I further authorize prior employers, references and institutions to release such records to the Employer and its agents.

Bond Terms and Employee Obligations

1. Employee acknowledges that the Employer, as Obligee, requires this bond to protect against loss arising from acts or omissions by the Employee within the scope of employment. Employee agrees to faithfully perform bonded duties and to exercise the highest standard of care in handling funds, property and records.

2. Employee agrees to cooperate fully with any investigation of loss, to provide written statements, and to submit to interviews and fingerprinting if requested by the Employer or the surety. Failure to cooperate is grounds for disciplinary action, including termination.

3. Indemnity and Reimbursement: Employee shall indemnify and hold harmless the Employer and its surety for any loss, including all costs, expenses, and attorney fees incurred in investigating and prosecuting claims arising from Employee's dishonest, fraudulent, or negligent acts. The Employer may recover such amounts by civil action or by deduction from wages and final pay to the extent permitted by law.

4. Surety Rights and Subrogation: If the surety pays a claim on the bond, Employee acknowledges that the surety shall be subrogated to the rights of the Obligee and may pursue recovery from Employee for the amounts paid. Employee consents to assignment of claims and any legal action necessary to recover losses.

5. Duration and Termination: Bond coverage shall remain in effect for the bond period stated above and may be terminated earlier upon written notice or as provided in the surety agreement. Termination of employment does not relieve Employee of liability for acts occurring during the period of coverage.

What the Employee Security Bond Form Is and when it applies

An Employee Security Bond Form documents a bond or surety arrangement tied to an employee’s responsibility for company funds, confidential assets, or high-risk duties. The form records the bonded amount, parties (employee, employer, surety), effective date, coverage limits, and events that trigger a claim. Employers use it to allocate financial responsibility and create a contractual basis for recovery if an employee’s actions cause loss. The form can be completed on paper or electronically and should align with internal policies, insurance requirements, and any applicable state laws.

Why maintaining a clear Employee Security Bond Form matters

A well‑drafted form clarifies financial exposure, documents consent, and supports claims against a surety or employee when loss occurs. It establishes obligations, reduces disputes, and helps employers meet internal control and audit requirements while providing evidence for insurance or legal proceedings.

Why maintaining a clear Employee Security Bond Form matters

Who typically completes and signs this form

The Employee Security Bond Form is completed and managed by HR, finance, and legal teams before an employee begins bonded duties.

  • HR and Talent Acquisition: Prepares bond conditions as part of the offer or onboarding package to ensure the employee accepts bonded responsibilities.
  • Finance and Treasury: Sets the bond amount, verifies coverage, and records accounting controls tied to bonded roles.
  • Legal or Risk Management: Reviews language, ensures enforceability, and coordinates with surety providers or insurers.

Essential sections a professional Employee Security Bond Form should include

A complete form combines parties, bond terms, coverage details, claim triggers, duration, and signature blocks so the document is actionable and auditable.

  • Finance/treasury: Record bond details in control documentation and ledgers.

Common mistakes to avoid when preparing the form

  • Unclear scope: failing to define covered conduct leads to disputes and denied claims during loss investigations.
  • Incorrect parties: using a trade name or abbreviation instead of the legal entity can invalidate recovery against the employer or surety.
  • Missing dates or amounts: leaving effective dates or bond limits blank undermines enforceability and complicates audits.
  • Incomplete signatures: not obtaining required surety or witness signatures may prevent the bond from supporting an insurance claim.

Consequences of errors or missing information

Claim denial: Incomplete form can lead insurers to deny coverage
Employer liability: Unclear terms may increase employer exposure
Disciplinary action: Employee may face termination for bonded-duty breaches
Audit findings: Missing records can trigger internal or external audit exceptions
Legal disputes: Ambiguous language increases litigation risk
Financial loss: Delayed claims reduce recovery prospects
