Legal Disclosures & Consent

At-Will Employment: I acknowledge that my participation in a volunteer program does not alter the at-will nature of my employment and that either I or the employer may terminate employment at any time, with or without cause or notice.

Equal Opportunity: The employer provides volunteer opportunities without regard to race, color, religion, sex, national origin, age, disability, or other protected characteristic in accordance with applicable law.

Authorization to Contact and Background Checks: I authorize the employer and its agents to contact my references and prior employers for verification of employment and character, and to obtain background checks as required for participation. I consent to such inquiries and to the release of information to the employer for this purpose.

Waiver, Release and Assumption of Risk

I acknowledge that participation in volunteer activities may involve inherent risks, including but not limited to physical injury, illness, property damage, transportation risks, and other hazards. In consideration of being permitted to participate, I expressly assume all such risks and agree as follows:

1. I, on behalf of myself, my heirs, executors, administrators and assigns, hereby release, waive, discharge and covenant not to sue the employer, its parent, subsidiaries, affiliates, directors, officers, employees, volunteers and agents (collectively, Released Parties) from any and all liability, claims, demands, actions or causes of action whatsoever for any loss, damage or injury (including death) arising out of or related to my participation, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.

2. I agree to indemnify, defend and hold harmless the Released Parties from and against any claims, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising from my acts or omissions during volunteer activities.

3. I agree to follow all safety instructions, policies and rules provided by the employer and host organization, and to immediately notify a supervisor of any unsafe condition or injury.

Medical Treatment Authorization

In the event of illness or injury, I authorize the employer to secure emergency medical treatment, including transportation and necessary medical care. I understand I am responsible for all costs of medical treatment and that the employer is not obligated to provide or pay for medical services or insurance.

Photo and Media Release

I grant the employer permission to record, photograph and use my likeness in any medium for promotional, educational, or informational purposes without compensation. I understand that such materials are the property of the employer.

Transportation & Conduct

If I choose to provide or accept transportation in connection with volunteer activities, I do so at my own risk. I agree to comply with all applicable laws while traveling and to maintain appropriate insurance for any vehicle I operate.

Confidentiality and Compliance

I agree to protect confidential information encountered during volunteer activities and to comply with all applicable employer policies and laws. I understand that unauthorized disclosure of confidential information may result in disciplinary action, up to and including termination of employment.

Applicant Certification

I certify that all information provided on this form is true and complete to the best of my knowledge. I understand that false statements may disqualify me from participating or may result in disciplinary action. I acknowledge that this waiver is binding and will apply to any claims arising from my voluntary participation unless otherwise prohibited by law.

What the Employee Volunteer Waiver Form Is

An Employee Volunteer Waiver Form documents an employee’s voluntary participation in a company-sponsored or company-supported activity and records informed acceptance of risks, release or limitation of liability, medical information, and emergency contact details. It clarifies the scope of the activity, any equipment or training requirements, and any photo or media release. The form helps employers document consent, manage exposures, and provide required disclosures when third parties or insured activities are involved. Properly completed waivers support operational and risk-management processes while preserving evidence of participant acknowledgement.

Why Use a Formal Waiver for Employee Volunteer Activities

A clear, signed waiver reduces ambiguity about assumed risks, documents employee consent, and supports incident response and insurance claims. It also records health or accommodation needs and assigns responsibility for safety protocols during the volunteer activity.

Why Use a Formal Waiver for Employee Volunteer Activities

Who Typically Completes and Approves This Waiver

Employers, HR teams, program coordinators, and participating employees commonly use this form to confirm voluntary participation and record essential details.

  • HR administrators and benefits teams who manage corporate volunteer programs and incident documentation.
  • Supervisors or program leads who verify activity scope, safety measures, and participant eligibility.
  • Employees and volunteers who must attest to health conditions, emergency contacts, and acknowledgment of risks.

Use completed waivers as part of event records, payroll exception logs (if applicable), and post-event safety reviews.

Step-by-Step: Completing the Waiver

Follow these practical steps to finish the form accurately and efficiently.

  • 01
Review Activity: Read the activity description and safety instructions before signing.
  • 02
Provide Details: Enter name, employee ID, emergency contact, and medical notes.
  • 03
Consent and Release: Read acknowledgement and liability release language carefully.
  • 04
Sign and Date: Use a handwritten or valid electronic signature and include the date.

How the Waiver Fits into the Volunteer Workflow

This sequence shows where the waiver is created, signed, and stored during volunteer program operations.

  • Create Template: HR or legal uploads a tailored waiver version for the specific event.
  • Send to Participants: Distribute via email or a secure signing link before the event.
  • Capture Signature: Participants sign electronically or in person; audit trail is recorded.
  • Store Record: Store a copy in HR file and event folder for the retention period.

Essential Sections to Include in a Professional Volunteer Waiver

A robust waiver is concise but comprehensive. Include these six elements to reduce ambiguity and support enforceability.

Participant Details

Full legal name, employee ID, contact information, emergency contact, and relevant medical conditions to ensure accurate identification and emergency response.

Activity Scope

Clear description of tasks, location, dates, equipment, and organizer contact to define the environment and foreseeable hazards.

Risk Acknowledgment

A plain-language statement where the participant acknowledges inherent risks and the voluntary nature of participation.

Release of Liability

Explicitly state any release or waiver language, limitations of liability, and any indemnification obligations, drafted to comply with applicable state law.

Emergency Authorization

Consent for emergency medical treatment with space for provider, insurance, and primary physician details where appropriate.

Signature and Date

A signature block for the participant and an authorization field for an employer representative if required by internal policy.

Required Administrative and Security Details

Form Version: Include version/date
Record Owner: Designate HR or program lead
Access Controls: Restrict to authorized staff
Audit Trail: Log signature metadata
Data Encryption: TLS in transit
Retention Policy: Follow retention schedule

Common Preparation and Execution Pitfalls

  • Using vague activity descriptions that leave liability or duty unclear; this can undermine enforceability and complicate insurer reviews.
  • Failing to collect emergency contact or medical information ahead of the event, causing delays in response if an incident occurs.
  • Requesting signatures on the day of the event without allowing time to read or ask questions, which may later be contested.
  • Storing signed waivers in unsecured email inboxes or shared drives without access controls, increasing exposure to privacy breaches.

Legal Risks and Consequences of an Incorrect Waiver

Unenforceability: Waiver may be invalid
Insurance Denial: Claims could be refused
Regulatory Exposure: State labor rules apply
Personal Liability: Direct suits against organizers
Privacy Breach: HIPAA or data laws implicated
Reputational Harm: Program credibility damaged

Typical Configuration for an Electronic Waiver Workflow

Configure the digital workflow to capture intent, consent, and an auditable signature trail before the event date.

Field Configuration

Authentication Email link or SMS code

Digital Signing and Storage Best Practices

Use a platform that preserves signature metadata, supports secure storage, and offers role-based access control.
