Common Mistakes to Avoid

  • Omitting exact legal names or using nicknames causes mismatches with tax or payroll systems and may trigger backup withholding or identity-verification delays.
  • Failing to specify compensation details, overtime eligibility, or exempt status increases risk of wage disputes and misclassification under federal wage laws.
  • Not obtaining clear electronic-consent disclosures for consumer-facing elements can undermine enforceability under ESIGN and may require paper consent.
  • Storing multiple unsigned drafts or inconsistent versions without audit trails creates audit failures and gaps in the chain of custody during compliance reviews.

Penalties and Regulatory Risks of Errors

Tax Penalties: Penalties under IRC §6721 for late filings.
I-9 Violations: Civil fines $281–$2,789 per violation under DHS rules.
Backup Withholding: Missing or incorrect TINs can trigger 24% withholding.
Contract Disputes: Ambiguous terms increase litigation risk and damages.
HIPAA Exposure: Improper PHI handling may violate HIPAA; BAA required.
Recordkeeping Failures: Insufficient retention can hinder audits and regulatory response.

Best Practices for Accurate, Defensible HR Documents

Adopt practices that reduce legal risk, ensure accurate payroll setup, and make onboarding efficient for both HR and new hires.

Verify identity and tax information early
Collect government-issued ID, Social Security or TIN, and completed tax forms before the first payroll run. Early verification prevents backup withholding, payroll delays, and misreporting to the IRS; retain copies according to retention schedules and document verification steps in the employee file.
Use clear compensation and classification language
State exempt or non-exempt status, overtime eligibility, pay basis, and commission calculation examples. Clear language reduces misclassification risk under the FLSA, supports accurate payroll calculations, and establishes a defensible record in the event of wage disputes or audits.
Obtain explicit electronic consent where required
For consumer-facing or benefit-related documents, present an ESIGN-compliant disclosure and record the employee's consent. Document how consent was obtained and retained; this protects enforceability and satisfies 15 U.S.C. §7001 consumer disclosure requirements.
Maintain version control and audit trails
Use a single authoritative template, record every edit and signer event, and store the final signed PDF with the audit trail. Version control prevents conflicting terms and provides evidence of intent, attribution, and record retention for compliance reviews.
