At-Will Employment: Employee acknowledges and agrees that employment with the Employer is at-will. Either the Employer or the Employee may terminate the employment relationship at any time, with or without cause or prior notice, except where otherwise prohibited by law. Employee understands that no representative of the Employer, other than an authorized officer in a written instrument signed by that officer and the Employee, has the authority to alter this at-will relationship.

Confidentiality: Employee will not disclose confidential business information, customer payment data, proprietary recipes, guest lists, pricing strategies, or other non-public information. This duty continues after separation of employment. Unauthorized disclosure may result in disciplinary action, including termination and legal remedies.

Tip Pooling and Distribution: Tips received by servers may be subject to a mandatory tip pool in which all front-of-house staff contribute. Employer will maintain records of tip pooling and distribution in accordance with applicable wage and hour laws. Misappropriation of pooled tips or cash handling violations constitute grounds for disciplinary action.

Uniforms, Grooming, and Health: Employee agrees to comply with the Employer's grooming, uniform, and health requirements, including any mandatory training and any job-specific health screenings. Food-handling certifications required by law must be obtained or maintained as a condition of employment.

Background Check and Employment Verification: Employee authorizes the Employer to verify prior employment, education, and to obtain a criminal background check and other pre-employment screening as allowed by law. Refusal to authorize such checks may result in disqualification from employment.

Discipline, Termination, and Dispute Resolution

Grounds for Termination: Violations of cash handling procedures, theft, harassment, falsification of records, failure to maintain required certifications, or repeated policy violations are grounds for disciplinary action up to and including termination.

Dispute Resolution: Employee and Employer agree to attempt to resolve employment-related disputes through an internal review process. If internal review does not resolve the dispute, both parties agree that claims arising out of or relating to this Agreement or employment shall be submitted to binding arbitration, except for wage and hour claims that require statutory procedures. Arbitration will be private and final, and judgment on the award may be entered in any court having jurisdiction.

Applicant Certification and Authorization

What an Employee Server Agreement Covers

An Employee Server Agreement is a written contract between an employer and an employee that defines access rights, operational responsibilities, security obligations, and permitted uses for company servers and hosted systems. It typically covers account provisioning, password and key handling, maintenance windows, acceptable use, data classification, monitoring and logging, incident reporting, confidentiality, intellectual property assignment, and procedures for termination or role changes. The agreement aligns employee duties with corporate security policies and regulatory obligations and often includes audit and remediation rights to support compliance programs.

Why this Agreement Matters for Risk and Compliance

A clear Employee Server Agreement reduces operational risk by documenting who may access servers, how credentials are managed, and what security controls apply. It supports incident response, enforces least-privilege practices, and provides contractual basis for disciplinary or corrective action.

Why this Agreement Matters for Risk and Compliance

Who Typically Completes an Employee Server Agreement

Employers, IT administrators, and HR teams use this agreement to set expectations before granting server access.

  • IT administrators and sysadmins who require privileged access to production systems; documents operational responsibilities and on-call expectations.
  • HR and security teams that coordinate onboarding/offboarding and enforce policy compliance across employees and contractors.
  • Contractors and consultants who need temporary or project-based server access; establishes scope, duration, and exit procedures.

Use this agreement for new hires, role changes that expand access, contractor engagements, and periodic privilege reviews.

Core Elements to Include in a Professional Agreement

A comprehensive Employee Server Agreement contains clauses that cover authority, technical controls, monitoring, and legal obligations so responsibilities are unambiguous and enforceable.

Access Scope

Define exact systems, environments, and account types the employee may access; limit production privileges and specify read/write allowances to minimize risk.

Authentication

Require multi-factor authentication, approved credential storage practices, and rules for SSH keys, API tokens, and password rotation intervals to maintain secure access.

Acceptable Use

List permitted activities and prohibited behaviors, including software installation, personal use prohibitions, and constraints on data exfiltration or lateral movement.

Monitoring & Logging

State that activity may be monitored, logs retained for security purposes, and that audit trails can be used in investigations or disciplinary actions.

Incident Reporting

Specify required reporting timelines for suspected breaches, misconfigurations, or lost credentials and outline the escalation path and remediation expectations.

Termination & Return

Describe immediate access revocation procedures, account deprovisioning steps, and return or destruction of any credentials, keys, or sensitive materials.

Required Information to Collect

Employee Identity: Full legal name
Job Role: Title and team
Access Level: Environments and privileges
Account IDs: Usernames and key IDs
Effective Dates: Start and end dates
Approval Chain: Authorizing manager

Step-by-Step: How to Complete and Approve the Agreement

Follow these sequential steps to request, approve, and activate server access while maintaining an auditable trail.

  • 01
Prepare Request: Employee or manager fills form with exact systems and justification.
  • 02
Obtain Approvals: Manager and security officer review and sign.
  • 03
Provision Access: IT creates accounts, assigns groups, and enforces MFA.
  • 04
Document Completion: Store signed agreement and log provisioning actions.

Where Signed Agreements Are Stored and Who Receives Copies

Signed agreements should be routed to HR, IT, and security with a master copy retained by records; maintain an audit trail of distribution and storage location.

  • HR Record: Maintains personnel file and access history.
  • IT Provisioning Log: Links agreement to account and change tickets.
  • Security Archive: Retains copies for incident response and audits.
  • Employee Copy: Provide signed copy to the employee for reference.

Digital Signing and Distribution Considerations

Use eSignature tools that preserve audit trails, support multi-signer workflows, and retain tamper-evident copies.

  • File Formats: PDF or DOCX recommended
  • Authentication: Email, SMS, or stronger MFA
  • Integrations: Connect with HRIS and ticketing

Ensure chosen platform supports secure storage, role-based access to signed agreements, and the ability to export audit reports for compliance reviews.

How to Configure an Online Completion Workflow

Set up a digital workflow that matches your approval chain and preserves evidence of consent and identity verification.

Field Configuration
Requester Auto-fill from HRIS
Manager Approval Sequential signer required
Security Approval Conditional signer if access elevated
Provisioning Trigger API call to ticketing system

Key Timing Rules and Expected SLAs

Establish clear deadlines for approvals, provisioning, and access revocation to avoid unauthorized access or audit gaps.

Approval SLA:

Manager response within 3 business days

Provisioning Window:

IT to provision within 2 business days after approvals

Temporary Access Limit:

Temporary credentials expire after 14 days

Offboarding Action:

Revoke access within 24 hours of termination

Privilege Review Frequency:

Quarterly access reviews recommended

Common Mistakes to Avoid

  • Granting broad or permanent administrative rights rather than time-limited, role-appropriate privileges increases attack surface and audit findings.
  • Failing to link the signed agreement to provisioning records or tickets leaves gaps that complicate incident investigations and compliance reviews.
  • Using weak or shared credentials and omitting multi-factor authentication undermines security controls and may breach policy requirements.
  • Neglecting to update or revoke keys and API tokens during role changes or termination leads to lingering unauthorized access risks.

Consequences of an Incorrect or Missing Agreement

Breach Liability: Civil and regulatory exposure
HIPAA Risk: Potential fines if PHI is exposed
Termination Risk: Disciplinary or dismissal action
Operational Impact: Extended downtime and remediation costs
Contractual Penalties: Vendor or customer breach clauses
Audit Findings: Remediation orders and reputational harm
