What the Employee Worker’s Comp Waiver Is

An Employee Worker’s Comp Waiver is a written document that an employer or contracting party may use to document an employee's or contractor's purported agreement to limit or release certain workers' compensation claims or related liability. These waivers vary by jurisdiction and may be treated differently for employees versus independent contractors; many states restrict or void employee waivers as a matter of public policy. The instrument typically identifies the parties, the scope of any release, effective dates, consideration, signatures, and any required notarization or witness language. Use careful drafting and local legal review.

Why organizations prepare a Worker’s Comp Waiver

A clear waiver can document expectations and risk allocation between parties, reduce ambiguity about accepted risks, and record informed consent where allowed by law.

Why organizations prepare a Worker’s Comp Waiver

Who typically completes the Employee Worker’s Comp Waiver

Various workplace stakeholders prepare or sign waivers depending on role, employment status, and industry context.

  • Employers and HR teams use waivers for contractors or special assignments where state law permits limited releases of claims.
  • Independent contractors and gig workers may be presented waivers when accepting work with elevated risk exposure.
  • Risk managers, legal counsel, and safety officers review waiver language to align with insurance and compliance obligations.

Always confirm whether a waiver is permitted for employees in the applicable state and consider attaching additional disclosures or acknowledgements to support enforceability.

  • Failing to provide consideration or evidence of voluntary informed consent, which courts may require to uphold a release.
  • Neglecting notarization, witness signatures, or mandated disclosures where the jurisdiction or insurance policy requires them.

Plain-language acknowledgements
Use clear, unambiguous language explaining rights being waived, include an acknowledgment of voluntary consent, and offer a period for review to strengthen the record.
Document consideration
Specify and document the consideration provided in exchange for the waiver—monetary amounts, payments, or specific benefits—to avoid arguments about adequacy.
Tailor to jurisdiction
Confirm whether employee waivers are permitted under state law; tailor language to local statutory limits and required disclosures.
