What the Employee Screen Consent Is and When it's Used

An Employee Screen Consent is a written authorization that allows an employer or its agent to obtain background screening reports about a job applicant or employee. Typical checks include criminal history, credit reports where permitted, employment and education verifications, and drug testing results. The form documents the applicant's informed consent, provides required disclosures when a consumer report is used, and records identity and signature for compliance with applicable federal and state laws governing background checks.

Why a Clear Consent Form Matters for Compliance and Risk Control

A properly drafted Employee Screen Consent protects employers by documenting applicant authorization, meeting disclosure requirements for consumer-report-based checks, and creating an auditable record of consent and signature. It reduces legal risk, supports consistent hiring practices, and helps demonstrate compliance during regulatory or litigation review.

Why a Clear Consent Form Matters for Compliance and Risk Control

Who Typically Prepares and Signs an Employee Screen Consent

Employers, HR teams, background-check vendors, and applicants commonly use this consent form during hiring and onboarding.

  • Hiring managers and HR professionals who must document screening authorization before ordering reports.
  • Third-party consumer-reporting agencies and screening vendors that require written permission to run checks.
  • Job applicants and employees who must provide identity, signature, and clear consent to proceed.

Use consistent forms and a secure storage process to reduce disputes and meet audit expectations.

Core Elements to Include in a Professional Employee Screen Consent

A complete consent form balances clarity for the signer with the employer's need for specific screening permissions. Include items that address identity, scope, consumer-report disclosures, signature, and retention so the document is enforceable and audit-ready.

Identifying Data

Full legal name, date of birth, and other identifiers used to match records accurately.

Scope of Checks

Explicit list (criminal, employment, education, credit where permitted, drug testing).

Consumer-Report Disclosure

If a CRA report will be used, include the required standalone disclosure and authorization.

Signature and Date

Signer name, signature, and date with a clear statement of consent to the checks listed.

Use and Sharing

Explain who will receive the results and how the information will be used in employment decisions.

Revocation & Questions

How the signer can withdraw consent and contact information for inquiries or disputes.

How to Complete the Employee Screen Consent — Step by Step

Follow these sequential steps to prepare, obtain, and retain a compliant consent.

  • 01
Prepare Form: Select a clear consent template and list precise checks to be performed.
  • 02
Collect Identity: Have the applicant provide full legal name, DOB, address, and SSN if required.
  • 03
Obtain Signature: Capture signature and date; document method (electronic or wet).
  • 04
Retain Record: Store the completed form securely and log retrieval details for audits.

Typical Electronic Consent and Screening Workflow

A common e-sign workflow reduces friction while preserving an audit trail and identity verification steps for the screening process.

  • Upload Form: Sender uploads the consent to the e-sign platform.
  • Place Fields: Signature, date, and optional identity fields are added to the document.
  • Send to Signer: Signers receive an email or secure link to review and sign.
  • Capture Audit Trail: Platform logs IP, timestamp, and execution events for later review.

Recommended Platform Settings for Secure eSubmission

Configure your e-sign workflow to require clear consent, adequate signer authentication, and an immutable audit trail.

Field Configuration
Authentication Email link | Optional SMS code or knowledge-based authentication
Conditional Fields Enabled | Show additional items when specific boxes are checked
Bulk Send Use plan that supports bulk | reduces manual sends for many applicants
Audit Trail Enabled | Record IP, timestamps, and signer actions
