Testing Authorization & Consent

I hereby authorize Employer and its authorized representatives, medical review officers, laboratories, specimen collectors, licensed health care providers and testing facilities to collect biological specimens and to perform tests as indicated below. I understand that test results will be used for employment-related decisions, including discipline or termination where allowed by company policy and applicable law.

I authorize release of test results and related medical information to Employer and its designated representatives for the purposes described above. I understand that test data will be treated as confidential medical information but may be disclosed to supervisory personnel, designated safety or human resources staff, insurers, or as required by law or regulation.

I understand that refusal to submit to testing, failure to provide a specimen as instructed, adulteration or substitution of a specimen, or a confirmed positive result may result in employment actions up to and including termination, in accordance with employer policy and applicable law. Such actions may be taken independent of any criminal or civil proceedings.

Authorization to Obtain/Release Records

I hereby authorize any health care provider, previous employer, laboratory, and testing facility to release to the Employer any records or information relating to prior drug/alcohol testing, treatment for substance use or incidental medical records necessary to interpret test results. This release includes records retained by third parties and applies to information created prior to and after the date of this authorization for the duration indicated below.

Legal Disclosures and Statements

At-Will Employment: I understand that, unless otherwise agreed in a written contract signed by an authorized company representative, my employment is at-will, which means the Employer may terminate employment at any time for any lawful reason and I may resign at any time.

Equal Opportunity: The Employer is an equal opportunity employer. Decisions regarding testing, discipline, hiring, promotion, or termination are made without unlawful discrimination and in accordance with company policy and applicable law.

Authorization to Contact Prior Employers and Background Checks

By checking the box below and signing this form, I authorize the Employer to contact my previous employers and references, and to conduct background checks (including criminal history checks) to the extent permitted by law and as reasonably related to my position.

Employee Certification and Release

I certify that all information provided on this form is true and complete. I voluntarily consent to the testing and authorizations described above. I release and hold harmless the Employer, its officers, employees, agents, laboratories, medical review officers, and testing facilities from any claims, demands, liabilities, losses or damages arising from the collection, testing, reporting, or use of test results, except to the extent such claims arise from willful misconduct or gross negligence.

Additional Acknowledgments

I acknowledge that I have had the opportunity to ask questions about the testing process and consequences, and that I will follow any specimen collection instructions. I understand that this authorization remains effective until the date specified in the Duration of Authorization above or until revoked in writing; however, revocation will not apply to tests or disclosures already performed.

What the Employee Testing Release Is

An Employee Testing Release is a written consent and release form used by employers to document an employee's authorization for workplace testing and the employee's agreement to release the employer and testing provider from specified claims arising from the test. Typical uses include infectious disease screening, drug and alcohol testing, and occupational exposure testing. The form clarifies test purpose, data handling and sharing, timeframes, and limited liability terms. Properly completed releases help employers meet internal safety policies while preserving employee privacy and traceability of consent.

Why a Clear Testing Release Matters

A well-constructed Employee Testing Release documents informed consent, sets expectations on data use and result disclosure, and reduces litigation risk by obtaining express employee authorization. It supports compliance with workplace health policies and establishes a clear record for HR and occupational health teams.

Why a Clear Testing Release Matters

Who Typically Prepares and Signs This Release

Employers, occupational health providers, HR teams, and testing vendors commonly prepare or request an Employee Testing Release before administering workplace tests.

  • Human resources teams that manage employee health programs and policy enforcement.
  • Occupational health or third-party testing providers collecting samples and reporting results.
  • Supervisors or safety officers coordinating site testing during outbreaks or incidents.

Use depends on workplace risk profile, regulatory environment, and whether testing is routine, incident-driven, pre-employment, or required by public health guidance.

Key Signatory Roles

HR Manager

Human resources professionals typically review and approve the release language, ensure alignment with company policy, and retain executed releases as part of the employee file. They coordinate any required privacy notices and determine where records are stored.

Testing Provider

Third-party occupational health vendors use the release to document patient consent, inform the testing procedure, and control downstream data sharing with the employer or public health authorities under existing privacy rules.

Essential Elements to Include in the Release

A complete Employee Testing Release should be concise yet comprehensive, covering consent, data handling, liability limits, and signatory details to ensure enforceability.

Identification

Full legal name and employee ID to clearly link the release to a specific individual and employment record for auditability.

Test Description

A brief statement of the test type, purpose, and sample type so the signer knows what is authorized and why it is being performed.

Consent Scope

Explicit authorization for specimen collection, laboratory analysis, and result disclosure to specified parties, with any limits clearly stated.

Privacy Notice

How results and personal data will be used, stored, and shared, including references to applicable privacy protections for health data.

Release Language

Narrowly tailored indemnity or release clauses addressing claims related to testing, medical treatment, or result disclosure.

Signature Block

Typed or handwritten signature, printed name, date, and witness or notary fields if state law or employer policy requires authentication.

Step-by-Step: Filling Out the Release

Follow these steps in order to create a complete and legally sound Employee Testing Release.

  • 01
Prepare form: Use employer template with required fields.
  • 02
Enter identity: Add full name and employee ID.
  • 03
Specify test: Describe test type and purpose.
  • 04
Sign and store: Sign, date, and retain under retention policy.

How eSubmission and Signing Typically Work

A digital workflow streamlines collection, authentication, signature, and secure storage while capturing an audit trail for compliance.

  • Upload Document: Sender uploads signed template to eSignature platform.
  • Place Fields: Signer name, date, and signature fields are positioned.
  • Invite Signer: Email or secure link is sent to the employee.
  • Capture Audit: Platform logs timestamp, IP, and authentication method.

Typical Online Form Settings for Employee Testing Releases

Common workflow settings help ensure consent is captured securely and stored for audits.

Field Configuration
Signer Authentication Email link or SMS code; KBA if required
Required Fields Name, date, test type, data sharing
Audit Trail Settings Enable IP, timestamp, and version history
Retention Tagging Apply HR retention label on completion

Technical and Platform Considerations for eSubmission

Choose a platform that supports required authentication, secure storage, and the file formats used by your HR systems.

  • File Formats: PDF and DOCX are standard and retain field placement
  • Integrations: Connectors to HRIS, cloud storage, and EHR ease routing
  • Security: TLS in transit, AES-256 at rest, and audit trails

Ensure the chosen solution can export signed records, attach audit certificates, and integrate with your retention and incident response processes.

Security and Compliance Items to Document

Encryption: TLS 1.2/1.3 in transit; AES-256 at rest
Audit Trail: Timestamp, IP, and signer actions logged
Access Controls: Role-based permissions for HR and health staff
BAA Availability: Business associate agreement required for HIPAA
Standards: SOC 2 Type II and ISO 27001 supported
Accessibility: WCAG 2.0 Level AA compatibility

Penalties and Legal Risks of Improper Releases

I-9 Documentation: Failure to retain I-9s risks fines between $281 and $2,789
Tax Withholding: Incorrect TINs can trigger 24% backup withholding
Information Returns: Late or incorrect filings may incur per-form penalties
HIPAA Violations: Improper PHI handling can result in civil penalties
Privacy Litigation: Insufficient notices increase class-action exposure
Contract Risk: Overbroad releases may be unenforceable under state law

Common Preparation Errors to Avoid

  • Using vague release language that fails to specify test type, sample, or data recipients leads to disputes and invalid consent.
  • Failing to match signer name with employment records can prevent proper retention and cause audit failures.
  • Omitting required privacy disclosures for health data can violate HIPAA or other privacy rules and trigger enforcement.
  • Neglecting to secure or timestamp electronic signatures leaves the document open to repudiation in later disputes.

Timing and Deadlines to Know

Certain administrative and reporting timelines affect when releases should be issued, signed, and retained.

Provide On Request:

Employee releases are often furnished at or before testing; provide upon request immediately

I-9 Retention Window:

Retain employment verification records per regulatory retention rules

Payroll Accounting:
