What an Employee Per Diem Agreement Covers

An Employee Per Diem Agreement defines the employer's daily allowance policy for travel-related expenses, including lodging, meals, and incidentals. It sets eligibility, per diem rates, substantiation and reimbursement procedures, and tax treatment expectations. The document clarifies whether payments follow federal GSA or IRS per diem guidelines, whether excess amounts are taxable, and the process for submitting expense reports, approvals, and repayment. Well-drafted agreements reduce disputes, support consistent payroll processing, and document the employer's accounting and audit controls for travel reimbursements.

Why a Clear Per Diem Agreement Matters

A written per diem agreement protects both parties by documenting rates, substantiation rules, and tax treatment. It reduces misunderstandings about reimbursements, supports compliance with IRS substantiation requirements for accountable plans, and creates a consistent internal approval process.

Why a Clear Per Diem Agreement Matters

Who Typically Prepares and Signs This Agreement

Employers, HR teams, and traveling employees commonly rely on per diem agreements to set consistent reimbursement rules and approval workflows.

  • Human resources teams and payroll administrators responsible for policy enforcement and recordkeeping.
  • Field employees and contractors who travel for business and need clear reimbursement expectations.
  • Finance or accounting staff who process expense reports and ensure tax compliance.

Clear assignment of roles (who approves, who processes payments) reduces errors and speeds reimbursement.

Core Elements to Include in the Agreement

A professional Employee Per Diem Agreement should be concise but cover rates, eligibility, substantiation, tax treatment, approval flow, and amendment procedures to avoid disputes and audit exposure.

Per Diem Rates

Specify daily amounts or reference GSA/IRS schedules, include regional variations, and state whether partial days receive prorated amounts.

Eligibility

Define who qualifies (employees, contractors), required trip duration, travel distance thresholds, and exceptions for local travel.

Substantiation

List required documentation (dates, purpose, locations), acceptable receipts, and timelines for submitting expense reports.

Tax Treatment

State whether payments are treated as accountable-plan reimbursements or taxable wages and explain employee responsibilities for reporting.

Approval Workflow

Describe approver roles, escalation steps, timing for reimbursements, and consequences for late or incomplete documentation.

Amendments

Explain how rates or policy changes take effect, required notice periods, and who may sign amendments on behalf of the employer.

Employee submission deadline:

Submit expense report within 30 days of trip end

Manager review timeframe:

Approve or return within 7–10 business days

Payroll processing window:

Include approved per diem in next payroll cycle

Year-end reporting:

Reconcile taxable per diem before annual filings

Record retention start:

Retention runs from agreement or trip date

Common Mistakes to Avoid

  • Failing to tie per diem to specific travel dates causes reconciliation issues and audit flags.
  • Using inconsistent rates across employees or regions leads to perceived unfairness and payroll errors.
  • Accepting late or incomplete substantiation increases tax exposure if payments are treated as nonaccountable.
  • Not documenting amendment procedures leaves disputes about rate changes or retroactive adjustments unresolved.

Key Risks and Potential Consequences

Tax exposure: Incorrectly treated per diem may be taxable
Payroll adjustments: Withholding and reporting corrections required
Audit findings: Insufficient records can trigger inquiry
Repayment requests: Employees may be asked to repay overpayments
Policy disputes: Inconsistent enforcement causes grievances
State compliance: Local wage rules may limit deductions

Practical Use Cases

Two common scenarios show how per diem agreements streamline travel reimbursement for field staff and remote assignments.

Field Sales Team

A distributed sales team travels regularly for client meetings

  • Per diem paid for nights away
  • A standard agreement reduced processing time and ensured consistent taxable treatment, while centralizing approvals in payroll for audit readiness.

Regional Healthcare Visits

Clinicians travel between clinics for outreach

  • Organization sets GSA-based regional rates
  • Clear rules on substantiation and HIPAA-conscious documentation reduced disputes and aligned retention with healthcare compliance.
