What the Employee Recruiting Group Agreement Is

An Employee Recruiting Group Agreement is a written contract between an employer and one or more recruiting firms or independent recruiters that defines the terms for sourcing, presenting, and placing candidates. Typical provisions cover scope of services, fee structure and timing, candidate ownership and exclusivity, replacement or refund obligations, confidentiality and non-solicitation, and the effective term. The agreement creates clear expectations for candidate submissions, interview coordination, offer handling, and payment triggers to reduce disputes and document each party’s responsibilities.

Why this Agreement Matters for Hiring

A clear Employee Recruiting Group Agreement minimizes disputes about fees, candidate ownership, and timelines, and documents legal responsibilities for both employer and recruiter. It supports compliance with payroll and tax recordkeeping and protects sensitive candidate data when combined with appropriate privacy language.
