Core Contract Elements to Include

A professional Employment Heavy Vehicle Operator Contract should clearly allocate risk, specify safety standards, and include operational, compensation, and compliance provisions.

Operator Duties

Detail the operator's permitted vehicle classes, expected routes, load types, hours of service, and any limitations. Precise duty descriptions reduce disputes and support disciplinary actions tied to safety violations.

Licenses

Require proof of current CDL, state-specific endorsements, valid medical examiner's certificate, and periodic background checks. State which party is responsible for renewal and consequences for lapses.

Compensation

State base wages, overtime and per-mile rates, per diem eligibility, reimbursable expenses, and pay schedule. Clarify payroll tax treatment, authorized deductions, and final pay on termination.

Safety Policies

Include drug and alcohol testing protocols, daily vehicle inspection checklists, required PPE standards, accident investigation steps, mandatory reporting timelines, and progressive disciplinary measures for noncompliance.

Insurance

Specify required liability, cargo and physical damage insurance limits, certificate of insurance requirements, naming of additional insureds, proof deadlines, and indemnity allocation between parties explicitly.

Termination

Define causes for immediate termination, required notice periods, final pay procedures, handling of accrued benefits, return of company property, and post-termination confidentiality obligations and arbitration procedures.

Frequent Preparation Pitfalls to Avoid

  • Omitting clear drug and alcohol testing protocols or failing to align policies with DOT and FMCSA rules increases compliance risk and potential regulatory penalties.
  • Not verifying CDL endorsements, medical certification, or driving records leads to hiring unqualified drivers and undermines insurance coverage or defense in claims.
