What an Employee Visa Transfer Agreement Covers

An Employee Visa Transfer Agreement documents the responsibilities and terms when an employer and employee coordinate changes related to the employee's immigration sponsorship, work location, or employer-of-record. It typically identifies the parties, describes which employer will file or support immigration petitions, allocates costs and reimbursements, sets start and end dates, confirms compliance obligations for I-9 and payroll, and records confidentiality or assignment clauses tied to employment. The agreement helps create a clear record for HR, legal, and immigration counsel while supporting electronic execution and secure retention for compliance purposes.

Why a Clear Transfer Agreement Matters

A written agreement reduces ambiguity about who handles USCIS filings, fees, and ongoing compliance. It protects the employee and employers by documenting responsibilities and timelines and helps avoid immigration or payroll disputes.

Why a Clear Transfer Agreement Matters

Who Typically Completes This Agreement

Common signers include the transferring employee, the releasing employer, and the receiving employer; HR and immigration counsel usually review the final text.

  • Transferring employee — Confirms start date, immigration support, and cost sharing
  • Releasing employer — Documents obligations to end employment and transfer records
  • Receiving employer — Agrees to file petitions, comply with wage terms, and retain I-9

Legal and HR teams should coordinate before execution to confirm immigration filings, payroll timing, and any required employee authorizations.

Essential Clauses to Include

A professional Employee Visa Transfer Agreement contains specialized clauses that address immigration support, cost allocation, reporting duties, and contingency planning in case petitions are delayed or denied.

Parties

Full legal names and entity types for all signatories, plus the employee's legal name and immigration status to ensure exact identification and avoid mismatch.

Immigration Responsibilities

Specify which employer will prepare and file USCIS forms, who pays filing and legal fees, and whether premium processing will be requested to speed adjudication.

Timing and Effective Date

State the effective transfer date, any conditional start dates tied to USCIS approvals, and obligations if adjudication is delayed or denied.

Compensation and Benefits

Document wage rate, benefits continuation or transition, and payroll responsibilities during the transfer and any reimbursement arrangements for relocation or legal costs.

Compliance and Recordkeeping

Assign responsibility for completing and retaining I-9s, maintaining immigration-related records, and cooperating with audits or future employer inquiries.

Termination Contingencies

Define what happens if the petition is denied, including notice requirements, return of documents, financial liabilities, and any severance or assistance commitments.

Common Preparation Pitfalls to Avoid

  • Using inconsistent party names or abbreviations that do not exactly match government IDs, which can delay immigration filings and verification checks.
  • Leaving effective dates conditional without clear fallback rules, creating payroll and benefits timing disputes between employers.
  • Failing to allocate fees or reimbursements explicitly, which can lead to unexpected deductions or contested invoices.
  • Not preserving a tamper-evident signed copy and audit trail, making later verification or legal proof more difficult.
