What an Employee SST Letter Is and when it’s used

An Employee SST Letter documents an employee’s entitlement to Supplemental Sick Time (SST), the amount of leave granted or used, pay treatment, and any employer conditions for taking the leave. Employers commonly issue this letter when an employee requests SST, when leave is approved or denied, or when payroll needs a formal record. The letter names the employee, effective dates or range, hours or days approved, pay rate or replacement pay, and any verification required. Electronic signatures are acceptable under U.S. e-signature law when proper consent and retention practices are followed.

Why a clear SST Letter matters for compliance and payroll

A formal Employee SST Letter creates a documented record that supports payroll accuracy, leave auditing, and compliance with local leave ordinances. Under the ESIGN Act (15 U.S.C. ch. 96) and UETA, electronically signed SST letters are generally enforceable when intent, consent, attribution, and retention are demonstrable.

Why a clear SST Letter matters for compliance and payroll

Who prepares and relies on an SST Letter

Maintain a copy in the employee file and provide the employee a signed copy; retain according to applicable recordkeeping rules.

  • HR administrators and leave coordinators who record eligibility, maintain compliance, and manage documentation
  • Payroll staff who require accurate hours and pay-rate instructions to process leave payments correctly
  • Employees and managers who use the letter as proof of approved leave and a reference for return-to-work conditions

Essential parts of a professional Employee SST Letter

A professional SST Letter is concise, factual, and includes clear identification, leave specifics, pay treatment, verification requirements, and signature lines; it should also note whether it was signed electronically.

Header

Employer name, address, contact person, and date. Include department and a short subject line like 'Supplemental Sick Time Approval' for quick reference and file indexing.

Employee Details

Full legal name, job title, employee ID, and work location. Accurate identity prevents payroll and tax mismatches and supports later audits or inquiries.

Leave Type

Specify 'Supplemental Sick Time' and cite the governing policy or ordinance. Clarify whether leave is paid, unpaid, or partially paid and any conditions for use.

Amount Approved

State hours or days approved, how they are calculated, and whether there are carryover or cap limitations; include effective start and end dates if applicable.

Pay Treatment

Specify pay rate or replacement pay, whether benefits continue, and any coordination with other leave (e.g., PTO, FMLA, disability).

Signature Block

Designated signer name and title, signature and date fields, and a note if the document may be signed electronically under ESIGN/UETA.

Step-by-step: issuing an Employee SST Letter

Follow a consistent workflow to approve, document, and distribute SST Letters so payroll and personnel files stay synchronized.

  • 01
Receive Request: Manager or employee submits leave request with supporting info.
  • 02
Verify Eligibility: HR confirms policy or ordinance entitlement and any required documentation.
  • 03
Prepare Letter: Complete template fields and confirm pay treatment with payroll.
  • 04
Sign and Distribute: Obtain signature and deliver copies to employee and payroll; file the original.

Typical digital workflow for SST Letters

A digital SST workflow reduces manual handling while preserving auditability; include signer authentication and record retention steps.

  • Upload Template: Load the SST Letter template into the e-sign platform.

  • Send to Signer: Deliver via secure email link or authenticated portal.
  • Store Audit Trail: Capture timestamp, IP, and authentication method for records.

Key workflow settings for electronic SST Letters

Configure the e-sign workflow to match your approval chain, signer authentication level, and retention needs before sending letters.

Field Configuration
Signer Order Sequential or parallel routing per company policy
Authentication Email link, SMS code, or stronger ID verification
Conditional Fields Show pay fields only when paid leave selected
Retention Automatic archival and export for HR records

Technical considerations for eSigning SST Letters

Confirm the platform meets legal, privacy, and IT requirements, including any needed Business Associate Agreement for health data.

  • File Formats: PDF and DOCX supported
  • Integrations: Connects with HRIS and payroll
  • Security: TLS and AES-256 encryption

Timing, deadlines, and payroll loops to watch

Timely issuance and submission of SST Letters ensures correct payroll treatment and reduces later reconciliation work.

Employee Notice Deadline:

Follow employer or ordinance notice rules when leave is requested

Payroll Cutoff:

Submit approvals before payroll cutoff to ensure inclusion

Record Retention Start:

Retention begins on the letter date or pay event

Reconciliation Window:

Allow one pay cycle to reconcile gross-to-net adjustments

Dispute Response:

Respond to employee disputes promptly per policy

Common preparation pitfalls to avoid

  • Incomplete employee identifiers that lead to mismatched payroll records and delayed payments
  • Vague descriptions of pay treatment causing disputes over replacement pay or PTO coordination
  • Failure to retain an audit trail for electronic signatures, weakening proof of authorization
  • Not aligning the letter’s dates with payroll cycles, resulting in missed or double payments

Risks and consequences of incorrect SST Letters

Wage claims: Potential unpaid wage disputes or back pay
Regulatory fines: Local ordinance penalties or administrative sanctions
Privacy breach: Exposure of health details without safeguards
Tax errors: Incorrect withholding or reporting outcomes
Recordkeeping failures: Missing documentation for audits
Operational delays: Payroll reconciliation and litigation costs
