Position Information

Policy Statement and Scope

The company maintains a drug- and alcohol-free workplace. This policy applies to all employees, contractors, temporary workers, and applicants while on company premises, during company business, and while operating company vehicles or equipment. Prohibited substances include illegal drugs, controlled substances without a valid prescription, alcohol while on duty, and the misuse of prescription medications. Employees must disclose prescribed medications that could impair job performance or safety in the Health Disclosure section below.

Prohibited Conduct

The following conduct is prohibited: reporting to work under the influence of alcohol or prohibited drugs; possession, distribution, sale, or transfer of illegal drugs or alcohol on company property; refusal to submit to testing as required by this policy; and engaging in conduct that impairs safety or productivity. Violations will result in discipline up to and including immediate termination.

Testing Procedures

Testing may be conducted under the following circumstances. Select all types authorized under this policy:

Testing will be performed by an authorized health services provider using accepted collection and chain-of-custody procedures. Positive results may be confirmed by a secondary laboratory test and employees may request the confirmation test on the split specimen. Refusal to consent to or obstruct a required test will be treated as a policy violation and may lead to termination.

Employee Health Disclosure

To enable appropriate evaluation for safety and reasonable accommodation, identify any prescription medication that you are currently taking that may impair your ability to perform job duties safely. Disclosure is voluntary but failure to disclose a medication that later contributes to impairment may affect disciplinary determinations.

Consequences, Discipline and Return-to-Duty

Confirmed violations of this policy may result in disciplinary action, including suspension, mandatory rehabilitation programs, loss of safety-sensitive duties, or termination. Return-to-duty after a positive test requires a negative confirmation test, clearance by a substance abuse professional where applicable, and may include follow-up testing for a period determined by the company.

Confidentiality and Records

Test results and medical information will be handled as confidential medical records in accordance with applicable law. Information will be disclosed only to individuals with a legitimate need to know for safety, administrative, or legal purposes.

What the Employee Substance Policy Form Is and When It Applies

The Employee Substance Policy Form documents an employer's rules on alcohol, drugs, and controlled substances in the workplace, employee acknowledgements, testing consent where applicable, and disciplinary steps for violations. It typically records covered activities (on-duty, off-duty conduct where it affects safety), testing types (pre-employment, reasonable suspicion, post-incident, random), and acknowledgement of receipt. Organizations use this form to create a consistent record that employees have read, understood, and accepted policy terms and testing procedures.

Why a Formal Policy Form Matters for Employers

A clear, signed Employee Substance Policy Form reduces legal risk, supports consistent enforcement, and documents employee consent to testing or remedial programs. It helps employers meet regulatory expectations for safety-sensitive roles and provides evidence of notice if disciplinary action becomes necessary.

Audit Failures: Incomplete records may fail internal or external audits

Common mistakes to avoid when preparing the form

  • Using outdated policy text or mix-and-matching clauses that contradict each other creates ambiguity and enforcement problems.
  • Failing to obtain explicit consent or missing an ESIGN consumer disclosure where legally required risks invalidate electronic consent.
  • Not tailoring the form for safety-sensitive roles or failing to document role changes that trigger testing eligibility.
  • Storing signed forms insecurely or without retention tags, which complicates retrieval for audits or legal proceedings.

Practical tips for accurate and efficient completion

Adopt consistent practices to reduce errors, speed processing, and strengthen legal defensibility of the policy.

Centralize policy versions
Maintain a single source of truth for the Employee Substance Policy Form and record version numbers and effective dates to avoid distributing superseded copies during hiring or role changes.
Use clear consent language
Draft consent and testing consent in plain English, explain consequences, and include an ESIGN consumer disclosure when obtaining electronic consent for consumer-facing or healthcare-adjacent programs.
Integrate with HR systems
Automate distribution and retention via HRIS so acknowledgements, role changes, and retention metadata populate personnel records without manual intervention.
Balance privacy and access
Limit access to test results and medical data to authorized staff, log access events, and document who may view or act on results to meet HIPAA and employment-law expectations.
