What the Faculty Employment Agreement Is

Faculty Employment Agreement is a legally binding contract between a higher-education institution and an academic employee that sets terms of appointment, compensation, duties, benefits, intellectual property, tenure or contractual status, and termination conditions. It typically names the faculty member’s title, start date, teaching and research expectations, service obligations, salary and benefits, leave and sabbatical provisions, confidentiality, conflict-of-interest rules, and dispute resolution procedures to provide a clear record of rights and responsibilities under applicable federal and state law.

Why a Clear Written Agreement Matters

A Faculty Employment Agreement aligns expectations, documents compensation and duties, and supports compliance with employment and tax laws. Clear written terms reduce disputes, expedite onboarding, and preserve evidence for tenure reviews, grievance procedures, and post-employment obligations.

Why a Clear Written Agreement Matters

Who Prepares and Signs These Agreements

HR, department chairs, academic administrators and faculty commonly use the Faculty Employment Agreement to record appointment terms and institutional policies.

  • University human resources offices for onboarding, payroll setup, benefits enrollment, and recordkeeping.
  • Department chairs and deans for defining duties, teaching load, research expectations, and service assignments.
  • Faculty members and their counsel for confirming salary, leave, IP rights, and dispute mechanisms.

Keep executed copies in the personnel file and provide signed originals to the faculty member, payroll, and department to ensure enforceability and clarity.

Primary Roles Involved

HR Director

As the appointing authority’s records manager, the HR Director ensures the Faculty Employment Agreement is completed, countersigned, and stored according to institutional retention policies. They coordinate payroll setup, benefits enrollment, and any background checks required before the faculty member’s start date.

Faculty Member

The faculty member reviews the agreement for accuracy, negotiates terms as needed, signs and returns the executed document, and retains a copy for personal records. Accurate personal data and timely signature are critical to avoid payroll, benefits, or immigration delays.

Core Sections to Include in the Agreement

Key sections define appointment, compensation, duties, IP rights, confidentiality, leave, termination, and dispute resolution, clarifying rights and obligations for faculty and institution.

Termination & Leave

Outlines resignation, termination for cause or convenience, notice periods, sabbatical eligibility, unpaid leave, disability leave, and severance or remediation procedures where applicable.

Dispute Resolution
