Screening Authorization and Disclosure

I acknowledge and understand that as a condition of my application for employment or continued employment with the identified Employer, the Employer may obtain consumer reports and investigative consumer reports concerning my background. These reports may include, as applicable: criminal history, credit history, driving and motor vehicle records, educational verification, employment verification, professional license verification, credential verification, drug screening results, and references.

I authorize the Employer and its designated agents and service providers to obtain such reports for employment purposes. I understand that such reports may be obtained prior to, during, and for the duration of my employment where permitted by law. I further authorize without reservation any person, agency, institution, or other entity to provide the Employer and its agents with relevant information and records.

I understand that the Employer may obtain an investigative consumer report that includes information about my character, general reputation, personal characteristics, and mode of living, obtained through personal interviews with sources such as neighbors, friends, or acquaintances. I have the right to request disclosure of the nature and scope of any investigative consumer report requested. I may request this disclosure by written request to the Employer.

Background Information

Have you ever been convicted of a felony or misdemeanor, pled guilty or no contest, or had a plea deferred? If yes, provide details below. Convictions will not necessarily disqualify you from employment; consideration will be given to the nature, date, and relation to the job.

Acknowledgements and Applicant Certification

By signing below, I certify that all information I have provided in this document and any attachments is true, correct, and complete to the best of my knowledge. I understand that false statements, omissions, or misrepresentations may disqualify me from employment or be grounds for disciplinary action, up to and including termination.

I expressly authorize the Employer to contact my prior employers, educational institutions, references, and other third parties to verify the information I have provided and to obtain consumer and investigative consumer reports as described above. I release and hold harmless all persons and entities furnishing information to the Employer from any liability for damages arising from furnishing such information.

I acknowledge receipt of this Employment Screening Disclosure and Consent and understand that if the Employer intends to take adverse action based in whole or in part on information contained in a consumer report, I will receive notice and a copy of the report and an opportunity to dispute the accuracy of that information prior to any final adverse action, where required by law.

Equal Opportunity and At-Will Employment

The Employer is an equal opportunity employer. Decisions regarding hiring and employment are made without regard to race, color, religion, sex, national origin, age, disability, veteran status, or any other protected characteristic under applicable law.

Unless otherwise set forth in a written agreement signed by an authorized representative of the Employer, I understand that employment with the Employer is at-will and may be terminated by either party at any time, with or without cause or notice.

What an Employment Screening Disclosure Is and When It Applies

An Employment Screening Disclosure is a written notice provided to a job applicant or employee that explains an employer's intent to obtain consumer reports or conduct background checks. It typically describes the types of checks (criminal history, credit, driving record, drug testing), requests the individual's written authorization, and clarifies how results may affect hiring decisions. The disclosure helps satisfy notice and consent requirements under consumer reporting and employment laws and is commonly used before submitting information to third-party background check vendors.

Why a Clear Disclosure Matters for Hiring and Compliance

A proper Employment Screening Disclosure documents consent, reduces legal risk, and creates a transparent hiring process. It supports compliance with consumer reporting requirements, helps defensibly manage adverse actions, and improves candidate experience by setting expectations about scope and use of screening results.

Why a Clear Disclosure Matters for Hiring and Compliance

Who Typically Prepares and Receives This Disclosure

Employers, HR teams, and third-party screening vendors commonly use this disclosure as part of pre-employment checks.

  • In-house HR teams handling hiring, onboarding, and recordkeeping for compliance and auditing.
  • Recruiting firms and staffing agencies ordering consumer reports for placement decisions.
  • Background-check vendors processing reports and returning adjudication-ready results to employers.

Applicants and current employees receive and sign the disclosure before any report is requested or action is taken.

Core Elements of a Professional Employment Screening Disclosure

A complete disclosure is concise, uses plain language, and explicitly covers scope, authorization, data sources, and applicant rights.

Scope of Checks

List each type of check (criminal, credit, driving, education, references, drug testing) and any limitations so applicants understand exactly what will be reviewed.

Authorization

A clear authorization statement that the applicant signs permitting the employer or its agent to obtain consumer reports and other screening information.

Source Identification

Identify the consumer reporting agency or vendor category that will supply reports and note that third-party sources may be consulted.

Use and Adverse Action

Explain how results will be used and describe the employer's pre-adverse and adverse action process if screening affects hiring or terms of employment.

Consumer Rights

Summarize key rights (to dispute inaccuracies, obtain a free report in certain cases) and how the applicant can request more information.

Signature Block

Provide a dated signature line or e-signature field and a short consent checkbox confirming voluntary authorization.

Essential Fields to Include

Applicant Name: Full legal name
Date of Birth: MM/DD/YYYY
SSN or TIN: Last four or full as required
Current Address: Street, city, state, ZIP
Consent Checkbox: Explicit yes/no consent
Signature and Date: Signed name and date

Step-by-Step: Completing the Disclosure

Follow these steps to capture valid consent and prepare the disclosure for screening.

  • 01
Prepare the form: Insert scope, vendor type, and plain-language instructions.
  • 02
Collect identity data: Enter full name, DOB, address, and SSN/TIN as specified.
  • 03
Obtain signature: Have applicant sign and date before ordering reports.
  • 04
Record retention: Store signed copy according to retention policy.

Configuring Online Screening Workflows

Set up digital fields and authentication according to your risk and compliance needs.

Field Configuration
Authentication Level Email link, SMS code, or stronger KBA
Consent Disclosure Display prior to signature
Conditional Fields Show additional consent if certain checks selected
Attachments Required Upload ID or consent documents as needed

Delivering and Signing the Disclosure Electronically

Use a secure e-signature platform that supports audit trails, data encryption, and user authentication.

  • Browser Compatibility: Works on modern Chrome, Edge, Safari
  • Integrations: Connects to ATS, HRIS, and background vendors
  • File Formats: PDF and DOCX supported

Ensure chosen tools offer retention controls and an accessible copy for the applicant; configure authentication strength to match legal requirements.

Where to Send or Submit the Signed Disclosure

Routes typically include the applicant, HR record, and the screening vendor; document each handoff for auditability.

  • To the Applicant: Provide a signed copy for their records
  • To Background Vendor: Transmit authorization and identity data securely
  • To HR File: Store signed disclosure in employee record
  • To Hiring Manager: Share adjudication summary without sensitive raw data

Timing and Processing Expectations

Understand candidate timing and vendor turnaround to set expectations and meet legal notice obligations.

Before Ordering Checks:

Provide disclosure and obtain signed consent prior to requesting reports

Vendor Turnaround:

Background report delivery typically 1–5 business days

Pre-Adverse Action Window:

Allow time to review reports and prepare notices before any adverse decision

Adverse Action Timing:

Issue pre-adverse and final notices promptly following decision

Record Access:

Provide applicant access to report details when required

Common Preparation Errors to Avoid

  • Failing to obtain signed consent before ordering a report, which can violate consumer reporting rules and increase legal risk.
  • Using vague scope language that does not specify report types, creating ambiguity when an adverse decision is based on screening.
  • Collecting incomplete identity data (misspelled name or wrong DOB) that causes mismatches and delays in report retrieval.
  • Neglecting to document pre-adverse and adverse action steps, reducing defensibility in case of disputes or regulatory review.

Short Risks and Regulatory Consequences

FCRA Penalties: Civil liability and statutory damages
State Consumer Actions: State enforcement and fines possible
Reputational Harm: Negative publicity and candidate loss
Operational Delays: Hiring slowdowns and extra costs
Incorrect Decisions: Unfair adverse action risk
Data Breach Liability: Privacy breach exposures

Practical Tips for Accurate, Efficient Disclosures

Adopt consistent templates and validation rules to reduce errors and speed processing across hires.

Use plain-language templates and version control
Maintain a single template repository and clear versioning so all hiring managers use the same approved disclosure language and fields, reducing legal exposure and inconsistent candidate experiences.
Validate identity data at entry
Require full legal name, MM/DD/YYYY birth date, and formatted address fields with input masks to prevent mismatches during vendor matching that can delay reporting or generate false positives.
Capture consent with an auditable e-signature
Use an e-signature solution that records timestamps, IP addresses, and authentication method so consent is demonstrable and defensible if a dispute arises.
Document adverse-action steps consistently
Prepare pre-adverse and adverse notices and retain copies to ensure compliance with consumer reporting requirements and to support decisions in case of candidate challenge.

Real-World Examples of How Disclosures Are Used

Two brief scenarios show practical application of Employment Screening Disclosures in different hiring environments.

Seasonal Retail Hiring

A regional retailer uses a concise disclosure during online onboarding to authorize criminal and identity checks.

  • The vendor returns results within two business days for most candidates.
  • The retailer retains signed disclosures for three years and provides adverse-action notifications when reports influence hiring decisions, improving auditability.

Healthcare Staff Onboarding

A clinic requires disclosures for credential and background screening as part of credentialing.

  • Checks include criminal history and professional license verification.
  • The clinic stores signed authorizations securely under HIPAA-aware controls and documents adverse-action steps for regulatory compliance and patient safety.

Who Signs and Who Manages the Disclosure

Nina Patel, HR Manager

Nina coordinates hiring and maintains signed disclosures in the HRIS. She verifies that screening orders are only placed after written candidate authorization and retains records according to internal retention schedules and applicable law.

Marcus Lee, Background Vendor Lead

Marcus receives the authorized request, matches identity data, and returns consumer reports with a vendor audit trail. He supports dispute resolution by providing data provenance and timelines to employers when necessary.
