For Non-Exempt employees, overtime will be paid at one and one-half times the regular rate for hours worked in excess of 40 hours in a workweek, unless otherwise required by applicable law. Employer reserves the right to modify pay practices in compliance with law and to provide written notice of any change.

Absent a signed covenant, no additional restriction is created by this Addendum unless explicitly stated and signed by both parties.

If no such procedure exists, disputes shall be subject to binding arbitration administered in the jurisdiction identified below, unless otherwise prohibited by law.

What the Employment Labor Addendum Is

An Employment Labor Addendum is a written attachment to an employment agreement that records specific labor-related terms not set out in the core contract. Typical addenda address wage rates, overtime rules, classification (exempt versus nonexempt), meal and rest periods, collective bargaining provisions, paid leave, and any temporary or project-specific conditions. Employers use an addendum to update or clarify obligations without redrafting the primary employment agreement; employees receive a clear, discrete statement of the labor terms that govern pay, hours, benefits, and dispute resolution for a defined period or task.

Why an Addendum Matters for Employers and Employees

An Employment Labor Addendum provides legal clarity for narrow, time-limited, or changing labor conditions. It reduces ambiguity about pay and hours, supports compliance with wage-and-hour laws, and documents agreed exceptions to standard policies while preserving the main contract language.

Why an Addendum Matters for Employers and Employees

Typical Users and When It’s Applied

Employers, HR professionals, union representatives, and legal counsel commonly prepare Employment Labor Addenda when specific labor terms differ from a standard employment agreement.

  • HR managers adjusting pay or schedules for a project-based role.
  • Small-business owners documenting temporary overtime or premium pay agreements.
  • Union reps adding or clarifying side letters tied to collective bargaining.

Use an addendum whenever the parties need a concise, focused amendment to labor terms without replacing the primary employment contract.

Who Signs and Why

Employer Representative — HR Director

The HR director or designated company officer typically signs to bind the employer to the addendum and confirm that the terms align with internal policies and applicable wage laws. Their signature indicates organizational approval and responsibility for implementation.

Employee or Union Rep

The employee (or authorized union representative) signs to acknowledge agreement to the specified labor terms. Signature confirms consent and enables enforceability under ESIGN/UETA standards when properly executed.

Core Elements to Include in a Professional Addendum

A comprehensive Employment Labor Addendum is concise but complete. It identifies parties, states the effective and expiration dates, describes modified labor terms, references the main employment agreement, and specifies dispute resolution and governing law.

Citation of the original employment agreement and statement that the addendum modifies specified sections only.

Dispute Resolution

Any agreed arbitration, mediation, or forum selection provisions specific to addendum disputes.

Signatures

Signature block for authorized employer signatory and the employee, including printed names and dates.
