What the Exempt Hourly Employee Agreement Is

An Exempt Hourly Employee Agreement documents the terms for employees who are paid hourly but classified as exempt from overtime under applicable wage-and-hour laws. It combines pay rate, expected work schedule, exemption basis, job duties, and any special conditions or meal and rest break policies into a single, signed record to reduce classification disputes and clarify expectations.

Why a Clear Agreement Matters

A well-drafted Exempt Hourly Employee Agreement reduces legal risk, improves payroll accuracy, and sets expectations for pay and duties. It helps employers document the factual basis for exemption and provides employees with an accessible record of terms.

Why a Clear Agreement Matters

Who Typically Prepares and Signs This Agreement

Human resources, payroll administrators, and hiring managers commonly prepare the agreement so pay classification and job duties are aligned before work begins.

  • HR managers and payroll teams who must document exemption rationale and maintain wage records.
  • Hiring managers who need to define duties, schedules, and managerial expectations.
  • Employees whose classification or pay method differs from typical hourly or salaried roles.

Keep copies in the employee file and provide a signed copy to the employee to ensure transparency and support recordkeeping requirements.

Step-by-Step: Complete the Agreement

Follow these core steps to complete and finalize the Exempt Hourly Employee Agreement accurately.

  • 01
Prepare: Gather job description, classification basis, and payroll settings.
  • 02
Fill: Enter names, dates, rates, duties, and exemption justification.
  • 03
Review: Have HR and legal review classification and language.
  • 04
Sign: Obtain dated signatures from authorized signer and employee.

Common Preparation Errors to Avoid

  • Using vague duty descriptions that fail to show primary exempt tasks and invite misclassification claims.
  • Leaving dates blank or backdating agreements; inconsistent dates can undermine enforceability and audit trails.
  • Mismatched names between payroll, tax records, and the agreement causing withholding and identity verification issues.
  • Failing to retain signed copies for the legally required period for payroll and tax audit defense.
