What the Employment Teaching Agreement Covers

The Employment Teaching Agreement is a written contract that defines the working relationship between an employing institution and a teaching professional. It sets out role and responsibilities, compensation, schedule, academic or instructional duties, intellectual property ownership where applicable, confidentiality, termination rights, and any conditions for renewal or reappointment. Employers use it to align expectations, manage compliance with institutional policies and applicable laws, and create a record of terms that govern employment. The agreement may be executed in paper or electronically under U.S. e-signature laws.

Why a Clear Agreement Matters

Use an Employment Teaching Agreement to clarify duties, protect institutional interests, and document compensation and schedules. It reduces disputes, supports regulatory compliance under ESIGN and UETA when signed electronically, and provides enforceable terms for employment duration, performance expectations, and termination procedures.

Why a Clear Agreement Matters

Who Typically Completes This Agreement

Typical users include academic departments, independent schools, tutoring centers, and adjunct faculty arranging teaching engagements and employment terms.

  • Public and private colleges hiring full-time and part-time instructors for semester or year-long appointments.
  • K–12 schools contracting long-term substitute teachers, curriculum specialists, or extracurricular coaches under written terms.
  • Private tutors and training providers establishing payment, schedule, cancellation, and deliverable expectations in writing.

Signed agreements provide a clear record for payroll, benefits eligibility, and resolving performance or contractual disputes.

Core Sections to Include in the Agreement

Core sections define duties, compensation, teaching schedule, intellectual property, confidentiality, performance evaluation, renewal conditions, and termination procedures tailored to teaching roles.

Duties

Specify instructional responsibilities, course load, office hours, grading obligations, committee service, and any supervisory duties for students or teaching assistants, including expectations for curriculum development and assessment methods.

Compensation

Detail base salary, hourly rates for adjuncts, stipend structure, payment schedule, fringe benefits, reimbursements for materials or travel, and conditions for bonuses or merit increases.

Schedule

Include start and end dates, regular working hours, class meeting times, required orientation or training dates, and procedures for schedule changes or make-up sessions for missed classes.

IP and Materials

Address ownership of course materials, lecture recordings, and student work; define license grants, rights to reuse, and policies for using institution logos or proprietary content.

Confidentiality

Set obligations to protect student data, proprietary research, and institutional records, and specify any FERPA or HIPAA-related restrictions that apply to educational or health-related information.

Termination

State notice periods, grounds for immediate termination, severance provisions if any, obligations on resignation, and post-termination restrictions such as non-disparagement clauses.
