What an Employee Moving Agreement Covers

An Employee Moving Agreement is a written contract between an employer and a relocating employee that documents the scope, conditions, and tax treatment of relocation assistance. Typical elements include the relocation allowance or reimbursement schedule, eligible expenses, required receipts, timelines for moving services, repayment obligations if employment ends early, and routing for payments. The agreement can be executed on paper or electronically under federal ESIGN (15 U.S.C. §7001) and state UETA frameworks. Clear terms reduce disputes and ensure consistent payroll and tax handling.

Why formalize relocation terms in writing

A written Employee Moving Agreement creates predictable obligations for both parties, clarifies taxable versus reimbursable items, and documents repayment triggers. It supports consistent HR administration and preserves evidence if tax or employment disputes arise.

Why formalize relocation terms in writing

Who prepares and signs this agreement

Typical users include HR, mobility teams, hiring managers, and relocating employees.

  • Human resources managers and mobility specialists who administer relocation packages and payroll adjustments.
  • Hiring managers or department heads authorizing relocation offers and timelines for new hires or transfers.
  • Employees receiving relocation benefits who must accept terms, provide receipts, and agree to repayment conditions.

The signed agreement becomes part of the employee file and payroll records for tax and retention purposes.

Step-by-step: completing an Employee Moving Agreement

Follow these sequential steps to prepare, approve, sign, and store the agreement correctly.

  • 01
Assemble policy: Confirm company relocation policy and allowed expenses.
  • 02
Populate details: Enter employee data, amounts, dates, and conditions.
  • 03
Review and approve: Obtain required manager and HR approvals.
  • 04
Sign and retain: Execute signatures and store per retention rules.

Typical eSubmission and signing workflow

A standard electronic signing flow reduces turnaround time and provides an auditable record of consent and execution.

  • Upload document: Add the finalized agreement to the eSignature platform.
  • Place fields: Insert signature, date, and receipt-upload fields.
  • Send to signer: Invite employee and authorized approvers by email.
  • Capture audit trail: Platform records timestamps, IP, and actions for compliance.

Configuring the online completion workflow

Set up authentication, fields, and notifications to match your compliance and operational needs.

Field Configuration
Authentication Email link by default; SMS or KBA for higher assurance
Required uploads Set receipts and invoices as mandatory attachments
Approvals Routing order: employee → hiring manager → HR
Notifications Automatic reminders at set intervals until signed

Technical considerations for eSigning and delivery

Confirm supported file types, integrations, and authentication methods before distributing electronically.

  • File formats: PDF and DOCX are commonly supported
  • Integrations: CRM/HR systems like Salesforce or NetSuite enable record linking
  • Security: TLS and audit trails preserve integrity

Match platform settings to your internal controls and privacy requirements, and document the configuration in your SOPs.

Core elements to include for clarity and enforceability

A professionally drafted Employee Moving Agreement balances operational detail with enforceable legal terms.

Relocation allowance

Define total payments or per-expense caps, payment timing, and whether amounts are advances, reimbursements, or taxable wages.

Eligible expenses

Specify covered categories such as movers, storage, travel, and temporary housing with itemized receipt requirements.

Payment mechanics

Describe invoicing, reimbursement process, direct-billing to vendors, and payroll reporting where applicable.

Tax handling

State whether reimbursements are taxable wages and how withholding or reporting will be handled for payroll tax compliance.

Repayment and clawback

Set clear triggers, amounts owed upon early departure, and authorized collection methods including payroll deduction.

Dispute resolution

Include governing law, jurisdiction, and any mediation or arbitration clauses to manage post-termination disputes.

Security and compliance controls to verify

Encryption: TLS 1.2/1.3 in transit; AES-256 at rest
Audit trail: Detailed timestamps, IP, and signer actions
Certifications: SOC 2 Type II and ISO 27001 available
HIPAA readiness: BAA available for protected health information
21 CFR Part 11: Electronic records support controls required
Accessibility: WCAG 2.0 Level AA compatibility

Key legal and tax risks to address

Taxable wages: Reimbursements may be taxable if not qualified
Missing receipts: Failure to collect receipts prevents substantiation
Ambiguous repayment: Vague clawback terms complicate enforcement
Improper signature: Unsigned or improperly signed agreements may be unenforceable
Record retention lapse: Loss of records hinders audit defense
Privacy exposures: Inadequate controls risk PHI or PII breaches

Common mistakes when preparing this agreement

  • Using vague reimbursement language that omits required documentation and per-item caps leads to disagreement and overpayment.
  • Not specifying tax treatment or withholding creates unexpected payroll liabilities for employer and employee.
  • Failing to include clear repayment triggers or collection procedures makes clawbacks difficult to pursue legally.
  • Distributing unsigned drafts or relying on informal email confirmations without a signed agreement weakens enforceability.

Typical deadlines and submission expectations

Set clear calendar dates for expense submission, payment, and reconciliation to avoid conflicts and tax issues.

Effective date:

Date when relocation benefits and obligations begin

Receipt submission:

Employee typically has 30–90 days to submit receipts

Reimbursement timing:

Repayment window:
