer and employee legal names, business addresses, vessel identification (if applicable), and a concise recital describing the maritime role, engagement date, and vessel or project associated with the assignment.

Scope

Define duties, work locations (onboard, dock, offshore), expected hours, on-call requirements, overtime rules, and any special certifications or licenses required for marine operations, including training and drills.

Compensation

State pay rate, pay frequency, overtime calculation, hazard or sea-pay differentials, reimbursement for travel or per diem, and any bonus or retention payment structures tied to voyage or project completion.

Safety

Require compliance with OSHA, Coast Guard regulations, and employer safety policies; mandate personal protective equipment, drug and alcohol testing policies, and emergency response procedures while aboard or during marine operations.

Insurance

Specify required insurance coverage such as workers' compensation, Jones Act considerations where applicable, employer liability, and any vessel insurance; state responsibility for premiums and proof of coverage.

Dispute

Include governing law clause, venue selection, arbitration or mediation provisions tailored to maritime and admiralty law, and procedures for handling claims, liens, or salvage disputes arising from service performance.
