Monitoring Policy — Acknowledgement and Consent

I acknowledge that the Company owns and controls all company-provided electronic systems, devices, and accounts including but not limited to email, telephone systems, computers, laptops, mobile devices, network access, cloud services, security cameras, badge access records, and vehicle telematics. Use of company systems is subject to monitoring, recording, retrieval, and review at the discretion of the Company without further notice.

I understand that monitoring may include automated collection, analysis, and retention of content and metadata, interception of communications, capture of keystrokes, screenshots, geolocation data, and use of third-party services for the purpose of security, compliance, performance, and investigation of alleged misconduct. Monitoring may occur while using company equipment and, where permitted by law, while using personal devices that connect to company systems.

Types of Monitoring

Please indicate acknowledgement of the monitoring methods described in the policy:

Privacy Expectations and Limits

I understand and agree that I have no right to privacy with respect to any information created, stored, sent, or received on company systems, including information that may be private in other contexts. Personal use of company resources may be permitted only to the extent set forth in Company policy; the Company retains the right to restrict, search, and disclose such content when necessary to enforce Company policy, protect Company assets, comply with legal obligations, or investigate wrongdoing.

Data Retention and Access

Collected data may be retained in accordance with Company retention schedules and applicable law. Access to monitored data is restricted to authorized personnel on a need-to-know basis and will be logged. The Company may disclose monitored data to law enforcement or other third parties when required by law or to protect the Company's legal rights and interests.

Prohibited Conduct and Consequences

Use of company systems to engage in unlawful activities, harassment, disclosure of confidential information, or other conduct that violates Company policy or law is prohibited. Evidence of prohibited conduct obtained through monitoring may be used in disciplinary proceedings up to and including termination and legal action.

At-Will Employment and Equal Opportunity

Nothing in this acknowledgement alters the at-will nature of employment unless expressly stated in a separate written agreement signed by an authorized company representative. The Company is an equal opportunity employer and makes employment decisions without regard to protected characteristics as defined by applicable law.

Authorization to Access and Investigate

By signing below, I authorize the Company to access, collect, and review information from company-provided equipment, accounts, and where permitted by law, personal devices that connect to Company systems. I further authorize the Company to obtain information from third parties, including service providers and prior employers, to the extent necessary to investigate compliance with Company policy or legal requirements.

Employee Certification

I certify that the information provided in this form is true and complete to the best of my knowledge. I understand that falsification or omission of relevant information may result in disciplinary action, up to and including termination. I agree to comply with Company policies regarding acceptable use, privacy, and information security.

What an Employee Monitoring Acknowledgement Is and when it’s used

An Employee Monitoring Acknowledgement is an internal record that documents an employer’s disclosure to employees about workplace monitoring practices and an employee’s written acknowledgement of those practices. Typical monitoring topics include electronic communications, computer and device use, CCTV and physical security, GPS in company vehicles, and access to cloud systems. The acknowledgement clarifies monitoring scope, lawful purposes, data handling, retention, and point-of-contact details. It is used at hire, when policies change, or before deployment of new monitoring technology to create a clear, auditable record of notice and consent.

Why a formal acknowledgement matters for employers and employees

A written acknowledgement reduces legal uncertainty, supports policy enforcement, and documents that employees received notice. It helps demonstrate compliance with privacy and employment rules, preserves evidence for internal audits, and improves transparency between employer and staff.

Why a formal acknowledgement matters for employers and employees

Who typically issues and signs these acknowledgements

Keep a signed copy in personnel files and a central compliance repository to support audits and dispute resolution.

  • Human resources teams responsible for onboarding and policy distribution
  • IT and security teams deploying monitoring tools or logging systems
  • Individual employees and contractors required to confirm understanding

Quick steps to issue and collect acknowledgements

Follow this sequence to distribute, collect, and record acknowledgements consistently for each employee.

  • 01
Draft: Prepare notice language and list monitoring methods.
  • 02
Distribute: Provide the acknowledgement at hire or before new monitoring starts.
  • 03
Authenticate: Confirm signer identity using email, SMS code, or stronger methods.
  • 04
Archive: Store signed acknowledgements in personnel records and backup.

Essential sections to include in a professional acknowledgement

A complete Employee Monitoring Acknowledgement balances clarity with legal precision; include scope, purpose, and handling rules to make the record enforceable and useful.

Notice Statement

A concise opening that states monitoring will occur, who conducts it, and which assets or locations are covered. Clear plain-language notice reduces ambiguity about the employer’s practices and intent.

Monitoring Scope

Specific list of monitored items (email, network traffic, device logs, physical cameras, GPS). Avoid vague terms; specificity helps with notice and proportionality analysis.

Purpose and Use

Explain business reasons (security, productivity, safety, compliance) and how collected data will be used in investigations or HR actions.

Data Retention

State retention periods, secure storage measures, and deletion procedures. Reference any industry rules that extend retention for legal reasons.

Limits and Privacy

Describe reasonable limits (e.g., no off-duty personal monitoring) and steps to protect personal data, including access controls and minimization practices.

Acknowledgement

Signature, printed name, date, and a brief statement that the employee read and understands the monitoring policy and where to direct questions.

Security and compliance controls to reference

Encryption: TLS 1.2/1.3; AES-256 at rest
Audit Trail: Timestamped logs with IP and action metadata
Access Controls: Role-based access and SSO where available
Certifications: SOC 2 Type II; ISO 27001; PCI DSS
Privacy Compliance: GDPR, CCPA readiness and data subject controls
Healthcare Support: HIPAA-compliant workflows (BAA required)

Key legal risks and penalties for deficient acknowledgements

Privacy Litigation: Employee privacy suits and damages
Regulatory Fines: HIPAA violations can lead to penalties
Tax Reporting Exposure: Incorrect withholding from monitoring-related pay
I-9 Documentation: I-9 errors carry $281–$2,789 fines (8 CFR)
Contract Risk: Breach claims for undisclosed monitoring
Reputational Harm: Employee trust and retention damage

Common mistakes to avoid when preparing acknowledgements

  • Using vague language that fails to identify specific monitoring tools, which invites disputes over scope and purpose.
  • Not aligning retention language with regulatory requirements (for example, HIPAA or tax rules) and internal deletion policies.
  • Failing to authenticate signers properly before relying on an electronic acknowledgement, which can weaken enforceability.
  • Neglecting to update acknowledgements after introducing new technologies or changing the monitoring purpose.

How electronic distribution and signing normally flows

Typical digital workflows reduce administrative friction while preserving an auditable record of distribution, consent, and signature.

  • Upload: Load the acknowledgement into your e-sign platform.
  • Place Fields: Add signature, date, and checkbox fields as required.
  • Deliver: Send by email or a secure signing link to the employee.
  • Record: Platform stores signed copy plus audit trail.

Typical e-sign configuration settings for this acknowledgement

Configure these settings to ensure legal validity, traceability, and convenient employee signing.

Field Configuration
Signature Field Required; date auto-populates on sign
Authentication Email by default; SMS or SSO for higher assurance
Conditional Fields Show additional cameras or sensors only when applicable
Retention Setting Retain signed PDFs and audit logs per policy

Technical and platform considerations for digital delivery

Choose a platform that supports required authentication, file formats, and secure long-term storage to preserve evidentiary value.

  • Integrations: Salesforce, NetSuite, Microsoft 365, Google Workspace
  • Formats: PDF, DOCX, HTML, Excel supported
  • Authentication: Email link, SMS code, KBA, SSO options

Ensure the platform you select produces a tamper-evident signed file and retains an audit trail to support compliance and dispute resolution.

Timing considerations and common scheduling rules

Issue and collection timing matters for enforceability, onboarding workflows, and when monitoring begins to apply to employees.

At Hire:

Provide acknowledgement during onboarding or before issuing monitored devices

Before New Monitoring:

Distribute notice prior to activating new surveillance or tracking tools

Policy Change:

Reissue acknowledgement when policy materially changes

Employee Response Time:

Set a reasonable deadline to return signed forms (e.g., 7–14 days)

Record Retention:

Keep signed copies per retention policy and applicable law
