Purpose

The purpose of this Employee Smoking Policy is to protect the health, safety and comfort of employees, contractors, visitors and customers by establishing standards governing smoking and the use of tobacco and nicotine delivery products on company premises and while conducting company business.

Scope

This policy applies to all employees, temporary workers, contractors, volunteers, interns, and visitors at all company-owned, leased, or controlled facilities and company vehicles. It also applies to any work-related event or activity off premises where employees or representatives are acting on behalf of the company.

Definitions

For purposes of this policy, "smoking" includes inhaling, exhaling, burning or carrying any lighted cigar, cigarette, pipe, or other lighted tobacco product, and using any electronic nicotine delivery system including e-cigarettes, vaporizers, or similar devices regardless of nicotine content.

Policy Statement

Smoking is prohibited inside all company buildings, enclosed structures, restrooms, stairwells, conference rooms, and within the footprint of any doorway, window or air intake. Smoking is also prohibited in company vehicles and in areas designated for clients, patients or the general public unless a specific outdoor designated smoking area is authorized in writing by Human Resources.

Designated Smoking Areas

Where local law permits, the company may establish limited outdoor designated smoking areas. Use of a designated area is a privilege that may be revoked. Designated areas shall be a reasonable distance from building entrances and air intake systems and shall be clearly marked. Employees using designated areas must keep them clean and must not impede pedestrian traffic or create a nuisance.

Electronic Cigarettes and Vaping

Electronic nicotine delivery systems (ENDS), including e-cigarettes, vaporizers, and similar devices, are treated the same as traditional smoking and are prohibited in all non-designated areas described in this policy.

Visitors and Vendors

Visitors, vendors and contractors are required to comply with this policy while on company property. Employees are responsible for informing visitors of this policy and reporting non-compliance to their supervisor or Human Resources.

Compliance and Discipline

Failure to comply with this policy may result in disciplinary action, up to and including written warning, suspension or termination of employment. Supervisors must document observed violations and report them to Human Resources for investigation. Disciplinary measures will be applied consistently and in accordance with applicable laws and company procedures.

Health, Safety and Accommodation

The company recognizes the health risks associated with tobacco use and will consider reasonable accommodation requests from employees with documented medical conditions that require an exception. Such requests must be submitted in writing to Human Resources and will be assessed on an individualized basis in accordance with applicable law.

Reporting Violations

Employees who observe violations of this policy should report them to their immediate supervisor or Human Resources. Reports may be made confidentially and the company prohibits retaliation against any individual who in good faith reports a possible violation.

Signage and Communication

Appropriate "No Smoking" signage will be posted in accordance with local regulations. The company will provide training and periodic reminders to staff regarding this policy and any updates.

Recordkeeping

Records of violation reports, investigations, disciplinary actions and accommodation requests will be maintained in the employee's personnel file in accordance with company record retention practices and applicable law.

What an Employee Smoking Policy Is and when to use it

An Employee Smoking Policy is a written workplace rule that defines where, when, and how tobacco and nicotine products may be used by employees and visitors on company property or during work hours. It typically covers combustible cigarettes, electronic cigarettes and vaping devices, smokeless tobacco, and sometimes marijuana where state law permits. The policy clarifies permitted smoking areas (if any), restrictions on smoking during work time or in company vehicles, procedures for addressing violations, accommodations for medical needs, and how the employer documents employee acknowledgement of the rule.

Why a clear smoking policy protects the workplace

A clear Employee Smoking Policy helps protect employee health, reduce liability from smoke exposure, support regulatory compliance, and set consistent expectations across locations. It minimizes disputes by documenting rules and enforcement steps while preserving accommodations required by law.

Why a clear smoking policy protects the workplace

Who prepares and who should acknowledge the policy

Maintain signed acknowledgements for each employee and keep a copy in the personnel file to document notice and compliance.

  • Human resources teams who draft policy language and manage distribution and recordkeeping for acknowledgements.
  • Supervisors and managers who enforce the policy and document incidents or violations.
  • All employees and contractors who work on-site and must sign or electronically acknowledge receipt and understanding.

Essential elements to include in a professional policy

A complete Employee Smoking Policy should be concise but cover scope, restricted areas, permitted areas (if any), enforcement steps, accommodation procedures, and how employees register acknowledgement. Consistent terminology and an effective date reduce ambiguity and support defensible enforcement.

Scope

Define locations and persons covered, including indoor areas, outdoor workspaces, company vehicles and visitors.

Prohibited Areas

List specific no-smoking zones such as entrances, stairwells, break rooms, company vehicles, and client premises.

Permitted Areas

If allowed, specify designated smoking areas, distance from entries, hours of use, and maintenance responsibilities.

Enforcement

Describe progressive disciplinary steps, reporting procedures, and documentation required for violations.

Accommodations

Explain accommodation process for medical needs or states where nicotine replacement therapy or medical cannabis is regulated.

Acknowledgement

Require employee signature or electronic acknowledgement with date and retention instructions.

Required data elements to record and retain

Employee name: Full legal name
Employee ID: Internal identifier
Job title: Position held
Acknowledgement date: MM/DD/YYYY
Signature type: Handwritten or e-sign
Policy version: Effective date

How to complete and record employee acknowledgements

Follow a short, consistent workflow to issue the policy, collect acknowledgements, and retain records in personnel files or an HR system.

  • 01
Distribute: Provide the policy to employees in writing or electronically.
  • 02
Explain: Hold a brief orientation or post FAQ to clarify rules and consequences.
  • 03
Acknowledge: Collect signed or e-signed acknowledgements and date them.
  • 04
File: Store acknowledgements in the employee record per retention rules.

Configuring an online acknowledgement workflow

Set up a simple electronic workflow to distribute the policy, collect e-signatures, and store acknowledgements in HR systems.

Field Configuration
Delivery method Email distribution or internal portal
Authentication Email link or SMS code
Signature capture Visible e-signature with timestamp
Record storage HRIS or secure document repository

Digital signing and eSubmission considerations

Ensure the platform supports required compliance frameworks (ESIGN/UETA) and retains records in a retrievable, tamper-evident format.

  • File formats: PDF or DOCX
  • Authentication: Email + optional SMS KBA
  • Integrations: HR systems, cloud storage

Where to send signed acknowledgements and final records

Designate a single authoritative repository and a routing path so acknowledgements are consistently stored and accessible to HR and compliance teams.

  • HR file: Store signed form in the employee's personnel file.
  • HRIS import: Upload metadata to HRIS for search and reporting.
  • Compliance archive: Keep immutable copies in a secure archive for audits.
  • Supervisor copy: Provide manager access where appropriate.

Timelines and deadlines to manage policy rollout

Coordinate communication, training, and acknowledgement collection with clear deadlines to ensure organization-wide compliance.

Implementation notice period:

Provide 30 days' advance notice to employees before enforcement begins.

Acknowledgement deadline:

Set a 14–30 day window for employees to sign and return the policy.

Training completion:

Require supervisors to complete policy training within 45 days of rollout.

Incident reporting:

Document and report violations within 7 business days.

Policy review:

Review policy annually or when laws change.

Key rollout milestones for the Employee Smoking Policy

Track milestones from drafting to full enforcement to ensure transparency and legal defensibility.

01

Draft policy

Create initial draft with HR and legal input, outlining scope and enforcement.

02

Management approval

Obtain sign-off from senior HR and legal leadership prior to distribution.

03

Employee notice

Announce the policy and provide the acknowledgement form to all employees.

04

Enforcement active

Begin consistent enforcement after the notice period ends.

Common pitfalls to avoid when preparing the policy

  • Vague geographic terms like 'on-site' without definition, causing inconsistent enforcement across locations and disputes.
  • Failing to address electronic smoking devices and smokeless tobacco, which leaves gray areas in enforcement.
  • Not documenting employee acknowledgements or failing to retain signatures, which weakens legal defensibility.
  • Neglecting to coordinate with local ordinances, resulting in conflicts between company rules and municipal smoking bans.

Risks of an incomplete or misapplied smoking policy

Workplace exposure: Increased complaints or potential OSHA attention
HIPAA risk: Sensitive health information mishandling
Employment claims: Discrimination or wrongful discipline allegations
Regulatory fines: Violations of local smoke-free laws
Reputational harm: Public complaints and employee disengagement
Recordkeeping gaps: Inability to prove notice and enforcement

How real organizations apply smoking policies

These concise scenarios illustrate typical policy choices and operational consequences.

Case Study 1

A regional healthcare clinic adopted a campus-wide tobacco-free policy with no-designated-smoke areas

  • The clinic required signed employee acknowledgements within 30 days
  • Result: simplified enforcement, fewer patient complaints, and documented compliance for accreditation reviews.

Case Study 2

A construction firm restricted smoking within 50 feet of all jobsite entry points

  • Supervisors issued progressive discipline for violations
  • The firm reduced fire hazard incidents and clarified subcontractor responsibilities in contracts.
