What the Employment Agreement for Production Intern Covers

An Employment Agreement for Production Intern is a written contract that defines the working relationship between a production company and an intern assigned to film, stage, or studio work. It specifies role and responsibilities, hours, compensation or stipend, confidentiality and intellectual property treatment, health and safety obligations, and the agreement's effective and termination dates. For internships that include access to protected health or education information, the contract should reference applicable privacy rules. The agreement supports clear expectations and provides documentation needed for payroll, tax, and compliance purposes.

Why a Clear Written Agreement Matters

A written employment agreement reduces misunderstandings about duties, pay, and ownership of work, and helps meet legal and recordkeeping obligations under federal and state rules such as ESIGN and UETA.

Why a Clear Written Agreement Matters

Who Typically Prepares and Signs This Agreement

Use the agreement to document expectations, confirm authority to sign, and create an audit trail for future reference.

  • Hiring managers and production coordinators who need on-set coverage and schedule control.
  • HR or payroll teams handling stipends, wage classification, and tax reporting.
  • Legal counsel reviewing IP, confidentiality, and compliance with labor laws.

Primary Signers and Their Roles

Production Company Representative

Title and authority: Company officer or authorized HR representative signs on behalf of the employer; the narrative should explain their authority to bind the company and accept responsibility for payroll, supervision, and indemnities.

Production Intern

Intern responsibilities and acknowledgment: The intern signs to accept duties, working hours, confidentiality and IP assignments; signature indicates consent to electronic records if executed under ESIGN or state UETA rules.

Core Sections to Include in the Agreement

A professional agreement organizes obligations, compensation, and legal provisions so both parties understand rights and duties.

Position and Duties

Clear description of production intern tasks, reporting structure, typical hours, and expected deliverables.

Term and Schedule

Compensation

Stipend, hourly wage, reimbursements, travel expenses, and payroll classification (employee vs intern) with tax implications.

Confidentiality and IP

Nondisclosure obligations, ownership of recordings and creative contributions, and any license-back arrangements.

Health and Safety

Typical Digital Workflow for Executing the Agreement

A standard e-signature workflow reduces turnaround time and creates an audit trail for compliance.

  • Upload Document: Sender uploads the agreement as PDF or DOCX for field placement.
  • Add Signers: Enter intern and company signer emails and assign signing order if needed.
  • Authenticate Signers: Use email link, SMS code, or stronger methods for identity assurance.
  • Execute and Archive: Collect signatures, timestamp events, and store the signed copy with audit trail.

Digital Setup: Recommended Field and Routing Settings

Configure form fields and routing to match your approval and recordkeeping needs.

Field Configuration
Signature Required for intern and company rep
Date Auto-fill on signature
Initials Use for each page or key clause confirmations
Attachments Allow resume, proof of eligibility, or ID uploads

Technical Considerations for eSigning and Storage

Maintain an immutable signed copy with an audit trail and restrict access to HR and legal personnel for confidentiality.

  • File Formats: PDF and DOCX are standard and preserve layout across devices.
  • Integrations: Look for connectors with HR systems, payroll, and cloud storage.
  • Security: Ensure TLS in transit and AES-256 at rest for document protection.

Important Dates and Deadlines to Track

Certain dates in the agreement influence payroll, tax reporting, and compliance; track them carefully.

Effective Date:

Date duties and compensation begin; affects payroll period

Payroll Cutoff:

Align start date with payroll cycles to prevent missed payments

Tax Reporting:

Provide W-2 or 1099 information as required by tax deadlines

Insurance Coverage:

Confirm coverage effective date for on-set incidents
