What an Employee Service Dog Agreement Is and Why It Matters

The Employee Service Dog Agreement is a written workplace accommodation that records the terms under which an employee may bring a trained service dog to the workplace. It sets expectations for access, supervision, hygiene, workspace boundaries, public interactions, and responsibility for any damage or costs. The agreement documents the employee’s request, any supporting medical or training information, agreed modifications to job duties or schedules if needed, and confidentiality measures for protected health information. A clear written agreement helps employers and employees manage operational impacts while supporting rights under federal disability law.

Why a Formal Agreement Benefits Employers and Employees

A written Employee Service Dog Agreement creates predictable expectations, reduces misunderstandings, and provides an auditable record of an approved accommodation. It supports ADA compliance, protects employee health information, and helps operational planning for workspace adjustments and safety steps.

Why a Formal Agreement Benefits Employers and Employees

Who Typically Completes an Employee Service Dog Agreement

After signatures, HR retains the agreement in the employee’s confidential file and distributes copies to the employee and the approving manager.

  • Human Resources professional responsible for accommodations and recordkeeping
  • Employee requesting the accommodation or their authorized representative
  • Direct supervisor or department manager who will apply workplace adjustments

Step-by-Step: How to Complete the Agreement

Follow these sequential steps to gather approvals and finalize the Employee Service Dog Agreement.

  • 01
    1. Employee Request: Employee submits a written accommodation request.
  • 02
    2. Intake Review: HR evaluates documentation and initiates an interactive process.
  • 03
    3. Draft Agreement: HR and manager draft terms addressing access and responsibilities.
  • 04
    4. Signatures: Employee, manager, and HR sign and date the final agreement.

Core Elements to Include in a Professional Agreement

Ensure the agreement covers operational, legal, and health privacy elements so both parties know obligations and limits.

Scope of Access

Define where the dog is permitted, restricted areas, and client-facing rules to balance accessibility and safety.

Handler Responsibilities

Specify feeding, cleanup, supervision, and control expectations to maintain workplace hygiene and safety.

Health and Safety Measures

Note vaccination, behavior standards, and steps for incidents such as bites, allergies, or aggressive behavior.

Property Damage

Allocate responsibility for damage and outline reporting and remediation procedures.

Duration and Review

State effective date, review frequency, and conditions triggering modification or termination.

Confidentiality

Restrict medical information sharing per HIPAA and company privacy rules; retain limited verification only.

Dog Details: Name, breed, training
Effective Date: MM/DD/YYYY

Common Preparation Mistakes to Avoid

  • Leaving vague access language such as 'reasonable access' without specifying areas or exceptions leads to future disputes and inconsistent enforcement.
  • Requesting unnecessary medical details beyond what the ADA permits can violate privacy rules and expose the organization to legal risk.
  • Failing to document agreed limitations or behavior standards makes it harder to address incidents like allergies, disturbances, or property damage.
  • Not including a review date or renewal process can result in outdated terms and unclear obligations when job duties change.

Risks and Consequences of an Incorrect or Missing Agreement

Discrimination Claims: Employment litigation risk
Privacy Violations: Unauthorized PHI disclosure
Operational Disruption: Workplace conflicts and absences
Regulatory Scrutiny: Agency inquiries or audits
Insurance Gaps: Uncovered liability costs
Inconsistent Enforcement: Unequal treatment exposure

Where the Agreement Goes and Who Receives Copies

After completion, route copies to HR, the employee, and the immediate supervisor; store a confidential copy in the employee file.

  • HR Records: Retain confidential original
  • Employee Copy: Provide signed copy to employee
  • Manager Copy: Manager retains operational copy
  • Legal Counsel: Share if legal review was required

How to Set Up an Online Completion Workflow

Configure a simple digital workflow to collect the employee request, manager review, and HR approval while keeping records secure and auditable.

Field Configuration
Employee Input Secure form with conditional fields
Manager Review Sequential approval step
HR Approval Final sign-off and retention
Audit Trail Automatic logging of actions

Digital Signing and Distribution Considerations

Ensure the chosen service allows retention and restricted access for HR records and supports any organizational BAA or security controls required for PHI.

  • Authentication: Email, SMS, or stronger
  • Audit Trail: IP, timestamp, and logs
  • File Formats: PDF and DOCX support

Schedule Reviews
Set periodic reviews to reassess fit with job duties or workplace changes.
