Employee Name:

I acknowledge that participation in the retreat and related activities (including but not limited to travel, team-building, outdoor recreation, workshops, and social events) involves inherent risks of personal injury, property loss or damage, and other hazards. I voluntarily assume all such risks, whether known or unknown, foreseeable or unforeseeable, and accept full responsibility for any injury, loss or damage that I may sustain.

I, on behalf of myself, my heirs, assigns, personal representatives and next of kin, hereby release, waive, discharge and covenant not to sue my employer, its officers, directors, employees, agents, volunteers, contractors, affiliates and other representatives (collectively the "Company Parties") from any and all liability, claims, demands, actions or causes of action for any loss, damage, injury or death, whether caused by the negligence of the Company Parties or otherwise, arising from or in connection with my participation in the retreat.

Indemnification

I agree to indemnify and hold harmless the Company Parties from and against any and all claims, liability, losses, expenses (including reasonable attorneys’ fees), costs and damages arising out of or related to my negligent, reckless, or intentional acts or omissions during the retreat, including claims by third parties.

Photo & Media Release

I grant the Company Parties the right to photograph, record, or otherwise capture my image and likeness during retreat activities and to use such media for lawful business purposes, including internal communications, training, and promotional materials. I waive any right to inspect or approve such use and release the Company Parties from any claims related to the use of such media.

Behavior, Safety & Compliance

I agree to comply with all Company policies, directions from retreat leadership, and applicable laws while participating in retreat activities. I understand that possession or use of illegal drugs, failure to comply with safety instructions, or other unlawful or dangerous behavior may result in removal from the retreat at my expense and may subject me to disciplinary action up to and including termination of employment.

What an Employee Retreat Waiver Is and when it applies

An Employee Retreat Waiver is a signed release used by employers to document participant assumptions of risk and to limit employer liability for injuries, property loss, or other incidents that may occur during company-sponsored offsite events. The waiver typically explains permitted activities, required safety precautions, emergency contact procedures, and acknowledgment of fitness to participate. It can include consent for medical treatment, photo release language, and governing law clauses. Properly drafted waivers reduce ambiguity and support risk management when paired with appropriate insurance and safety protocols.

Who typically completes and relies on this waiver

Employers, HR teams, and event coordinators use Employee Retreat Waivers to capture informed consent and manage event risk before participants attend.

  • HR managers coordinating offsite activities and on-site health screenings.
  • In-house legal counsel reviewing liability language for state-specific enforceability concerns.
  • Event vendors and activity leads collecting signed waivers before participation.

Signed waivers support incident response, claims handling, and documentation that safety procedures and participant acknowledgments were completed.

  • 01
Gather Participant Info: Collect names, addresses, emergency contacts, and medical details.

Core sections to include in a professional waiver

Essential components of a professional Employee Retreat Waiver that clarify risks, responsibilities, and emergency procedures for participants and organizers prior to events.

Risk Acknowledgment

Clear statement that participant understands and accepts risks associated with specific retreat activities, including physical exercise, travel, and social events; lists examples and advisories to set expectations.

Assumption of Risk

Participant agrees to assume responsibility for voluntary participation and releases the company from liability for ordinary negligence, subject to any statutory limitations or public policy exceptions in the governing jurisdiction.

Medical Release

Optional authorization for emergency medical treatment with a statement of known conditions and medications; advises that HIPAA privacy requirements must be followed when handling protected health information.

Photo Release

Consent for photographs or recordings during the event, including use for internal communications or promotional materials, with an opt-out checkbox if the employer permits exceptions.

Indemnification

Clause requiring participant to indemnify the company for claims arising from their intentional acts or gross negligence, including coverage for costs of defense, settlements, and related legal fees.

Governing Law

Specify the state law that will govern interpretation and disputes, and include venue selection to reduce uncertainty about litigating claims arising from retreat incidents and enforcement.

Errors that most often reduce a waiver's value

  • Failing to list specific high-risk activities can render a waiver ambiguous and reduce enforceability in litigation.
  • Collecting unsigned waivers or duplicates with mismatched names creates administrative burdens and insurance coverage disputes after incidents.
  • Using overly broad or unconscionable language risks court invalidation under state public policy exceptions and statutes.
  • Not updating waivers for new activities, locations, or changed safety protocols can expose employers to avoidable claims.
