EMPLOYEE SICKNESS ABSENCE POLICY

Employer Name:    Effective Date:

Purpose

This policy sets forth the rules, procedures, and employee and employer responsibilities relating to sickness absence, medical certification, pay entitlements, return-to-work requirements, and related recordkeeping. It is intended to ensure consistent administration, protect workplace health, and comply with applicable federal, state, and local leave and disability laws.

Scope

This policy applies to all employees of the Employer, including full-time, part-time, and temporary employees, unless otherwise superseded by a collective bargaining agreement or statutory requirement.

Definitions

For purposes of this policy: "Sickness absence" means an absence from scheduled work due to an employee's own illness or injury, or required medical or dental treatment. "Medical certification" means documentation from a licensed health care provider verifying the nature and expected duration of the condition.

Reporting an Absence

Employees must notify their manager or the designated human resources representative as soon as practicable and, except in emergency situations, no later than before the scheduled start of the workday. Notification must include the reason for absence and expected return date.

Medical Certification and Verification

The Employer may require medical certification for any sickness absence. Where requested, an employee must provide a certification from a licensed health care provider stating the nature of the illness, dates unable to work, and any work restrictions. For absences of consecutive workdays or more, medical certification will be required upon return unless otherwise specified by applicable law.

The Employer reserves the right to require a second medical opinion at the Employer's expense where there is a legitimate question regarding the validity of a medical certification.

Paid Sick Leave and Pay Treatment

Employees eligible for paid sick leave shall follow the Employer's accrual and usage rules. Pay during sickness absence will be determined based on accrued sick time, and where applicable, other paid leave entitlements. Unpaid leave may be granted where paid leave is exhausted, subject to applicable law.

Employees must accurately report leave usage; falsification of time or a claim for paid leave may result in disciplinary action up to and including termination.

Reasonable Accommodation and Return-to-Work

Employees who require accommodation related to a medical condition should notify Human Resources. The Employer will engage in an interactive process to determine reasonable accommodations in accordance with applicable disability and leave laws. A fitness-for-duty certification may be required prior to return to the workplace when the condition could affect safety or essential job functions.

Excessive Absence and Disciplinary Action

Absences that are frequent, unreported, or inconsistent with medical documentation may be subject to progressive disciplinary action. Each case will be considered on its facts, including any applicable protected leave entitlements or accommodations.

Recordkeeping and Confidentiality

Medical information and documentation will be maintained separately from personnel files and kept confidential to the extent required by law. Access will be limited to those with a legitimate need to know for administering leave, accommodation, or safety requirements.

Interaction with Other Leave Entitlements

Sickness absence will run concurrently with any other applicable statutory leave entitlements where required by law. Eligibility for other leaves and benefits will be determined in accordance with applicable law and Employer policies.

Employee Responsibilities

Employees must:

  • Notify their supervisor or HR as required before the start of the shift or as soon as practicable.
  • Provide truthful information regarding the reason for the absence and expected return date.
  • Submit requested medical documentation in a timely manner.
  • Comply with return-to-work and accommodation processes.

Employer Responsibilities

The Employer will administer this policy consistently, maintain confidentiality of medical information, and provide information regarding leave entitlements and accommodations when requested.

What an Employee Sickness Absence Policy Covers

An Employee Sickness Absence Policy defines how employees should report illness, the documentation employers require, how leave is authorized or denied, and how records are retained. It sets eligibility, notification timelines, medical certification requirements, return-to-work procedures, and confidentiality safeguards to protect health information.

Why a Clear Policy Matters for Employers and Staff

A consistent policy reduces disputes, ensures compliance with federal rules, and standardizes recordkeeping. Use clear notices and documented acknowledgments that meet electronic-signature standards such as the ESIGN Act (15 U.S.C. ch. 96, 2000) and applicable UETA provisions.

Why a Clear Policy Matters for Employers and Staff

Core Elements to Include in the Policy

A professional policy organizes eligibility, reporting, documentation, return-to-work steps, privacy, and accommodations so managers and employees apply rules uniformly.

Purpose & Scope

Define who is covered, which absences qualify, and whether the policy applies to full-time, part-time, and temporary staff.

Eligibility

State service time or hours requirements for protected leave (for example, FMLA eligibility standards where applicable).

Notification Rules

Explain how and when employees must report absence, acceptable notice channels, and late-notice procedures.

Medical Documentation

Describe acceptable medical certifications, timelines for submission, confidentiality handling, and verification steps.

Accommodations

Outline the process for ADA accommodation requests, interactive process steps, and decision timelines.

Recordkeeping

Specify retention periods, access controls, and who maintains absence records in HR systems.

Who Uses and Manages This Policy

HR leads and benefits teams typically own the policy, while supervisors and employees interact with it daily to report and approve absences.

  • Human Resources — administer policy, maintain records, coordinate leave benefits and compliance
  • Supervisors — receive notices, approve or escalate absences, and track temporary coverage
  • Employees — report illness, submit required medical documentation, and follow return-to-work steps

Clear role definitions reduce confusion and ensure consistent implementation across locations and business units.

Primary Signatories and Administrators

HR Manager

The HR Manager reviews absence requests, enforces notification rules, approves documentation, coordinates FMLA or disability leave, and ensures record retention and confidentiality in accordance with company policy and applicable law.

Occupational Health Nurse

This clinician may verify medical certifications, recommend return-to-work restrictions, coordinate reasonable accommodations under ADA, and retain clinical records separately and securely when required.

Step-by-Step: Completing an Absence Report

Follow these steps to document and process a sickness absence consistently from employee notice through record retention.

  • 01
Notify: Employee informs supervisor via designated channel with dates and reason.
  • 02
Document: Employee completes the absence form and uploads any medical certification.
  • 03
Review: HR or manager verifies documentation and determines entitlement or need for accommodation.
  • 04
Record: Store signed acknowledgment and related documents in HRIS with restricted access.

Typical Submission and Routing Flow

A standard workflow routes an employee report to the supervisor and HR, captures approvals, and archives records with access controls.

  • Employee Submission: Employee submits form and attachments via HR portal or secure email.
  • Manager Review: Supervisor confirms absence and forwards documents to HR for eligibility check.
  • HR Decision: HR approves, requests more information, or initiates accommodation discussion.
  • Archive: Signed records and audit logs are stored in HRIS with restricted access.

Configuring a Digital Workflow for Absence Requests

Set up fields, notifications, and storage so submissions follow a predictable approval path and generate an audit trail.

Field Configuration
Required Fields Employee name, ID, dates, reason, and signature required
Notifications Auto-notify supervisor and HR on submission and changes
Approvals Two-step approval: supervisor then HR for sensitive cases
Storage Encrypted HRIS folder with role-based access

Digital Tools and Integrations to Support the Policy

Choose platforms that support secure forms, eSign, audit trails, and integrations with HR systems.

  • Integrations: Salesforce, NetSuite, Google Workspace, Microsoft 365
  • File formats: PDF, DOCX, and secure image attachments supported
  • Authentication: Email, SMS code, and SSO options available

Key Timeframes and Notification Deadlines

Specify clear deadlines for employee notice, medical certification, and HR response to reduce ambiguity and compliance risk.

Employee notification:

Report absence as soon as practicable; emergency exceptions allowed

Medical certification due:

Submit certification within 15 calendar days when requested

FMLA eligibility window:

Employee must meet 12 months and 1,250 hours eligibility

HR response time:

HR communicates approval or documentation request within 5 business days

Record retention trigger:

Retention period begins on the date of final action

Processing Milestones for an Absence Claim

Track each milestone from initial notice through final record closure to ensure timely handling and audit readiness.

01

Report Received

Employee notice logged and confirmation sent to manager

02

Documentation Requested

HR requests medical certification if eligibility or duration unclear

03

Decision Issued

HR approves leave, requests more info, or denies with rationale

04

File Closed

Signed acknowledgments archived and retention period recorded

Common Pitfalls to Avoid

  • Incomplete documentation: accepting vague notes without provider details creates verification problems and may delay benefits
  • Inconsistent enforcement: applying different rules by team increases discrimination and disparate treatment risk
  • Poor privacy controls: mixing medical records with general personnel files can violate HIPAA or internal policies
  • Missed deadlines: failing to request or follow up on certification quickly can impair FMLA or accommodation decisions

Legal Risks and Potential Consequences

FMLA Liability: Back pay and damages
ADA Exposure: Failure to accommodate claims
HIPAA Breach: Civil penalties and corrective action
Payroll Errors: Wage disputes and penalties
Recordkeeping Violations: Agency fines or sanctions
Discrimination Claims: Compensatory and legal costs

Security and Compliance Checklist

Encryption in transit: TLS 1.2/1.3
Encryption at rest: AES-256
Audit Trail: Tamper-evident logs
Access Controls: Role-based permissions
HIPAA Considerations: BAA required for PHI
Authentication: SSO and multi-factor options

Operational Components to Put in Place

Operational controls reduce manual work and make administration defensible in audits and disputes.

Required Fields

Capture employee identifiers, dates, reason category, and attachments to enable consistent review and reporting.

Signature & Consent

Record employee acknowledgment; for electronic signatures ensure intent, consent, attribution, and retention per ESIGN.

Manager Review

Define escalation steps for prolonged absences or conflicting medical information.

Integration

Connect with payroll and HRIS to avoid manual entry and reduce errors.

Practical Examples of Policy Use

These examples show how organizations apply the policy to common scenarios to maintain continuity and compliance.

Mid-size Employer Example

HR issues an absence form when an employee reports flu symptoms

  • Manager approves paid sick days for the stated dates
  • HR files the signed form, timestamps medical certification, and records leave balance to avoid payroll errors and preserve an audit trail.

Healthcare Clinic Example

A clinician reports exposure and provides a provider note

  • Occupational health limits duties and documents restrictions
  • Clinic retains the medical note in a secure PHI repository, coordinates accommodation, and logs the case for OSHA where required.
