Legal Disclosures and Policy Acknowledgment

At-Will Employment: I understand that employment, if offered, is at-will and may be terminated by the employer or me at any time, with or without cause and with or without notice, unless otherwise agreed in a signed written contract. This statement does not alter the at-will employment relationship unless a written agreement signed by an authorized representative specifically states otherwise.

Equal Opportunity: The employer provides equal employment opportunity and does not discriminate on the basis of race, color, religion, sex, national origin, age, disability, genetic information, or other protected characteristics as required by applicable law.

Drug and Alcohol Testing Consent

I acknowledge that the employer maintains a drug- and alcohol-free workplace policy. I understand and agree that as a condition of employment or continued employment I may be required to submit to testing for drugs and alcohol under the circumstances described below. I further understand that compliance with testing requirements is a condition of employment and refusal to submit to testing or a confirmed positive result may result in disciplinary action up to and including termination.

Circumstances under which testing may be required (check all that apply):

Specimen types that may be collected for testing (check all methods you consent to):

Medical and Confidentiality Consents

Medical Review: I authorize laboratory personnel and the employer's designated Medical Review Officer (MRO) to review test results and to discuss medically relevant information necessary to evaluate test results. I understand that the MRO will give me an opportunity to discuss any legitimate medical explanation for a confirmed positive test result prior to reporting to the employer.

Confidentiality: Test results and related medical records will be maintained in confidential files and disclosed only as permitted by law or as required for employment decisions, safety investigations, or treatment and rehabilitation referrals.

Prescription Medication Disclosure and Medical Conditions

If you are currently taking any prescription medications or over-the-counter medications that may affect test results or job performance, you must disclose them below. Disclosure does not imply exemption from testing; it allows the MRO to evaluate legitimate medical use.

If applicable, describe any medical condition that the MRO or treating physician should be aware of in relation to drug or alcohol testing:

Prior Test History and Explanations

Have you ever had a prior confirmed positive drug or alcohol test with any employer or testing program?

Authorization and Applicant Certification

By signing below, I certify under penalty of perjury that the information provided on this document is true and complete to the best of my knowledge. I authorize the employer, its agents, and service providers to obtain and release drug and alcohol test results and related medical information to each other, to the Medical Review Officer, to a treating physician as necessary, and to any other representative of the employer with a legitimate need to know for employment decisions.

I consent to the collection of samples, analysis, and disclosure described above and I authorize release of my prior drug and alcohol testing records to the employer and its agents for the purpose of determining eligibility for employment or continued employment. I understand that refusal to consent to testing, tampering with a specimen, or a confirmed positive result may result in discipline up to and including termination.

I further authorize the employer to contact my prior employers and references to verify employment history and inquire about past drug/alcohol testing results where permitted by law. I release all prior employers and references from liability for furnishing such information.

What an Employment Drug Statement Is

An Employment Drug Statement is a written acknowledgement and consent form used by employers to document an applicant's or employee's agreement to drug and alcohol testing. It typically identifies the testing circumstances (pre-employment, random, reasonable suspicion, post-accident), the types of tests to be used (urine, saliva, hair, breath), specimen handling and chain-of-custody procedures, and consequences for refusal or positive results. When handled electronically, the form must meet ESIGN (15 U.S.C. ch. 96) and applicable state e-signature laws to be legally enforceable, and may implicate HIPAA or privacy requirements when test results contain protected health information.

Why a Clear Employment Drug Statement Matters

A well-crafted Employment Drug Statement documents informed consent, reduces legal ambiguity, and supports consistent application of testing policies. It helps protect workplace safety, demonstrates compliance with applicable federal and state rules, and creates an auditable record of employee acknowledgement.

Why a Clear Employment Drug Statement Matters

Who's Responsible for Completing and Managing This Form

Employers and HR teams generally issue the Employment Drug Statement; employees or applicants must complete and sign it prior to testing.

  • Human resources and talent acquisition staff who manage hiring, onboarding, and policy enforcement.
  • Safety and operations managers at companies with safety-sensitive roles (transportation, construction, manufacturing).
  • Third-party administrators, occupational health clinics, and collection site staff who coordinate specimen collection.

Maintain signed statements as part of the employment record and follow applicable retention and privacy rules for medical or test-result data.

Core Sections to Include in an Employment Drug Statement

A comprehensive statement organizes consent, identity, testing protocol, privacy, consequences, and contact details so employees understand what to expect and employers capture legally relevant acknowledgements.

Employee identity

Full legal name, date of birth, employee ID, and contact details to match specimen labels and chain-of-custody forms.

Scope of testing

Specify whether testing is pre-employment, random, reasonable suspicion, post-accident, return-to-duty, or follow-up testing.

Type of specimen

List acceptable specimen types (urine, saliva, hair, breath) and any alternate collection methods or refusal definitions.

Consent and authorization

Clear language authorizing collection, analysis, release of results to designated parties, and waiver of liability where appropriate.

Privacy notice

Describe who will receive results, how they are protected, and references to HIPAA or company privacy policies when applicable.

Consequences

Outline disciplinary actions, testing program remedies, and appeal or retest processes for disputed results.

Security and Compliance Elements to Record

Encryption: TLS 1.2/1.3; AES-256 at rest
Audit trail: Time-stamped signing events and IP metadata
HIPAA controls: BAA required for covered entities
Access controls: Role-based access and MFA
Retention policy: Defined secure retention and deletion rules
Certifications: SOC 2 Type II, ISO 27001 where applicable

Step-by-Step: Completing an Employment Drug Statement

Follow these sequential steps to issue, complete, and record the statement correctly in paper or electronic form.

  • 01
Prepare the form: Insert employer details, test policy, and required fields before sending.
  • 02
Provide to signer: Share via secure link, email, or in-person at collection site.
  • 03
Collect consent: Signer reviews, initials where required, and executes signature with date.
  • 04
Record and store: Save signed copy to HR file and follow retention rules.

Setting Up an Electronic Workflow for the Statement

Use these configuration items to create an auditable, compliant e-signing flow for employment drug statements.

Field Configuration
Authentication Method Email link with optional SMS code for stronger identity
Signature Type Allow typed or drawn signatures; require checkbox consent for legal acknowledgement
Conditional Fields Show follow-up fields only when a positive test or refusal is selected
Retention Policy Automatically retain signed PDF and audit trail per retention rules

Technical Considerations for eSubmission and Signing

Ensure the platform supports required security, recordkeeping, and integrations before routing the statement for signature.

  • Integrations: HRIS, ATS, and occupational health system connectivity
  • File formats: PDF and DOCX support for final signed records
  • Mobile support: Responsive signing on tablets and phones

Confirm the provider can supply auditable audit trails, encryption in transit and at rest, and a BAA if the employer is a HIPAA-covered entity.

Typical Electronic Signing Flow for the Statement

A standard eSignature workflow minimizes friction while preserving identity evidence and an audit trail for future compliance reviews.

  • Upload document: Sender uploads the Employment Drug Statement to the e-sign platform.
  • Place fields: Add name, date, signature, and conditional test result fields.
  • Send to signer: Dispatch secure link or email with signing instructions.
  • Sign and record: Signer completes form and system stores signed copy plus audit trail.

Timing Expectations and Common Deadlines

Understand the timing triggers that commonly apply to employment drug testing and associated documentation.

Pre-employment testing:

Completed after conditional offer and before first day when policy requires

Post-accident testing:

Conducted promptly; many employers require testing within 24–72 hours of incident

Random testing schedules:

Administered per published pool schedule or DOT rules where applicable

Result reporting:

Negative results typically reported within 24–48 hours; confirm lab SLA

Dispute retest window:

Allow time for confirmatory testing and disciplinary review per company policy

Common Preparation and Documentation Errors to Avoid

  • Using inconsistent names or IDs between the statement and lab forms, which breaks chain of custody.
  • Failing to obtain explicit consent language or required acknowledgements before specimen collection.
  • Storing results or signed statements in unsecured systems that lack encryption or access controls.
  • Overlooking industry-specific rules (for example, DOT/49 CFR Part 40) that impose stricter testing and result-handling procedures.

Potential Consequences of Incorrect or Missing Statements

HIPAA violation: Civil penalties and corrective action
Discrimination claim: Wrongful discipline or termination exposure
Chain-of-custody break: Lab results may be inadmissible
Regulatory fines: DOT or agency penalties for noncompliance
Operational delay: Hiring or return-to-duty postponements
Reputational harm: Loss of trust with employees and regulators
