What an Employment Visa Service Agreement Covers

An Employment Visa Service Agreement is a written contract between an employer (or its agent) and a visa services provider or employee that describes the scope of immigration-related services, responsibilities, timelines, fees, and data handling. It typically covers which USCIS petitions or consular processes will be filed, who prepares supporting evidence, fee allocation, consent to submit personal data, and dispute resolution. The document clarifies whether the provider offers legal representation or administrative assistance and sets expectations for communication, biometrics, and post-approval obligations under U.S. immigration rules.

Why a Clear Agreement Matters for Employers and Employees

A written Employment Visa Service Agreement reduces misunderstandings, allocates costs and responsibilities, and creates an audit trail useful for compliance and dispute resolution. It documents consent to share personally identifiable information, clarifies who controls filings, and sets realistic timelines tied to USCIS or consulate procedures.

Why a Clear Agreement Matters for Employers and Employees

Who Typically Relies on an Employment Visa Service Agreement

Common parties that use or prepare this agreement and why they need it.

  • Employers and HR teams handling sponsored hires and cost allocation for immigration services.
  • Immigration attorneys or accredited representatives managing petition drafting, filing, and legal advice.
  • Foreign national employees who need clarity on fees, documentary responsibilities, and data sharing.

The agreement helps these groups document commitments, protect data, and manage regulatory steps throughout the immigration process.

Step-by-Step: Completing and Executing the Agreement

Follow a simple sequential process to gather documents, execute the agreement, and initiate filings with consistent records.

  • 01
Prepare Documents: Collect IDs, paystubs, education credentials, and employer records.
  • 02
Execute Agreement: All parties sign, date, and initial each page as required.
  • 03
Submit Forms: Provider files USCIS petitions or prepares consular packet.
  • 04
Track Case: Monitor USCIS notices, biometrics, RFEs, and final decisions.

Core Clauses to Include in Professional Agreements

A robust Employment Visa Service Agreement isolates obligations, timelines, and remedies. Include clauses that address service scope, payments, data privacy, and post-approval responsibilities to reduce disputes and ensure compliance.

Scope of Services

Define the exact filings, consulting, and document-preparation tasks the provider will perform, including exclusions and any deliverables.

Fee Structure

Describe all fees, who pays government and legal fees, invoicing timing, retainer conditions, and any refund or surcharge policies.

Timeline & Milestones

Set expected dates for document submission, filing, biometrics, and anticipated processing windows while noting USCIS variability.

Responsibilities

List required employer and employee actions, documentation to provide, and consequences for missed deadlines or withheld information.

Confidentiality & Data

State how personal data will be stored, shared, and protected, and whether a Business Associate Agreement is needed for health data.

Termination & Remedies

Explain termination rights, refund calculations, and dispute resolution (mediation, arbitration, or court).

Sensitive Data Elements Often Collected

Passport Number: Sensitive identifier
Date of Birth: Essential for identity
Social Security Number: Protected personal data
USCIS A-Number: Immigration record ID
Employer EIN: Company tax ID
Consent Records: Signed data-sharing consent

Common Preparation Pitfalls to Avoid

  • Using nicknames or initials instead of the full legal name on government IDs, which can cause USCIS rejections or RFEs.
  • Omitting supporting evidence such as detailed job descriptions, degree evaluations, or client letters required for specialty occupations.
  • Failing to allocate who pays specific USCIS or attorney fees, leading to disputes and potential nonpayment delays.
  • Not retaining a complete signed copy and audit trail, complicating responses to RFEs and compliance requests.

Consequences of Incomplete or Incorrect Agreements

Filing Delays: May cause missed visa windows
Form Rejection: Incorrect data can prompt denials
I-9 Violations: Civil penalties and fines
Fee Disputes: Contractual breach claims
Unauthorized Practice: Non-lawyer advice risks
Data Breach: Regulatory and reputational harm

Configuring an Online Workflow for Agreement Execution

Set up an efficient digital workflow that enforces field requirements, signer order, and secure storage to reduce errors and speed execution.

Digital Signing and File Delivery Considerations

Choose a platform that supports secure eSignatures, audit trails, and required authentication for immigration documentation.

  • Integrations: Salesforce, NetSuite, Microsoft 365 supported
  • File Formats: PDF, DOCX, and fillable forms
  • Authentication: Email, SMS, KBA, or advanced auth

Where to Sign, File, and Share the Agreement

The agreement typically stays with employer and provider; copies accompany USCIS filings or serve as internal evidence of consent and fee allocation.

  • Upload Agreement: Store signed copy in encrypted cloud repository
  • Assign Signers: Add employer and employee signer emails and roles
  • eSign & Notarize: Apply eSignature; arrange notarization or RON if required
  • Distribute Copies: Deliver executed PDF to all parties and counsel
