Policy Scope, Purpose, and Definitions

This Employee Vehicle Policy Handbook governs the use of company-owned vehicles and the operation of personal vehicles on behalf of the company. It applies to all employees authorized to drive on company business and to employees assigned a company vehicle.

Definitions: "Company vehicle" means any motor vehicle owned, leased, or rented by the company. "Authorized driver" means an employee who has been approved in writing to operate a company vehicle or to use a personal vehicle for business purposes.

Driver Qualifications and Authorization

To be authorized to drive on company business, an employee must possess a valid driver's license, maintain acceptable driving record standards as determined by the company, complete required training, and comply with all policy requirements. Lack of authorization or suspension of driving privileges will result in termination of driving duties and may lead to discipline up to and including termination of employment.

I attest that my driving record contains no mandatory disqualifying offenses (as described below). I understand the company will periodically review my motor vehicle record and may obtain reports from motor vehicle agencies. By initialing, I authorize the company to obtain my driving record.   Initials:

Consent to MVR check: I authorize the company to obtain motor vehicle records and related driving history information as necessary for determining my eligibility to drive on company business.

Vehicle Use, Safety and Prohibited Conduct

Employees must comply with all traffic laws and exercise prudent driving practices. Prohibited conduct includes driving under the influence of alcohol or drugs, consuming alcohol while operating a vehicle, reckless driving, operating any vehicle without required insurance coverage, and use of handheld mobile devices while driving unless hands-free operation is used in full compliance with applicable law.

Seat belts must be worn by all occupants at all times. The employee is responsible for securing and properly maintaining cargo and for ensuring passengers observe all safety requirements.

Accident Reporting and Investigation

In the event of a collision, employees must secure safety, notify emergency services if necessary, preserve evidence to the extent safe and lawful, exchange requisite information with other parties, and notify their supervisor and the company Risk Manager immediately. Failure to report an accident promptly may result in disciplinary action.

Insurance, Liability and Reimbursement

Company vehicles are insured under company policies for authorized business use. Employees operating personal vehicles for business must maintain liability insurance at or above minimum company requirements and must provide proof of insurance upon request. The company is not responsible for personal vehicle maintenance or fines resulting from personal use.

Drug, Alcohol and Medical Fitness

The company maintains a strict policy prohibiting impairment while operating vehicles. Employees must notify the company of any medical condition or medication that could impair safe driving. The company reserves the right to require drug and alcohol testing and medical fitness evaluations where permitted by law.

I consent to testing: I acknowledge that the company may require drug or alcohol testing associated with driving duties as permitted by policy and law.

Maintenance, Inspections and Equipment

Company vehicles must be maintained per manufacturer recommendations. Employees using personal vehicles for business must ensure tires, brakes, lights and other safety systems are in safe operating condition. Periodic inspections may be required. Any safety defect must be reported immediately.

Disciplinary Action

Violations of this policy may result in removal of driving privileges, mandatory retraining, disciplinary action up to and including termination, and restitution for losses caused by negligent operation. Repeated violations or serious offenses will be grounds for immediate termination of driving privileges and potential termination of employment.

Traffic citations, parking tickets and fines are the responsibility of the driver. The company may impose additional disciplinary measures where violations adversely affect company operations or insurance.

Legal Notices and Disclosures

At-Will Employment: Nothing in this handbook alters the at-will nature of employment. Either the employee or the company may terminate the employment relationship at any time, with or without cause or notice, unless otherwise agreed in a separate written contract signed by an authorized officer.

Equal Employment Opportunity: The company is an equal opportunity employer and does not discriminate on the basis of race, color, religion, sex, national origin, age, disability, or any other status protected by applicable law.

Authorizations, Certifications and Applicant-type Declarations

Applicant/Employee Certification: I certify that all information supplied on this form is true and complete to the best of my knowledge. I understand that false statements or omissions are grounds for disciplinary action, which may include termination.

Authorization to Contact Previous Employers and Conduct Background Checks: I authorize the company and its agents to contact my previous employers and references and to obtain background information, including criminal history and motor vehicle records, as reasonably required for determining my eligibility to drive or operate a company vehicle. I release the company from liability for seeking such information and for any actions taken based on the information obtained.

What the Employee Vehicle Policy Handbook Covers

The Employee Vehicle Policy Handbook is a centralized document that defines employer expectations, permitted vehicle use, insurance and registration requirements, safety practices, reimbursement rules, and disciplinary consequences related to employees operating personal or company vehicles for work. It standardizes fleet and driving-related procedures across departments, clarifies liability allocation, and provides forms and acknowledgments for employee signatures. The handbook supports risk management by documenting required evidence (registration, insurance, driving record checks) and outlining incident reporting and post-accident processes to ensure consistent handling of claims and compliance with company and regulatory obligations.

Why a Formal Handbook Matters

A written handbook reduces legal ambiguity, documents safety and insurance requirements, and creates consistent enforcement for vehicle use policies across the organization.

Why a Formal Handbook Matters

Who Prepares and Relies on the Handbook

Employers, HR professionals, fleet managers, and legal teams typically prepare and maintain the handbook; employees and managers rely on it daily.

  • Human Resources teams overseeing policy distribution and employee acknowledgments.
  • Fleet or operations managers tracking registrations, inspections, and vehicle compliance.
  • Legal or risk management staff advising on liabilities and insurance requirements.

Use the handbook to unify responsibilities, simplify onboarding, and create an auditable record of employee acknowledgment and training.

Core Sections to Include in an Employee Vehicle Policy Handbook

A practical handbook contains concise, actionable sections. Each item below represents a standard module that supports compliance, risk control, and operational clarity for employees driving on behalf of the company.

Scope

Define covered drivers, vehicle types (personal vs. company), permitted trips, and when the policy applies to remote work or travel.

Insurance Requirements

Specify minimum liability and comprehensive coverage, required proof (declarations page), and procedures for policy lapses or changes.

Driver Qualifications

Detail driver's license class, acceptable driving record criteria, periodic MVR checks, and disqualification thresholds for safety-sensitive roles.

Vehicle Condition

Require regular inspections, maintenance records, safety equipment, and prohibited mechanical conditions that would prevent work use.

Accident Reporting

Provide step-by-step post-accident actions, required documentation, internal reporting timelines, and contact details for claims reporting.

Reimbursements

Outline mileage rates, allowable expenses, documentation needed, payment timing, and tax treatment of reimbursements.

Step-by-Step: How to Complete the Handbook Acknowledgment

Follow these steps to onboard a driver and record required vehicle documentation.

  • 01
Collect Documents: Gather license, registration, and proof of insurance copies.
  • 02
Verify Eligibility: Run or request an MVR check per policy frequency.
  • 03
Complete Form: Enter fields, sign, and date the acknowledgment form.
  • 04
Store Record: Upload signed form and documents to secure HR or fleet folder.

How the Vehicle Policy Is Administered

This workflow shows typical routing from employee submission through verification to final retention.

  • Employee Submission: Employee completes and signs the vehicle form.
  • Manager Review: Manager checks entries and attachments for completeness.
  • Compliance Check: HR or fleet runs MVR and insurance verification.
  • Record Retention: Files are archived per retention schedule and accessible for audits.

Transport: TLS 1.2/1.3 in transit
Certifications: SOC 2 Type II, ISO 27001
HIPAA: BAA required for PHI
eSign Laws: ESIGN and UETA compliant
Audit Trail: Timestamps and signer IP

Key Risks and Legal Consequences of Noncompliance

I-9 Penalties: $281–$2,789 per violation
Incorrect Tax Reporting: 1099 penalties $60–$330 per form
Intentional Disregard: $660+ per form
Insurance Lapse: Increased employer liability
Unenforceable Reimbursement: Claims disputes possible
Data Breach Fines: State and federal penalties

Common Preparation Mistakes to Avoid

  • Incomplete driver data: missing license numbers or expiration dates delays MVR checks and may leave the employer exposed.
  • Vague reimbursement rules: unclear mileage rates or undocumented expenses lead to disputes and inconsistent payroll treatment.
  • Insufficient verification cadence: failure to recheck MVRs after incidents increases undetected risk for repeat offenses.
  • Poor record retention: disposing of records before statutory retention periods can hinder defense against future claims.

Real-World Scenarios Illustrating Policy Use

These example scenarios show practical ways organizations apply the handbook to reduce risk and streamline administrative tasks.

Property Management Firm

A mid-size firm required up-to-date insurance declarations for vendors

  • Conducted quarterly MVR checks
  • As a result, the firm reduced claim disputes and standardized vendor onboarding documentation across five regional offices, improving audit readiness.

Healthcare Clinic

A clinic required HIPAA-aware transport rules for patient transfers

  • Implemented signed vehicle acknowledgments with HIPAA addenda
  • This clarified staff responsibilities, ensured coverage verification, and aligned records retention with 45 CFR §164.530(j).
