Workplace Violence Policy Summary and Acknowledgement

Definitions: Workplace violence includes, but is not limited to, physical assault, threats of violence, harassment, intimidation, stalking, or any conduct that a reasonable person would interpret as a threat of bodily harm. Violence may occur on Employer premises, during work-related travel, or at work-related social events.

Prohibited Conduct: Employees are prohibited from engaging in violent or threatening behavior, possessing weapons on Employer premises or in Employer vehicles, or making verbal or written threats. Retaliatory actions against individuals who report incidents in good faith are strictly prohibited.

Reporting: Employees must immediately report incidents, threats, or suspicious behavior to their supervisor, security, or human resources. Reports may be made orally or in writing and will be handled promptly. If an immediate danger exists, employees must contact emergency services before notifying Employer management.

Investigation and Discipline: The Employer will investigate reported incidents in a timely manner. Investigations may include interviews, review of documents, and inspection of workplace areas. Employees are required to cooperate fully. Confirmed violations of policy may result in corrective action up to and including termination, civil remedies, and criminal prosecution where appropriate.

Confidentiality: To the extent practicable, the Employer will protect the confidentiality of reports. However, confidentiality cannot be guaranteed where disclosure is necessary to investigate, resolve, or take corrective action.

Weapons and Searches: Possession of weapons on Employer premises or while performing work for the Employer is strictly prohibited unless expressly authorized for business use. The Employer reserves the right to conduct lawful inspections of personal property, lockers, or company property when there is reasonable suspicion of policy violation.

Emergency Response: Employees must follow emergency procedures as instructed by Employer or emergency responders. Employees should prioritize safety and notify appropriate authorities in immediate-threat situations.

Legal Disclosures

At-Will Employment: Nothing in this policy or in this acknowledgement modifies the at-will nature of employment, unless a written agreement signed by an authorized company representative expressly states otherwise. Either the Employer or the employee may terminate the employment relationship at any time, for any lawful reason.

Equal Opportunity: The Employer is committed to equal employment opportunity and will not tolerate discrimination or harassment on the basis of any protected characteristic. Reports of discriminatory or harassing conduct will be investigated and addressed in accordance with Employer policies.

What the Employee Violence Acknowledgement Is

The Employee Violence Acknowledgement is a written record that confirms an employee has received, read, and understood an employer's workplace violence policy, reporting procedures, and related safety protocols. It documents awareness of prohibited conduct, required reporting channels, and potential disciplinary consequences. Employers use the form to standardize communication, support incident response, and maintain personnel files. The acknowledgement can be completed on paper or electronically where ESIGN and relevant state laws permit, and it should be retained according to document retention policies and applicable regulations.

Common Risks and Consequences of Poor Documentation

Policy Noncompliance: Discipline up to termination
Recordkeeping Failure: Regulatory penalties possible
Investigation Delay: Slower incident response
Privacy Breach: Potential HIPAA or state fines
Retaliation Claims: Increased legal exposure
Lost Evidence: Weakened defensibility in disputes

Practical Tips for Accurate and Efficient Completion

Adopt consistent practices to minimize errors and preserve evidentiary value while making it simple for employees to comply.

Maintain version control
Label policy versions clearly, retain change logs, and require a new acknowledgement when material policy changes occur to avoid disputes over which rules applied.
Provide training with the form
Deliver brief, role-specific training when distributing the acknowledgement so employees understand reporting steps, confidentiality limits, and how to request support.
Use electronic audit trails
Capture signer identity, timestamps, and IP addresses. An audit trail preserves intent and attribution, which is critical if an incident is contested.
Centralize storage and access
Store signed acknowledgements in a secure HR system with role-based access and automated retention to meet legal and organizational requirements.

Industry Examples of How the Acknowledgement Is Used

Representative scenarios show how different organizations use the acknowledgement to support safety programs and compliance.

Healthcare Clinic Example

A community clinic issues acknowledgements during orientation to all clinical staff to document policy receipt.

  • The acknowledgement links to reporting contacts and escalation steps.
  • Maintaining dated acknowledgements helped the clinic demonstrate staff notice and training during an OSHA inquiry and streamlined follow-up for affected patients and providers.

Manufacturing Site Example

A manufacturing employer circulates the acknowledgement after a site-wide safety update requiring new access controls.

  • Supervisors collect signed copies and upload them.
  • Having centralized, timestamped electronic acknowledgements enabled prompt discipline where needed and supported a coordinated safety audit across multiple shifts.
