What the Employee Relation Agreement Is and when it applies

An Employee Relation Agreement is a written contract that documents specific expectations between an employer and one or more employees, covering topics such as workplace conduct, reporting procedures, dispute resolution, confidentiality, and corrective action. It may be used alongside employment contracts, handbooks, or policies to address particular relationships, team interactions, or remediation steps. The agreement clarifies duties, timelines for corrective measures, and processes for escalation, and it can establish confidentiality, non-retaliation, and return-of-property obligations to reduce ambiguity and support consistent HR decisions.

Why an Employee Relation Agreement matters for HR and risk management

A clear Employee Relation Agreement sets expectations, documents mutual commitments, and creates an auditable record that protects both parties. It reduces misunderstandings, supports progressive discipline, and helps demonstrate compliance with internal policies and external obligations when disputes arise.

Why an Employee Relation Agreement matters for HR and risk management

Who typically prepares and signs these agreements

Signatures typically include the employee, the approving manager, and an HR or legal representative; authorized signers should be documented in company policy.

  • Human resources managers who document performance plans, corrective actions, and behavior-related expectations for employees.
  • Legal counsel or corporate attorneys who review language for enforceability, regulatory risk, and consistency with company policy.
  • Line managers or supervisors who initiate the agreement based on operational needs and coordinate signings with HR and the employee.

Core sections to include in a professional Employee Relation Agreement

A well-drafted agreement organizes obligations, timelines, confidentiality, dispute resolution, and signature details so the parties clearly understand expectations and remedies.

Purpose

Explain the reason for the agreement, whether corrective action, special assignment, or confidentiality obligation, to limit scope and avoid ambiguity.

List specific responsibilities, performance targets, or behavioral standards with measurable criteria and applicable timeframes for review.

Remedies

Confidentiality

Include proprietary information and data-handling rules; define duration of confidentiality and any permitted disclosures.

Common mistakes to avoid when preparing the agreement

  • Using vague performance metrics that cannot be objectively measured often leads to disputes over compliance.
  • Failing to obtain signature from an authorized representative may render the agreement unenforceable against the employer.
  • Omitting dates or using inconsistent date formats can create uncertainty about when obligations or deadlines begin.
  • Not retaining a tamper-evident copy or audit trail increases risk during arbitration or litigation.

Potential legal and administrative risks

Breach Claim: Civil damages possible
Employment Action Risk: Wrongful termination claims
Invalid Agreement: Improper authorization voids terms
Tax Errors: Incorrect withholding exposure
Privacy Violation: Unauthorized data disclosure
I-9 Noncompliance: Administrative fines possible
