Date: case information is as follows: case number: date: in my mind, if the court were to hear this motion for a speedy trial, the judge would find the facts, and there would be no more reason to have a trial so close to the end of the court's term. This does not necessarily mean the judge won't grant the motion. That can be decided on a case by case basis, but the judge will surely grant it if given probable cause to believe an important issue could be proven and set for trial. A motion for a speedy trial, when granted, means the trial may be the same day or within the next two weeks. Some states don't have speedy trial statutes because the state doesn't know if a new trial is appropriate and doesn't care to hold them. There are exceptions though. One is Maryland and pennsylvania. The only state that has a speedy trial statute is Texas. In a quick search of the texas courts I don't find a single case where a case has been set for trial for two weeks or fewer. Even if it did, it is still likely that a new trial would be ordered. I think the Texas courts are more careful, but still, in a normal circumstances, I believe the trial can continue in a few days. Other states are closer to the standard I'm proposing as opposed to being closer to Texas, though, the standard would still allow for a speedy trial because the court sees the evidence and the evidence could not justify another trial more than six weeks after the case was originally scheduled. You may want to consult your attorney. In other words, consult your court's attorney in any way you can to determine what to do in any given case. If you decide to accept this offer, don't feel compelled to tell the judge if you won't be available on the day to answer questions from the defense. If you decide not to accept the offer, you may be able to argue that you have already lost a few days of work due to not being able to defend your client. In this case the judge may deny this motion.
